197 Conditions on appointment of environmental auditor (1) The Authority may appoint a person as an environmental auditor— (a) unconditionally; or (b) subject to conditions specified in the environmental auditor's instrument of appointment; or (c) subject to any prescribed conditions. (2) In addition to subsection (1), at any time during the appointment of an environmental auditor, the Authority may by written notice— (a) impose conditions or further conditions on the appointment; or (b) vary or revoke any of the conditions to which the appointment is subject. (3) In making a decision to impose, vary or revoke conditions on the appointment of an environmental auditor, the Authority must have regard to any relevant guidelines issued under section 203. (4) A condition imposed on an appointment under subsection (1)(b), (c) or (2)(a) or a variation or revocation of a condition under subsection (2)(b) takes effect on the date specified by the Authority or the date on which the environmental auditor is notified by the Authority, whichever is the later.
