Environment Protection and Biodiversity Conservation (National Recovery Plan for the Malleefowl (Leipoa ocellata)) Instrument 2024

The plan rests on a small set of technical and governance concepts that determine how conservation activity will be prioritised, measured and coordinated.

Monitoring as the indicator of status: The plan uses mound activity and presence indicators as proxies for population trend and occupancy. Objective 1 treats annual measures of mound activity as an indicator of population trend (mound activity is assumed to indicate number of breeding birds). Objective 2 treats area of occupancy (AOO) calculated using IUCN AOO methods on presence‑only data as the metric for distributional resilience (see Objective 1 and Objective 2). For arid areas where mounds are rare, the plan relies on footprint/track surveys rather than mound counts (Monitoring).

Adaptive‑management experimentation: The AMPE is an explicit experimental design to learn about the effect of predator (fox and cat) reduction on Malleefowl breeding activity. It sets up paired treatment and control sites, with predator management in treatments and no intervention in controls, to isolate predator control effects from other environmental drivers (see 2.6).

Standardisation and data centralisation: The plan emphasises standardised monitoring protocols, training, a national monitoring manual, smartphone app tools, data validation and a National Malleefowl Monitoring Database managed by the NMRG. The objective is to produce national and regional trend analyses to inform management decisions (see 2.5).

Role of volunteers and community groups: The plan assumes a large volunteer base for field monitoring; it notes over 1000 members across groups and more than 100 active field volunteers. The NMRG is explicitly volunteer‑based and coordinates volunteer monitoring, training and data validation (see 2.5, 2.3).

First Nations leadership and customary practice: First Nations engagement is elevated from participation to a stated objective. The plan seeks to promote Traditional Knowledge, Indigenous land management (notably fire management), community leadership of science and monitoring, and incorporation of recovery actions into local Healthy Country or other Indigenous land management plans. It also states that nothing in the plan is intended to affect Native Title rights and that the Native Title Act 1993 procedures should be considered where Future Acts might affect Native Title (see 2.2, Objective 4, 2.3).

Multi‑jurisdictional coordination: The plan recognises the species occurs across many land tenures and multiple jurisdictions and places the NMRT and NMRG as coordinating bodies to align state, territory and federal, Indigenous, NGO and private actors (see 2.3, 2.4, 2.5).

Technical differentiation by landscape: The plan distinguishes monitoring and management approaches by landscape type, prescribing mound‑centric monitoring in semi‑arid regions and track‑based or transect techniques in arid regions, and use of remote sensing (LiDAR, photogrammetry) where appropriate (Monitoring).

Performance targets and time frames: The plan articulates measurable performance criteria tied to dates (2022-2032 for mound trends, 2033 for AOO, 2032 for genetic exchange and First Nations engagement), providing political and operational timelines for measurement (see Objectives).

The text identifies multiple classes of actors likely to be involved, affected, or required to cooperate for the plan to be implemented.

Indigenous landholders and Traditional Owners: The plan names specific Indigenous groups across WA, SA, Vic, and NSW as being located within the species’ distribution. It seeks to promote Indigenous leadership in monitoring and governance, incorporate Traditional Knowledge and customary practices (particularly fire management), and to include First Nations participation on the Recovery Team. The plan explicitly states nothing within it is intended to affect Native Title rights and flags additional procedural requirements under the Native Title Act 1993 and the Indigenous Heritage Act 1998 where actions may touch Native Title or cultural heritage (see 2.2, 2.3, Objective 4).

Government agencies: Commonwealth and state/territory environment, agriculture, land‑planning and national parks agencies are identified as partners and as organisations likely affected by proposed recovery actions (see 2.3). The Recovery Team's membership includes representatives from relevant state departments and the Commonwealth environment department (see 2.4).

