285 Redirection of obligations in case of transfer of land (1) The Authority may by notice in writing direct a body corporate to comply, subject to any modification specified by the Authority, with a specified site management order issued to a related entity or associated entity if— (a) the body corporate transfers to the entity any land in relation to which the site management order requires an action to be taken within the 2-year period before the direction is made; and (b) the entity— (ii) has failed to comply with the site management order; and (c) the Authority is satisfied that the body corporate or an officer of the body corporate knew or ought reasonably to have known— (i) of the circumstances that resulted in the issuing of the site management order; and (ii) that the entity was likely to be wound up, or was likely to fail to comply with the site management order. (2) If the Authority gives a direction under subsection (1) to a body corporate, the body corporate must comply with the site management order, subject to any specified modification.
