109 Effect of position statements (1) A position statement does not give rise to— (a) a legal right, expectation, duty or obligation that would not otherwise be conferred or imposed on any person; or (b) any liability of, or other claim against, the Authority; or (c) any defence that would not otherwise be available to any person. (2) Without limiting subsection (1), a position statement does not affect any matter specified in subsection (1)(a), (b) or (c) that is otherwise provided for under this Act.
