180 Effect of environment protection notice on need for statutory authorisation (a) a person is required by an environment protection notice to carry out an action; and (b) a statutory authorisation of a kind prescribed by regulation is required for that action. (2) The person may carry out the action without obtaining the statutory authorisation. (3) A person incurs no liability to a penalty under the Act governing the statutory authorisation for complying with subsection (2). (4) Subsections (2) and (3) apply despite anything to the contrary in the Act governing the statutory authorisation. Environment Protection Act 2019 165
