438 Fees and penalties to be paid into the Consolidated Fund (1) Subject to sections 439 and 440, the following fees and penalties must be paid into the Consolidated Fund— (a) any fee paid under this Act; (b) any penalty for an offence against this Act or the regulations; (c) a civil penalty for a contravention of a civil penalty provision under this Act. S. 438(2) amended by No. 36/2022 s. 61. (2) Any fee paid under this Act to a body (other than a council) that has delegated powers or functions of the Authority must be paid by the body to the Authority for payment into the Consolidated Fund. S. 439 inserted by No. 39/2018 s. 18 (as amended by Nos 27/2019 ss 32−40, 3/2020 ss 45, 46, 47/2020 s. 27).
