Enhancing Online Safety for Children (Consequential Amendments) Act 2015

Understanding the operation of this Act requires isolating several key statutory concepts that redefine the boundaries of Commonwealth online content regulation:

The Commissioner and the Expanded Scope of Investigations

The Act formally introduces the "Children's e-Safety Commissioner" into the broader telecommunications and broadcasting frameworks. Under the new section 169A of the Broadcasting Services Act 1992, an "investigation by the Commissioner" is defined as any investigation conducted under section 19 of the Enhancing Online Safety for Children Act 2015, Clause 27 of Schedule 5 (internet content complaints), or Clause 44 of Schedule 7 (content service complaints). This unifies the Commissioner's child-specific safety mandates with the pre-existing, general classification-based online content complaint regimes.

Split-Funder Administrative Model

The Act establishes a distinct statutory division between the legal powers of the Commissioner and the financial and human resources of the ACMA. Under the amendments to the Australian Communications and Media Authority Act 2005 (specifically the insertion of section 57(aa)), the ACMA must track and report on the remuneration, employment-related costs, and other expenses of its Australian Public Service (APS) employees whose duties relate to the Commissioner's functions. The Commissioner directs the work of these employees, but the financial liability and administrative reporting remain with the ACMA.

Written Directions to Carriers and Service Providers

Under the newly inserted subsection 581(2A) of the Telecommunications Act 1997, the Commissioner is granted the power to issue written directions to carriers and service providers in connection with any of the Commissioner's functions or powers. This is a significant statutory mechanism that bypasses standard telecommunications regulatory pathways.

Exempt Documents

The Act amends the Freedom of Information Act 1982 to insert a specific exemption for "exempt content-service documents" and "exempt internet-content documents" held by the Commissioner. This means that documents relating to the Commissioner’s performance of functions under Schedules 5 and 7 of the Broadcasting Services Act 1992 are shielded from public access requests, preserving the confidentiality of the Commissioner's investigative files.

The mechanical re-routing of regulatory powers under this Act directly impacts several distinct groups across the telecommunications, technology, and public sectors:

Telecommunications Carriers and Carriage Service Providers (CSPs)

Carriers and CSPs are subjected to a new regulatory master. While they continue to interact with the ACMA on traditional telecommunications and broadcasting matters, they must now respond directly to the Commissioner regarding online safety, content complaints, and specific written directions. The Act forces these commercial entities to monitor and comply with directions issued under section 581(2A) of the Telecommunications Act 1997, introducing new operational compliance costs and legal risks.

Online Content Hosts and Content Service Providers

Any business or individual hosting internet content or operating content services in Australia (such as hosting providers, portal operators, and online service administrators falling under Schedules 5 and 7 of the Broadcasting Services Act 1992) is affected. Their compliance interface shifts entirely. Regulatory notifications, take-down requests, and formal investigations are no longer managed by the ACMA, but by the Commissioner.

The Australian Communications and Media Authority (ACMA)

The ACMA experiences a significant reduction in its direct regulatory portfolio, losing its functions over internet content and designated content/hosting services under section 10 of the Australian Communications and Media Authority Act 2005. However, its corporate services, human resources, and financial departments are heavily affected, as they must still employ, support, and financially account for the staff delegated to perform the Commissioner's functions.

Witnesses and Third Parties in Online Investigations

Individuals, employees, or corporate officers who hold information relevant to online safety investigations are directly affected. They are now subject to the Commissioner’s coercive information-gathering powers under the amended Part 13 of the Broadcasting Services Act 1992, which includes facing formal summonses and compulsory oral examinations.

The Act establishes a precise set of statutory duties and corresponding legal rights, dividing them between the regulator, regulated commercial entities, and individuals caught up in investigations:

The Compliance Duty of Carriers and Service Providers

The primary commercial duty created by the Act is set out in the newly inserted subsection 581(4A) of the Telecommunications Act 1997. A carrier or service provider must comply with a written direction given to them by the Commissioner under subsection 581(2A). Under subsection 581(2B), this duty is absolute and is not limited by any other provisions of law that prescribe conditions or restrictions on how the Commissioner performs their functions.

