38Declaration of prohibited actions

38 Declaration of prohibited actions (1) The Minister may, by Gazette notice, declare an action or class of actions to be a prohibited action or prohibited actions if the Minister is satisfied that: (a) the environment or an aspect of the environment should be protected; and (b) the declaration is necessary to further the objects of this Act. (2) The notice must include the following information: (a) a description of the declared prohibited action or class of actions; Environment Protection Act 2019 30 (b) the day on which the declaration takes effect; (c) the reason for the declaration. (3) A declaration must be prepared in accordance with the regulations. (4) The Minister must publish a statement of the reasons for making the declaration as soon as practicable after the declaration is made. (5) The Minister must table a copy of the declaration in the Legislative Assembly within 6 sitting days after the declaration is made.
