41Suspension or cancellation

41 Suspension or cancellation (1) This section applies if: (a) after considering the accepted representations for the show cause notice, the CEO: (i) still believes a ground exists to suspend or cancel the approval; and (ii) believes suspension or cancellation of the approval is warranted; or (b) there are no accepted representations for the show cause notice. (2) The CEO may: (a) if the proposed action stated in the show cause notice was to suspend the approval for a stated period – suspend the approval for not longer than the stated period; or Environment Protection (Beverage Containers and Plastic Bags) Act 2011 26 (b) if the proposed action stated in the show cause notice was to cancel the approval – either cancel the approval or suspend it for a period. (3) The CEO must immediately give a review notice for the decision to the holder of the approval. (4) The decision takes effect on: (a) the day the review notice is given to the holder; or (b) if a later day of effect is stated in the notice – the later day.