The Right to Disclose Information to the Commissioner

To facilitate investigations, the Act alters privacy and non-disclosure obligations. Subsection 284(1A) of the Telecommunications Act 1997 provides that the general prohibitions on disclosing customer information (contained in sections 276 and 277) do not apply if the disclosure is made to the Commissioner, or to an ACMA staff member assisting the Commissioner, provided the information may assist the Commissioner in carrying out their functions.

The Duty of Secondary Confidentiality

Under subsection 299(1A) of the Telecommunications Act 1997, if information is disclosed to a person to assist the Commissioner, that person is under a strict statutory duty not to disclose or use the information or document for any purpose other than carrying out the Commissioner's functions and powers.

Coercive Witness Duties and High Court Protections

Under the amended Part 13 of the Broadcasting Services Act 1992, individuals summoned by the Commissioner have a duty to attend examinations, take oaths or affirmations (s 174(4)), and answer relevant questions (s 174(6)). However, they are granted a corresponding statutory right: under section 200(4), a person who gives evidence or produces documents has the same protection and immunities as a witness in proceedings before the High Court of Australia. Furthermore, under section 176(3) and (4), examined persons have a right to receive a written copy of the record of their examination, including in electronic form if requested.

The enforcement architecture of this Act relies on integrating the Commissioner's new powers into existing enforcement frameworks across multiple statutes rather than establishing a standalone set of criminal offences within this amending text itself.

Enforcement of Written Directions to Carriers

The primary enforcement mechanism for a carrier's failure to comply with a written direction issued by the Commissioner under section 581(2A) lies within the Telecommunications Act 1997. Because subsection 581(4A) imposes a statutory command ("A person must comply with a direction"), any failure to comply constitutes a breach of a statutory obligation under the Telecommunications Act 1997. This triggers the standard suite of enforcement remedies available under that Act, which can include civil penalty proceedings, federal court injunctions, or administrative actions against a carrier's licence.

Part 13 Information-Gathering Non-Compliance

The Act extends the ACMA’s coercive information-gathering penalties to the Commissioner's investigations under Part 13 of the Broadcasting Services Act 1992. If an individual is summoned via a written notice under section 173(2) and fails to attend, refuse to take an oath or affirmation under section 174(4), or refuses to answer questions under section 174(6), they are subject to prosecution for non-compliance. Similarly, failing to make documents available for inspection or copying when required by a written notice under section 177(2) triggers statutory penalties under the Broadcasting Services Act 1992.

Transfer of Criminal Code Safe Harbours

The Act alters the enforcement landscape of the Criminal Code Act 1995 by shifting critical law-enforcement exemptions. Paragraphs 273.9(5)(a), 474.21(4)(a), and 474.24(4)(a) of the Criminal Code are amended to replace the "Australian Communications and Media Authority" with the "Children's e-Safety Commissioner". This ensures that the Commissioner and their staff (including delegated ACMA staff) are legally protected from criminal liability when handling, possessing, or transmitting objectionable, classified, or child-abuse material in the course of their official duties and investigations.

The entire purpose of this Act is to manage the complex legislative intersections resulting from the creation of the Commissioner. It functions as a statutory bridge between several key pieces of Commonwealth legislation:

Interaction with the Broadcasting Services Act 1992 (BSA)

The Act systematically decouples the ACMA from online content regulation. It amends the definition of "Commissioner" in subsection 6(1) of the BSA and transfers the entirety of the regulatory functions in Schedule 5 (internet content) and Schedule 7 (content services) from the ACMA to the Commissioner. Investigations conducted under these schedules are now legally defined as investigations of the Commissioner (s 169A), although they remain physically executed by staff historically employed within the ACMA.

Interaction with the Telecommunications Act 1997

The Act carves out exceptions to the strict telecommunications privacy laws in Part 13 of the Telecommunications Act 1997. By inserting subsection 284(1A), it permits carriers and CSPs to disclose confidential customer records to the Commissioner without committing an offence, provided the disclosure assists the Commissioner’s functions. Crucially, the direction-giving power in section 581(2A) is designed to operate independently of other statutory restrictions, overriding standard regulatory limits to ensure the Commissioner can compel carrier cooperation.

