105 Emergency situations
This division applies if an authorised officer—
(a) has reasonable grounds for believing that serious or material
environmental harm has been or is likely to be caused, other than
harm permitted by or under this Act; and
(b) is satisfied that it is necessary to take immediate action to
prevent, minimise or remedy the harm (in this division called
emergency action).
