143 No offence committed
A person does not commit an offence against section 137,
section 138, section 139, section 141 or section 142 if—
(a) the act or omission that would apart from this provision have
constituted the offence or an element of the offence was
authorised by or under this Act; or
(b) in any other case—
(i) the act or omission that would apart from this provision
have constituted the offence or an element of the offence
happened during the conduct of an activity that was, apart
from this Act, lawful; and
(ii) in conducting the activity, the person was complying with
the general environmental duty.
