##### 41. Planning approvals For the purposes of section 135 of the *Planning and Development Act 2005*, an energy operator may submit to the Western Australian Planning Commission plans of a subdivision of land acquired, or to be acquired, by the energy operator notwithstanding that the energy operator is not the owner of the land, and approval under that Act may be given thereto.