Community volunteer groups and NGOs: Numerous community groups across southern Australia are already active in Malleefowl conservation. The plan states total membership across these groups exceeds 1000, with over 100 active field members. The NMRG coordinates the volunteer monitoring programme and provides training, protocols and data management (see 2.5, 2.3). NGOs such as Bush Heritage Australia, Greening Australia and Australian Wildlife Conservancy are named participants on the Recovery Team (see 2.4).

Private landholders and the agricultural sector: The plan notes Malleefowl occur on private lands and pastoral leases; recovery actions will necessarily involve private land managers through monitoring, habitat management, predator control and possibly other interventions. The agricultural sector is listed among organisations likely to be affected (see 2.3).

Mining and resource sectors: Mining is explicitly flagged among sectors likely to be affected by recovery actions, given the distribution of Malleefowl across varied tenures. The plan does not specify statutory obligations but identifies the mining sector as a stakeholder to be considered when specialised tasks arise (see 2.3).

Researchers and academic institutions: The plan explicitly links the NMRG and the NMRT with universities and independent genetic expertise for Objective 3 (genetic exchange evidence), and indicates the plan will work with researchers on monitoring methods and analyses (see 2.5, Objective 3).

Local and regional natural resource managers: NRM agencies, national parks managers and Indigenous ranger groups are key operational partners; the NMRG aims to collaborate with them to ensure data are suitable for management and decision‑making (see 2.5).

Federal policymakers and funders: The plan foresees annual reporting of regional trends to state and federal governments and anticipates coordinated funding and actions; the Recovery Team includes parties “involved in funding and those participating in actions” (see 2.4).

Who pays and who decides: The document implies costs and decisions are shared across these groups. Decisions about priorities and coordination are assigned to the NMRT; operational data management and monitoring are delivered by the volunteer NMRG in coordination with partner agencies. Funding sources are not itemised in the supplied text, but the relationship matrix implies government and NGO funding for coordination, training and experiments, and volunteer in‑kind contributions for field monitoring (see 2.4, 2.5, 2.6).

The plan is a policy and operational document rather than a statute. Its provisions deploy obligations, expectations and rights primarily in the language of encouragement, coordination and technical standards rather than legally enforceable duties. From the text, the practical duties and rights it creates or recognises include:

Duties (operational and coordination duties, as stated or implied):

• NMRT duties: Provide advice and assist in coordinating implementation of recovery strategies. Membership includes government departments, NGOs and a community representative. The NMRT is to advise and coordinate rather than exercise statutory powers (see 2.4).
• NMRG duties: Manage the volunteer national monitoring programme and database, maintain monitoring protocols/manuals, deliver training, validate data, maintain the smartphone app, create educational materials and produce regional and national trend reports annually to partners and governments (see 2.5).
• Monitoring duties for participating organisations and volunteers: To follow the standard monitoring protocols, use prescribed descriptors for mound visits, record locations accurately, and participate in training and data validation processes to ensure robust population estimates (Monitoring, 2.5).
• AMPE operational duties: Implement predator‑management treatments and maintain paired control sites to allow inference about predator control effectiveness; ensure the experiment is monitored in a standardised way as part of the broader monitoring programme (see 2.6).

Rights and protections recognised:

• Indigenous rights: The plan explicitly states that nothing in it is intended to affect Native Title rights or interests. It instructs that provisions of the Native Title Act 1993 should be considered before any Future Acts that might affect Native Title rights, and that Native Title procedures are additional to those required under the Indigenous Heritage Act 1998 (see 2.2, 2.3).
• Data access and stewardship rights: The NMRG is designated the manager of the national monitoring database and is responsible for data validation and reporting. While the text does not set out legal data rights, it allocates operational stewardship and responsibilities to the NMRG (see 2.5).

Expectations rather than legal duties:

• Participation in monitoring and AMPE is framed as collaborative and voluntary; the plan describes encouragement, support and coordination rather than compulsion. The text identifies groups and sectors “likely to be affected” and outlines roles but does not impose statutory obligations or sanctions in the provided text (see 2.3, 2.5).

