40 Effect of agreements
(1) An environmental protection agreement does not relieve a party to the
agreement from any obligation or duty under this Act or another law.
(2) No action or proceeding lies against a party to an environment
protection agreement arising out of an act or omission only because
it constitutes a breach of the agreement.
