44 Conducting activities other than prescribed activities (1) A person who is served with a notice under section 43 (1) must not conduct, or continue to conduct, the activity described in the notice unless the person holds an environmental authorisation in relation to that activity. (2) A person does not commit an offence against subsection (1)— (a) on or before the date specified in the notice by which an application for an environmental authorisation must be lodged; or (b) if the person lodges an application on or before that date—while a decision on the application is pending; or (c) if the notice is revoked—on or after the date of revocation.