Technical obligations for monitoring quality:

• The plan prescribes specific methodological obligations for anyone participating in the monitoring programme: adherence to the National Malleefowl Monitoring Manual, use of defined descriptors for mound assessments, periodic re‑search of sites every 5-10 years to capture new mounds, and adherence to protocols for remote sensing technologies and adopted devices (see Monitoring, 2.5).

Administrative and planning obligations:

• The plan requires the NMRT and partners to identify priority isolated populations for genetic work, to determine evidence requirements for genetic exchange by independent genetic expertise, and to report on progress towards performance criteria by specified dates (Objective 3, 2.4, 2.5).

What the plan does not create:

• The text does not create statutory land‑use restrictions, direct licensing conditions, or enforceable penalties within the provided material. Instead, it relies on coordination, agreements, and compliance with existing statutory frameworks where relevant to cultural heritage and Native Title (see 2.2, 2.3).

The supplied text does not set out any new statutory penalties, criminal offences or administrative sanctions. Enforcement in this plan is executed through collaborative governance, technical standards and negotiated participation rather than through prescribed fines or regulatory enforcement tools. Key points derived from the text:

Absence of internal sanctioning mechanisms: The document frames actions as encouragements, supports and cooperative projects (for example, promoting traditional land management, providing access to technical information, and encouraging Indigenous leadership). There is no language in the supplied material that creates enforcement powers for the NMRT or NMRG, nor any nomination of penalties for non‑compliance with the plan’s objectives or protocols.

Reliance on existing statutory regimes where relevant: The plan explicitly instructs that Native Title rights should be considered and that procedures under the Native Title Act 1993 are additional to those required under the Indigenous Heritage Act 1998 before undertaking Future Acts that might affect Native Title or cultural heritage (see 2.2, 2.3). Those statutory regimes contain their own procedural consequences and potential sanctions; the plan signals that statutory compliance with those Acts remains required, but it does not attempt to alter or replicate their enforcement machinery.

Enforcement by contractual or funding mechanisms (implied): The plan anticipates multi‑party projects involving governments, NGOs, research institutions and private landholders. In practice, enforcement of standards and continuation of actions is likely to be driven by funding agreements, grant conditions, land‑management agreements and institutional reporting obligations. The supplied text does not include model contract terms or grant conditions, but it does indicate that reporting and data provision are expected within the national monitoring programme (see 2.5).

Voluntary conformity and peer accountability: The plan depends heavily on volunteer groups and community‑based monitoring; compliance with monitoring standards and experimental design will be achieved principally through training, QA/QC by NMRG, and peer‑review of data and methods rather than through coercive enforcement (see 2.5, AMPE).

Implementation risk from lack of statutory enforcement: The absence of specified penalties within the document itself increases the plan’s reliance on goodwill, funding continuity, coopetition among sectors and the operational capacity of the NMRT and NMRG to ensure adherence to protocols. The text recognises multi‑jurisdictional coordination challenges and the need to maintain relationships and cooperation with Indigenous stakeholders (see 2.4), implicitly acknowledging that effectiveness depends on voluntary collaboration.

In short, the plan relies on governance, coordination, funding and statutory compliance via pre‑existing laws on Native Title and heritage rather than establishing new enforcement measures or penalties in the document itself.

The text identifies explicit legal touchpoints and implies several practical intersections with existing statutory regimes and administrative processes.

Native Title and Indigenous heritage laws: The plan expressly states that nothing in it is intended to affect Native Title rights or interests and instructs that the Native Title Act 1993 should be considered before undertaking any Future Acts that might affect Native Title rights. It further notes that procedures under the Native Title Act are additional to those required to comply with the Indigenous Heritage Act 1998 (see 2.2, 2.3). Practically, this requires project planners to run relevant Native Title procedural steps and heritage assessments before undertaking on‑ground actions that could impinge on Native Title or cultural heritage.

