91L Priority for costs if owner insolvent
If the authority carries out the requirements of an assessment order or
remediation order in relation to land disclaimed (by a liquidator or
trustee in bankruptcy) as onerous property in the course of
proceedings for winding up or bankruptcy, the authority may recover
the cost of carrying out the order together with a rate of interest and
reasonable costs and expenses so incurred, in priority to any holder
of security over the land.
Note A rate of interest may be determined under s 165 for this section.