Interaction with the ACMA Act 2005

The Act modifies the ACMA’s corporate structure. It removes "internet content, designated content/hosting services" from the ACMA's general statutory functions in paragraph 10(1)(a). It turns the ACMA into an administrative host that must fund, employ, and report on the personnel performing the Commissioner’s duties, as detailed in the new reporting obligation under paragraph 57(aa).

Interaction with the FOI Act 1982

The Act amends the Freedom of Information Act 1982 to establish a secure operational perimeter for the Commissioner. By categorising "exempt content-service documents" and "exempt internet-content documents" as exempt under Schedule 2 of the FOI Act, it ensures that sensitive corporate disclosures, platform complaints, and regulatory files are not subject to public FOI disclosure, aligning with the highly sensitive nature of online safety and child-related investigations.

The Enhancing Online Safety for Children (Consequential Amendments) Act 2015 is a time-locked amending instrument. It was introduced into the House of Representatives on 3 December 2014, passed both houses of Parliament, and received the Royal Assent on 24 March 2015 as Act No. 25 of 2015.

The commencement of its various schedules was precisely structured to align with the enactment of the primary legislation and other concurrent deregulation agendas:

• Sections 1 to 4: Commenced on the day the Act received Royal Assent (24 March 2015).
• Schedule 1, Part 1 (General BSA Amendments): Commenced on 1 July 2015, simultaneously with the commencement of section 3 of the Enhancing Online Safety for Children Act 2015.
• Schedule 1, Part 2 (Substitution of references from ACMA to Commissioner): Commenced on 1 July 2015, immediately after the commencement of Part 1.
• Schedule 2, Part 1 (Amendments of the ACMA Act, Criminal Code, FOI Act, and Telecommunications Act): Commenced on 1 July 2015, in lockstep with the primary Act.
• Schedule 2, Part 2 (Contingent Telecommunications Act Amendments): This part contained contingent commencement provisions linked to the Telecommunications Legislation Amendment (Deregulation) Act 2015. The table in section 2(1) specified that these amendments would commence immediately after the commencement of Part 3 of Schedule 1 to the Deregulation Act. However, if the Deregulation Act commenced before the main provisions of this Act, Schedule 2 Part 2 would not commence at all. Ultimately, these provisions commenced on 1 July 2015.
• Schedule 3 (Transitional Provisions): Commenced on 1 July 2015, managing the midnight transfer of regulatory authority.

Because the Act functions as a machinery-of-government amending statute designed to transfer existing regulatory powers rather than create novel substantive offences, there is no independent, named judicial case law arising directly from the text of this specific amending Act itself.

However, the Act explicitly anticipates litigation and actively manages court and tribunal proceedings through its transitional provisions. Schedule 3, Item 3 addresses "pending proceedings" directly. It states that if any court or tribunal proceedings to which the ACMA was a party were pending immediately before the transition time (1 July 2015), and those proceedings were brought under or in connection with Schedule 5 or Schedule 7 to the Broadcasting Services Act 1992, the Children's e-Safety Commissioner is automatically substituted for the ACMA as a party to those proceedings from that time.

This statutory substitution mechanism prevented the abatement or dismissal of active litigation during the transition of online safety portfolios. Any administrative appeals in the Administrative Appeals Tribunal (AAT) or enforcement actions in the Federal Court of Australia concerning internet content complaints or content hosting investigations were seamlessly transferred. The Commissioner inherited the exact legal standing, liabilities, and arguments of the ACMA, ensuring continuity of the Commonwealth’s regulatory litigation footprint.

