303 No criminal proceedings while enforceable undertaking in force If the Authority accepts an enforceable undertaking in relation to a contravention or alleged contravention of this Act or the regulations, or any other Act or the regulations made under any other Act, while the enforceable undertaking is in force, the Authority must not commence criminal proceedings for an offence that is constituted by the contravention or alleged contravention that the undertaking is given in relation to.
