123 Decision on transfer (a) approve the transfer of an environmental approval; or (b) refuse to approve the transfer of the environmental approval. (2) The Minister must make a decision on the application within the required time after the Minister receives the application for approval of the transfer. (3) If the Minister approves the transfer of the environmental approval, the Minister may amend the environmental approval and grant an amended environmental approval in its place. (4) The Minister's approval may be subject to a condition that the transfer does not take effect until the transfer of assets or other matters related to the action have occurred. (5) Until a transfer of the environmental approval takes effect the approval holder is responsible for performing all obligations in relation to the approval. the application for approval of the transfer.
