436 Application for declaration (1) A person may apply to VCAT for a declaration concerning any matter in relation to which the person may apply to VCAT under this Act or anything done by the Authority under this Act. (2) On an application under subsection (1) VCAT may make any declaration it thinks appropriate in the circumstances. (3) VCAT's power to make a declaration under this section is exercisable only by a presidential member of the Tribunal. (4) Without limiting subsection (1), a person proposing to engage in an activity may apply to VCAT for a declaration as to whether or not a permission is required to engage in that activity.
