101 Decision of Minister in relation to approval notice (a) approve an application under section 98; or (b) refuse to approve an application under section 98. (2) The Minister must make a decision on the application within the required time. (2A) Before making a decision to approve an application, the Minister must consider whether or not the applicant is a fit and proper person to hold an approval notice. (3) Before making a decision to approve an application, the Minister must be satisfied that: (a) the proposed action has been assessed under a strategic assessment; and Environment Protection Act 2019 63 (c) it is appropriate in the circumstances to issue the approval notice. (4) The Minister must not issue an approval notice for a proposed action if the environmental approval relevant to that application has expired or been revoked. (5) In this section: the application for the approval notice.
