122 Litter authority may take action following failure to comply with waste abatement notice (1) If a person fails to comply with a waste abatement notice issued under section 121(1) or a notice issued under section 121(6), the Authority or a litter authority may remove or dispose of the waste or the object or thing. (2) The Authority or other litter authority may recover any reasonable costs incurred by it in taking action under this section. (3) The reasonable costs referred to in subsection (2) are to be treated as a debt due to the Authority or other litter authority that is payable by a person who fails to comply with a waste abatement notice or a notice under section 121(6). (4) Subsection (3) does not apply if an occupier fails to comply with a notice under section 121(6) because the occupier has a reasonable excuse.
