162 Consideration of issues of environmental concern when issuing remedial notices (a) the Authority proposes to issue a remedial notice to a person; and (b) the proposed remedial notice would require the person to carry out an action or do a thing to minimise a risk of harm to human health or the environment that relates to an issue of environmental concern; and (c) the person is required to address that issue of environmental concern. (2) For the purposes of determining whether to issue the remedial notice, the Authority must take into account any better environment plan that addresses the issue of environmental concern. (3) In this section— ***remedial notice*** means— (a) an environmental action notice; or (b) an improvement notice; or (c) a notice to investigate; or (d) a prohibition notice.
