146 Offence relating to conflict of interest (1) A person commits an offence if the person: (a) is a qualified person; and (b) intentionally carries out an environmental audit or part of an environmental audit; and (c) has a conflict of interest and is reckless in relation to that circumstance; and (d) does not have the authorisation of the CEO to engage in the conduct despite the conflict of interest. (2) Strict liability applies to subsection (1)(a) and (d).
