73 Matters to be considered by Minister in deciding on environmental approval (1) In addition to the matters set out in Part 2, the Minister must consider the following in deciding whether to grant or refuse an environmental approval for an action or strategic proposal: (b) the assessment report on the action or strategic proposal; (c) whether the proponent is a fit and proper person to hold an environmental approval; (d) any other matters the Minister considers relevant. (2) Before granting an environmental approval for an action or strategic proposal, the Minister must be satisfied that: (a) the community has been consulted on the potential environmental impacts and environmental benefits of the proposed action or strategic proposal; and (b) the significant impacts of the action or strategic proposal have been appropriately avoided or mitigated or can be (c) if appropriate, environmental offsets can be provided in accordance with this Act for significant residual adverse impacts on the environment that cannot be avoided or mitigated.
