sec.86 Who is an affected energy worker

An individual is an affected energy worker if the individual is— an affected energy GOC worker; or a prescribed energy worker; or an affected energy contractor. For subsection (1) , an individual is an affected energy GOC worker if— the individual is, or was, an employee employed by a GOC or an entity wholly or partly owned by a GOC— to perform work at a publicly owned coal-fired power station; or whose role is, or was, predominantly related to the operations of a publicly owned coal-fired power station; and the individual has been, or will be, directly and adversely affected because of a change in operations, including the reduction or ceasing of operations, of the publicly owned coal-fired power station as a coal-fired power station as a consequence of achieving the strategic infrastructure path objectives. Also, for subsection (1) , an individual is a prescribed energy worker if— the individual performs work at a prescribed facility, other than as an employee mentioned in subsection (2) ; and the work is performed under a contract entered into— with the individual directly; or with the entity that employs or engages the individual to perform the work; and the individual has been, or will be, directly and adversely affected because of a change in operations, including the reduction or ceasing of operations, of the prescribed facility as a consequence of achieving the strategic infrastructure path objectives. In addition, for subsection (1) , an individual is an affected energy contractor if— the individual performs work at a publicly owned coal-fired power station other than as an employee or contractor mentioned in subsection (2) or (3) ; and the work is performed under a contract entered into— with the individual directly; or with the entity that employs or engages the individual to perform the work; and the total amount of work performed by the individual at 1 or more publicly owned coal-fired power stations meets or exceeds the amount prescribed by regulation for this paragraph; and A regulation may prescribe an amount of time an employee performs work under 1 or more contracts at 1 or more power stations over a specified period of time. the individual has been, or will be, directly and adversely affected because of a change in operations, including the reduction or ceasing of operations, of the publicly owned coal-fired power station as a coal-fired power station as a consequence of achieving the strategic infrastructure path objectives. In this section— prescribed facility means a facility that— is either— a coal mine; or an electricity generating facility; and is prescribed by regulation for this definition. s 86 amd 2025 No. 30 s 73 sch 1 (sec.86-ssec.1) An individual is an affected energy worker if the individual is— an affected energy GOC worker; or a prescribed energy worker; or an affected energy contractor.
