140 Person may be found guilty of lesser charge (1) If in a proceeding for an offence against section 137, the court is not satisfied that the defendant is guilty of the offence charged but is section 138 (1), (2) or (3), the court may find the defendant guilty of the latter offence. (2) If in a proceeding for an offence against section 137 or section 138, the court is not satisfied that the defendant is guilty of the offence charged but is satisfied that the defendant is guilty of an offence against section 139 (1), (2) or (3), the court may find the defendant guilty of the latter offence.