Land tenure and planning laws: The plan recognises Malleefowl occupy varied land tenures including Indigenous lands, pastoral leases, private land, state and national parks and uncommitted Crown land (see 2.3). This variety means on‑ground actions must comply with tenure‑specific obligations such as lease conditions for pastoral leases, state national park regulations, and local government planning controls where applicable. The plan itself does not change those legal frameworks; instead it overlays a coordination and monitoring effort across multiple statutory regimes.

Environmental and biodiversity legislation: While the supplied text does not identify specific environmental statutes (other than the Native Title / Indigenous Heritage Acts), state and federal environment laws that list threatened species or regulate actions that may impact biodiversity will interact with the plan’s measures. The plan’s monitoring and data outputs are likely to inform statutory assessments, recovery listings and conservation advice under relevant Commonwealth and state threatened species regimes, though the document does not alter statutory criteria or processes.

Contractual and funding instruments: The plan anticipates collaborative projects involving government agencies, NGOs, and private actors. Implementation will interact with a range of contract law and grant‑funding conditions. For example, funding agreements for AMPE or monitoring activities will likely impose reporting, intellectual property and data‑sharing requirements beyond the plan’s text.

Biosecurity and pest control law: AMPE involves the management of introduced predators (foxes and cats) on treatment sites. Predator control operations are operationally and legally influenced by biosecurity and animal welfare laws, pest control regulations, and local authority permits. The plan does not specify the legal instruments for predator control, so each implementing agency or land manager must ensure compliance with animal welfare regulation, permits for control methods and any statutory pest management requirements in their jurisdiction.

Data privacy, ownership and IP law: The plan assigns the NMRG responsibility for maintaining the National Malleefowl Monitoring Database and for error‑checking, validating and reporting from the data (see 2.5). The text does not specify data ownership, privacy protections, or intellectual property arrangements. Data sharing and publication will therefore be governed by the data‑sharing arrangements and policy of the parties involved, and potentially by privacy or research ethics laws where personal data or sensitive site locations are involved.

Planning approval and 'Future Acts': The plan’s explicit reference to Future Acts under the Native Title Act signals that some recovery activities may trigger formal procedural steps, particularly on native title land or where land access or use requires authorisation. This means recovery actions can be subject to statutory consultation and compensation processes in the Native Title Act where relevant (see 2.2).

Cross‑jurisdictional reporting and administrative law: The requirement that the NMRG report regional trends to state and federal governments each year (see 2.5) means the plan provides input into administrative decision‑making processes. Those public agencies will, in turn, apply statutory frameworks when making land‑use, conservation, or funding decisions informed by the plan.

In summary, the plan overlays voluntary coordination and technical standards on existing statutory frameworks. It expressly requires consideration of the Native Title Act 1993 and Indigenous Heritage Act 1998 where actions may affect rights or heritage, and it will interact in practice with a range of environmental, land tenure, pest control and administrative laws as parties implement the recommended monitoring, predator control experiments and management actions.

The provided text does not include formal amendment clauses, legislative citations for amendment, or a record of previous statutory versions. The document reads as a contemporary recovery plan with its own internal governance but without an attached amendment schedule or legislative enactment history. From the material provided:

• No formal amendment mechanism or statutory prescription for future updates is set out in the supplied text. The plan describes governance structures (NMRT, NMRG) that can evolve over time (“membership of this Recovery Team (which may change over time) includes, but is not limited to individuals…” , see 2.4), implying internal adaptability of membership and roles rather than a legal amendment process.
• The plan contemplates iterative adaptive management (explicit in AMPE and monitoring), which operationally implies periodic review and modification of strategies based on evidence. However, the text does not specify who formally authorises amendments to the plan document itself, nor how amendments will be recorded, published or legally validated.
• There is no table of previous versions or formal dates of past amendments in the provided extract. The performance criteria reference baseline and target years (e.g. 2022-2032, 2023 baseline for AOO, 2032, 2033 targets), which suggests periodic evaluation of progress within the decade, but not a statutory amendment schedule (see Objectives).
• Institutional continuity: The plan assigns ongoing roles to NMRG and NMRT that may operationally adapt the plan’s content and implementation. The NMRG’s remit to “trend and periodically undertake analyses and reporting results” (see 2.5) suggests the plan expects rolling updates to practice, but such changes appear to be administrative rather than legal amendments.