For legal practitioners, compliance officers, and technology platform operators, several significant statutory traps are embedded in this Act:

The Unconstrained Direction Power

The most significant regulatory "gotcha" lies within subsection 581(2B) of the Telecommunications Act 1997. This subsection explicitly states that the Commissioner’s power to give written directions to a carrier or service provider is "not limited by any other provision of a law" that confers functions, prescribes modes of performance, or imposes conditions and restrictions on the Commissioner. This means that standard administrative law limitations or procedural constraints that might otherwise restrict the Commissioner's power under their primary Act do not limit their power to issue a binding direction to a telecommunications entity. This creates a highly discretionary, broad power that is difficult to challenge on narrow administrative grounds.

The ACMA Staffing Split

Although the regulatory authority is vested in the Commissioner, the physical investigators and staff are ACMA employees. For corporate counsel, this creates a potential double-handling and communication risk. Correspondence, document submissions, and responses to summonses must be addressed specifically to the Commissioner or their named delegate, even though the physical mail, IT infrastructure, and personnel are housed within the ACMA. Treating the ACMA and the Commissioner as a single legal entity in submissions or litigation remains a critical administrative error.

FOI Blindspots for Platforms

Under the FOI Act amendments in Schedule 2, any documents concerning the performance of functions under Schedules 5 and 7 of the BSA are completely exempt. This means that if an online content provider is investigated, they cannot use the FOI Act to obtain copies of internal guidelines, complaint files, or communications between the Commissioner and third parties regarding those specific schedules. This severely restricts an investigated party's ability to gather information for a potential judicial review.

Transitional Records and "Partly Concerning" Documents

Schedule 3, Item 4 creates a potential trap regarding document control. While documents that "wholly concern" Schedule 5 or 7 must be transferred to the Commissioner, documents that only "partly concern" these schedules remain with the ACMA but must be "made available" to the Commissioner upon request. This split custody means that commercial entities seeking to audit what regulatory records the government holds about their operations must issue requests to both agencies, as records may be fragmented across both the ACMA and the Commissioner’s offices.

To navigate the regulatory environment established by this Act, affected organisations and professionals should adopt the following concrete operational protocols:

For Telecommunications Carriers and CSPs:

1. Establish a Direct Commissioner Response Protocol: Do not route online safety directions or notices through your standard ACMA regulatory compliance team. Create a dedicated operational pipeline to receive, assess, and execute written directions issued under section 581(2A) of the Telecommunications Act 1997.
2. Verify Section 284(1A) Disclosure Thresholds: Before disclosing customer data or documents to anyone claiming to represent the Commissioner, confirm that the recipient is either the Commissioner or an ACMA staff member whose active duties relate to the performance of the Commissioner's functions. Verify in writing that the requested disclosure is required to "assist" the Commissioner. This ensures that the disclosure falls squarely within the statutory safe harbour and does not violate general telecommunications privacy prohibitions under sections 276 and 277.
3. Train Staff on Secondary Use Prohibitions: Ensure that if your personnel receive any information or documents back from the Commissioner’s office, they comply strictly with the secondary non-disclosure obligations in section 299(1A).

For Content Hosts and Platform Operators:

1. Update Regulatory Service Addresses: Ensure that all legal service templates, automated take-down response systems, and compliance manuals are updated to replace the ACMA with the Children's e-Safety Commissioner for any matters arising under Schedules 5 and 7 of the Broadcasting Services Act 1992.
2. Prepare for Part 13 Summonses: If served with a summons under section 173(2) of the BSA:
   • Confirm whether the summons requires the production of physical documents, a written information statement, or personal attendance before the Commissioner or a named delegate.
   • Ensure that any witness attending an oral examination is prepared to be examined under oath or affirmation (s 174(4)).
   • Immediately request a written and electronic copy of the record of the examination under section 176(3) and (4) to maintain an accurate evidentiary record of the investigation.
   • Ensure your legal representative is aware that witnesses are entitled to the same protections as High Court witnesses under section 200(4).

For ACMA Financial and HR Administrators:

1. Implement Cost-Allocation Tracking: Establish accounting codes to isolate and report on the remuneration, superannuation, travel, and other employment-related costs of any APS employees who are seconded to, or performing duties for, the Commissioner. This is necessary to satisfy the strict reporting requirements under section 57(aa) of the Australian Communications and Media Authority Act 2005.
