359Powers of the Authority

359 Powers of the Authority (1) The Authority has— (a) any power conferred on the Authority under this or any other Act; and (b) the power to do all things that are necessary or convenient to be done for or in connection with the performance of the Authority's functions and duties and to enable the Authority to achieve its objective. (2) The Authority may give advice to a person who has a duty or obligation under this Act about complying with that duty or obligation. (3) The Authority's power under subsection (2) to give advice may also be exercised by an authorised officer. (4) The giving of advice under subsection (2) by the Authority or an authorised officer does not give rise to— (a) any liability of, or other claim against, the Authority; or (b) any right, expectation, duty or obligation that would not otherwise be conferred or imposed on the person given the advice; or (c) any defence that would not otherwise be available to that person. (5) The Authority has power— (a) to apply for, obtain and hold intellectual property rights (including patents, copyrights, trade marks and registered designs); and (b) to enter into agreements or arrangements for the commercial exploitation within or outside Victoria of those intellectual property rights and ancillary services on any terms or conditions as to royalties, lump sum payments or otherwise as the Authority may see fit.