Given the absence of explicit amendment provisions in the supplied text, parties seeking to rely on or modify the plan should confirm whether the plan is published with a formal versioning process externally to this extract, and whether sponsoring government agencies have internal policies for updating recovery plans. Practitioners should treat this document as a policy instrument subject to administrative update rather than a statute with codified amendment procedures unless an external source attaches formal amendment rules.

The supplied material contains no references to litigation, judicial decisions, or administrative appeals relating to this recovery plan or the measures it describes. There are no cited cases, enforcement proceedings or dispute histories within the text.

What the text does contain that bears on litigation risk:

• Native Title and heritage procedural triggers: The plan instructs that the Native Title Act 1993 procedures and the Indigenous Heritage Act 1998 procedures should be considered where actions may affect Native Title or heritage (see 2.2, 2.3). Those statutory regimes have established litigation and mediation pathways which could be engaged if a proposed recovery action constituted a ‘Future Act’ or affected heritage interests. Although the plan itself is not a regulatory instrument, actions taken under it that engage Native Title or heritage law can trigger legal disputes under those statutes.
• Multi‑party stakeholder involvement: The plan lists a wide set of stakeholders, including private landholders and mining interests (see 2.3). Where recovery actions intersect with commercial land uses, contestation over access, compensation, or restrictions could lead to administrative review or litigation under planning, lease or regulatory regimes, depending on specific on‑ground measures adopted and the statutory frameworks engaged.
• Data use and site confidentiality: The NMRG manages a national database and smartphone app. The plan does not articulate data confidentiality protocols or protections for sensitive site location data. In practice, disclosure of sensitive location data can create litigation risk (for example, if landholders claim harm from publication) and could be regulated by privacy, environmental protection or heritage laws.

Because the text contains neither precedent nor litigation history, a legal analyst should not infer existing case law from the document. Practitioners should check external legal databases or agency publications for any disputes arising from implementation, and should treat the plan’s references to Native Title and heritage as signalling areas where litigation is possible if on‑ground actions proceed without due statutory process.

The plan contains several operational, legal and practical features that commonly cause friction during implementation. Below are concrete “gotchas” grounded in the text and the mechanisms it establishes.

Reliance on volunteers for core monitoring functions: The NMRG’s monitoring programme is volunteer‑based and central to national trend estimation (see 2.5). Reliance on volunteers exposes data continuity and quality to fluctuations in volunteer availability, training uptake and local capacity. Although the NMRG provides training and manuals, long‑term dependence on voluntary labour poses a sustainability risk and could create regional data gaps.

Data governance and confidentiality not specified: The NMRG is designated to maintain the National Malleefowl Monitoring Database and to validate and report data (see 2.5). The plan does not articulate data‑sharing protocols, ownership, or handling of sensitive site information. Practitioners should anticipate needing agreements on access, confidentiality (particularly for rare populations or culturally sensitive locations), and intellectual property before data are internationalised or published.

No statutory enforcement or penalties in the plan text: The plan is prescriptive on methods and goals but does not set sanctions for non‑participation, and does not impose statutory constraints on landholders (see 2.3, 2.5). This makes implementation reliant on voluntary cooperation, funding and administrative will. Expect difficulty enforcing monitoring coverage on private land without negotiated agreements or contractual funding conditions.

Complex tenure mix: Malleefowl occur across Indigenous lands, pastoral leases, private lands, reserves and unallocated Crown land (see 2.3). Each tenure has distinct legal constraints. Actions requiring access or manipulation of land (predator control, fire management, fenced exclosures) will need tailored permissions and may trigger tenant obligations, lease constraints, or native title procedures , failure to navigate these can stall projects.

