12Coordinator arrangement

12 Coordinator arrangement (1) Each CDS coordinator must make a waste management arrangement with each other CDS coordinator. (2) A coordinator arrangement may be made by: (a) all of the CDS coordinators entering into one arrangement; or (b) any of the CDS coordinators entering into an arrangement with any of the other coordinators in a way that ensures all of the arrangements have the effect of one arrangement between all of the coordinators. (3) A coordinator arrangement must include provisions that contain the agreements specified in Schedule 1. (4) An agreement made as specified in Schedule 1 is taken to form part of the coordinator arrangement. (5) For section 51(1)(d)(i) of the Commonwealth CCA and with reference to section 51(1C)(e) of that Act, CDS coordinators are authorised to: (a) make a coordinator arrangement; and (b) include in the coordinator arrangement provisions that: (i) deal with the matters mentioned in section 11(2); and (ii) contain the agreements specified in Schedule 1; and (c) give effect to the coordinator arrangement. Note for subsection (5) The effect of this subsection is that anything mentioned in paragraphs (a) to (c) that is done by a CDS coordinator is not to be regarded in deciding whether the coordinator has contravened Part IV of the Commonwealth CCA. (6) This section does not limit section 11.
