What it does
This instrument is a Register of Critical Habitat published under section 207A of the Environment Protection and Biodiversity Conservation Act 1999 (the Register). The document lists three specific critical-habitat entries, each with an effective date (01 July 2002), a geographic description of the area, and reasons for listing tied to the EPBC Act criteria (labelled (a) to (g) in the entries). The three entries are:
- Diomedea exulans (Wandering Albatross) , Macquarie Island (Attachment A).
- Thalassarche cauta (Shy Albatross) , Albatross Island, The Mewstone, Pedra Branca (Attachment B).
- Thalassarche chrysostoma (Grey-headed Albatross) , Macquarie Island (Attachment C).
The Register states, as its operative identification principle, that "The identification of critical habitat for the Register of Critical Habitat, including location and extent information, is a matter of ecological judgement, and is based on the most up-to-date scientific information available to the Threatened Species Scientific Committee and the Minister for the Environment and Heritage at the time the habitat was being considered." The Register also records that "As new or additional information becomes available, critical habitat identified on the Register may be amended." The entries expressly link the listing reasons to a set of criteria (a) to (g), each of which the entries address or mark as N/A where not applicable.
Mechanically, the document performs three functions within the scope of the material provided. First, it records and publicises specific spatial extents described by coordinates and area estimates (for example, Macquarie Island "about 13,000 ha, comprising all islands and rocks above mean high water level, lying within the area bounded by parallels 54°27' S and 54°49' S latitude and meridians 158°45' E and 158°59' E longitude"). Second, it sets out reasoned statements applying the statutory listing criteria to each entry, explaining why the area is "critical" for the listed species. Third, it cites ancillary technical sources that informed the decision, namely the Recovery Plan for Albatrosses and Giant-Petrels 2001-2005 and a 2002 map of habitat critical to the survival of the listed species.