Native Title and heritage procedural traps: The plan expressly advises considering the Native Title Act 1993 and Indigenous Heritage Act 1998 before undertaking Future Acts (see 2.2, 2.3). Practitioners may underestimate the time and process required under these Acts: consultation, notification, mediation, or compensation steps can be time‑consuming and may delay AMPE or other on‑ground interventions.

Methodological differences by landscape require bespoke protocols: Semi‑arid mound monitoring and arid track surveys are fundamentally different: sites vary in size (2-4 km² for typical monitoring blocks; 10-20 km² for airborne surveys) and in detection probability (Monitoring). Applying the wrong method to the wrong landscape will bias trend estimates , for example using mound counts in low‑density arid areas where tracks are the more efficient indicator.

AMPE experimental integrity and contamination risk: AMPE uses treatment and control paired sites to infer predator control effects (see 2.6). If predator management spills over from treatment to control sites, or if other contemporaneous interventions occur, inference will be compromised. The plan does not specify buffer widths, monitoring intensity required to detect spillover, or governance for maintaining experimental integrity , these operational details need fixing before roll‑out.

Genetic objective requires independent expertise and baseline establishment: Objective 3 requires evidence of genetic exchange by 2032 and asks that priority isolated populations be identified by each NRM region, led by NMRT, with evidence requirements determined by independent genetic expertise (Objective 3). The plan does not provide baselines or sampling design; commissioning credible genetic analyses requires specialist capacity and funding which are not itemised.

Interoperability of technologies and protocols: The plan proposes adopting technologies (LiDAR, drones, smartphone apps) and standard protocols (see 2.5). Ensuring interoperability across jurisdictions and groups can be difficult; inconsistent sensor specifications, data formats, or QA/QC practices will hamper national aggregation unless standard operating protocols are strictly enforced and resourced.

Potential stakeholder expectation gaps: The plan encourages Indigenous leadership and First Nations participation (Objective 4), but implementation may require reallocating resources, providing training, and ensuring decision‑making roles are meaningful. If Indigenous partners are treated instrumentally or resourcing is inadequate, participation goals may not be achieved.

Funding continuity risk: The plan anticipates ongoing monitoring, AMPE trials, training and smartphone app maintenance (see 2.5, 2.6). These are multi‑year operational costs. The text does not commit funds; implementation depends on partner funding. Short funding cycles risk interruption of long‑term trend measurement and the AMPE’s capacity to deliver conclusive results.

Overall, the plan sets out workable approaches but leaves many implementation specifications and legal/contractual arrangements to parties on the ground. Early attention to data governance, tenure‑specific approvals, funded staffing for coordination, and safeguards for AMPE experimental design will materially reduce the risk of delayed or equivocal outcomes.

Because the plan functions as a coordinating recovery instrument rather than an enforceable statute, “compliance” means aligning actions with the plan’s methodologies, governance expectations and statutory touchpoints identified in the text. For each actor class below, the concrete steps required to comply with the plan and reduce legal and operational risk are listed, grounded in the plan’s provisions.

For Indigenous groups and Traditional Owners

• Engage with the NMRT and NMRG: seek membership or representation on the Recovery Team and volunteer monitoring networks (see 2.4, 2.5).
• Incorporate Malleefowl recovery into local Healthy Country or land management plans and ensure recovery actions are led or co‑designed by First Nations land managers (Objective 4).
• Record and share sightings as encouraged by the plan, subject to community guidance on data sensitivity and confidentiality (2.3, 2.5).
• Where proposed actions might affect Native Title or heritage, require pro‑active consideration of the Native Title Act 1993 and the Indigenous Heritage Act 1998; exercise procedural rights in consultation and on access permits (2.2, 2.3).

