176 Environment protection notice – purpose and issue (1) The CEO may issue an environment protection notice to any person under this Division for the purpose of securing compliance with: (a) a declaration under section 35, 36 or 38; or (ab) an environmental approval; or (ac) an environmental (mining) licence; or (ad) Part 5A or 5B; or (b) a requirement prescribed by regulation. Environment Protection Act 2019 162 (2) In addition to subsection (1), the CEO may issue an environment protection notice under this Division in the circumstances set out in Division 2A. (3) Without limiting subsection (1), an environment protection notice can be made on the revocation or ceasing to have effect of a notice under section 182, 182A or 183.