For federal, state and territory agencies

• Nominate and maintain NMRT membership and provide advisory and coordination inputs to align jurisdictional programs (see 2.4).
• Fund and support the NMRG to maintain national monitoring tools, provide training events, and uphold data validation and reporting functions (see 2.5).
• Ensure any government‑led on‑ground actions involving access or land‑use change follow Native Title and heritage procedural requirements before commencement (2.2, 2.3).
• Integrate monitoring outputs into statutory decision‑making and consider using the plan’s trend reports to inform conservation listings, funding priorities and regional planning.

For private landholders, pastoral lessees and the agricultural sector

• Participate in the national monitoring programme by allowing access for mound or track surveys under negotiated terms, providing site records, and applying the National Malleefowl Monitoring Manual protocols (see 2.5, Monitoring).
• Where control measures (e.g. fox baiting) are considered, ensure compliance with applicable pest control, animal welfare and local regulations; coordinate with AMPE protocols where relevant (2.6).
• Engage with NMRG training and data validation to ensure site records are robust and suitable for national aggregation.

For mining and resource companies

• Early screen operations against the plan’s mapped distribution for Malleefowl and incorporate the plan’s requirements into project planning, avoiding impacts on known mounds and identified priority areas (see 2.3).
• Where operations may affect Indigenous land or heritage, proactively run Native Title and Indigenous Heritage Act procedures and negotiate access or offsets as required (2.2, 2.3).
• Offer collaborative funding or technical support to monitoring and AMPE where possible, tied to data‑sharing and confidentiality arrangements consistent with community expectations and statutory obligations.

For researchers and universities

• Work with NMRG to align monitoring methods, provide independent genetic expertise for Objective 3, and collaborate on designing robust AMPE sampling and analysis plans (see 2.6, Objective 3, 2.5).
• Adhere to the National Malleefowl Monitoring Manual, contribute to developing standard protocols for new technologies (LiDAR, drone), and support training and QA/QC (see 2.5).

For NRM agencies and park managers

• Implement standard monitoring site selection and re‑search intervals (thorough re‑search at least every 5-10 years in semi‑arid sites) and follow the prescribed site sizes and search methods appropriate for landscape type (Monitoring).
• Coordinate with NMRG to provide manpower, training venues, and logistical support for volunteer monitoring and AMPE logistics (2.5, 2.6).

Cross‑cutting practical compliance steps

• Adopt the National Malleefowl Monitoring Manual and use the prescribed descriptors for mound assessments each visit to maintain data comparability (see Monitoring, 2.5).
• Use the NMRG smartphone app for data entry where feasible, and comply with NMRG validation procedures to reduce data errors (2.5).
• For AMPE sites, ensure experimental design integrity: maintain control site status, document all interventions, and coordinate monitoring frequency with NMRG so treatment effects are detectable (2.6).
• Develop data‑sharing agreements (MOUs) that specify confidentiality, access, intellectual property and publication rights, and include provisions to protect sensitive site locations and respect Indigenous data sovereignty.
• Budget for multi‑year funding for monitoring continuity and app/platform maintenance; short funding horizons will compromise trend detection (2.5).

Legal checklist before on‑ground action

• Confirm Native Title status and seek required consents or follow Future Acts procedures under the Native Title Act 1993 where actions may affect Native Title rights (2.2, 2.3).
• Undertake Indigenous heritage assessments under the Indigenous Heritage Act 1998 and obtain required approvals or permits.
• Secure tenure‑specific permissions: pastoral lease consent, park manager approval, private land access agreements or statutory approvals where necessary.
• Ensure pest control and animal welfare practices comply with relevant laws and permits.

In sum, “compliance” with this recovery plan is achieved through procedural alignment, data and method standardisation, respectful engagement with Indigenous rights and heritage processes, and the negotiation of funding and access agreements that enable the volunteer‑based national monitoring programme and experimental work to proceed. The plan provides the technical scaffolding; legal and contractual instruments are required at the project level to operationalise its aims.
