Energy Coordination (General) Regulations 1995

The regulations are built around a small number of structural concepts that determine how the Energy Coordination Act’s powers are operationalised.

Inspectors and classification. Inspectors are designated by the issuing authority, which the regulations define as the Director (reg 3). There are two discrete classifications: Inspector (Gas) and Inspector (Electricity) (reg 5). The classification determines the statutory Acts under which the inspector may exercise powers: Inspectors (Gas) may only exercise their powers for the Gas Standards Act 1972 and the Energy Coordination Act 1994; Inspectors (Electricity) may only exercise powers for the Electricity Act 1945 and the Energy Coordination Act 1994 (reg 7 and the Table to reg 7). The certificate of designation documents the classification, the specific powers of inspection that may be exercised, and any limitations and restrictions that apply (Form 1).

Qualification and gatekeeping. The issuing authority must be satisfied the candidate has the qualifications and experience to carry out, properly and efficiently, the duties of the classification specified on the instrument of designation (reg 6). The regulation does not catalogue minimum academic qualifications or single professional accreditations; it establishes an administrative satisfaction test for the issuing authority.

Limits on powers. The regulations explicitly limit the exercise of powers to the Acts specified in the Table and to the scope set out in the certificate of designation. The instrument therefore embeds a twofold constraint: a categorical constraint (gas versus electricity) and an individualised constraint (limitations/restrictions on the certificate) (reg 7).

Variation and administrative offence. The issuing authority may vary or cancel a certificate of designation (reg 8(1)). Where varied or cancelled, the designated person must return the certificate (reg 8(2)). Failure to return the certificate is an offence with a monetary penalty of $200 (reg 8(3)).

Infringement regime. The regulations prescribe specific offences under the Energy Coordination Act 1994 for which infringement notices may be issued under Part 2 of the Criminal Procedure Act 2004 (reg 9(1), Schedule 2). Modified penalties are specified for individuals and bodies corporate (Schedule 2). The Director may appoint authorised and approved officers or classes of persons to act under the Criminal Procedure Act 2004 Part 2, and must issue a certificate of appointment to each authorised officer (reg 10).

Prescribed forms and payment process. Schedule 1 sets the prescribed forms for certificate of designation, infringement notice and withdrawal of infringement notice (reg 4, Schedule 1). The infringement notice form sets a 28 day payment period and provides the process for payment and for electing prosecution in court, and it lists the enforcement actions that may follow non‑payment under the Fines, Penalties and Infringement Notices Enforcement Act 1994 (Form 2).

Technical review panel for specific appeals. For appeals under section 19B(2)(b) of the Energy Coordination Act 1994, the chief executive officer must convene a technical review panel composed of three professional engineers appointed from nominees of the President of the WA Division of The Institution of Engineers Australia, with one member appointed chair (reg 12(1)-(3)). The panel’s procedure is largely left to its own determination, subject to minimum procedural obligations set out in reg 13, including giving the Director a reasonable opportunity to make submissions and completing the review within a period the chief executive officer specifies (regs 12 and 13).

Allocation of administrative discretion. Multiple decision points are allocated to the Director and the chief executive officer: Director as issuing authority and appointing officer for authorised officers; chief executive officer to convene panels, appoint the chair and determine time frames and administrative support (regs 3, 10, 12, 13). The chief executive officer may also, on recommendation of the Public Sector Commissioner, determine remuneration for panel members (reg 12(4)).

Interconnection with other statutes. The regulations operate by reference to other statutes: the Energy Coordination Act 1994 (the parent Act), the Gas Standards Act 1972, the Electricity Act 1945, the Criminal Procedure Act 2004 Part 2 and the Fines, Penalties and Infringement Notices Enforcement Act 1994 (reg 7, reg 9, Form 2). The regulations therefore form an administrative layer between subject matter Acts and existing enforcement and court procedures.

These concepts determine who can act, how they act, the limits on action, the remedies available for non‑compliance, and the appeal process. The regulations prefer administrative definition and formal documentation (certificates, prescribed forms) to detailed operational rules inside the instrument itself.

The regulations affect several identifiable groups, each subject to different duties, rights and enforcement consequences.

Designated inspectors. Individuals who may be appointed as Inspector (Gas) or Inspector (Electricity) are directly affected. The issuing authority is the Director, who must be satisfied as to a candidate’s qualifications and experience before designation (reg 3, reg 5, reg 6). A designated inspector receives a certificate of designation which documents their classification, the Acts in which they may exercise powers, the powers of inspection they may exercise, and any limitations or restrictions (Form 1). Inspectors whose certificates are varied or cancelled must return the certificate or face a $200 penalty (reg 8).

Director and chief executive officer. The Director (defined in reg 3 as the issuing authority) has responsibility for designations, for appointing authorised and approved officers to issue infringement notices, and for receiving notifications such as notices of appeal and infringement responses (reg 3, reg 10, reg 13). The chief executive officer must convene technical review panels for appeals under s 19B(2)(b) of the Act, appoint panel members from nominees, designate the chair, provide panel support services, and set the period within which the panel must complete its review (regs 12-13). The chief executive officer also has discretion to direct payment of remuneration and to determine the amount on the recommendation of the Public Sector Commissioner (reg 12(4)).

Authorised and approved officers. Persons appointed by the Director as authorised or approved officers under the Criminal Procedure Act 2004 Part 2 are empowered to issue infringement notices in respect of Schedule 2 offences (reg 10(1)-(2), reg 9). The Director must issue a certificate of appointment to each authorised officer (reg 10(2)). The regulations do not limit the classes of persons who may be appointed, leaving flexibility for the Director to appoint persons or classes of persons.

Network operators. Network operators are explicitly named as appellants in Part 4. If a network operator commences an appeal under s 19B(2)(b) they must follow the prescribed appeal procedure, including delivering a written notice of appeal within 30 days of receiving the Director’s written notice under s 19A(5) or 18C(6) of the Act, and the notice must state grounds and any representations (reg 11, reg 13(1)-(3)). Network operators therefore carry the time and procedural burden of starting the appeal and providing the technical content of their case to the technical review panel.

Alleged offenders and regulated entities. Persons and bodies corporate who may be subject to inspections, orders from inspectors, or infringement notices are affected by the offence list in Schedule 2 and the prescribed modified penalties. Schedule 2 identifies specific Energy Coordination Act sections where non‑cooperation, failure to provide information, false or misleading information, and failure to comply with inspector orders attract monetary penalties ranging from $1,000 to $15,000 depending on whether the offender is an individual or a body corporate and depending on the statutory basis of the order (Schedule 2). Entities required to provide access, assistance, documents or to comply with orders must therefore budget for compliance and the risk of monetary sanctions.

Professional engineers and The Institution of Engineers Australia. For appeals requiring a technical review panel, the pool of nominees comes from the President of the Western Australian Division of The Institution of Engineers Australia. The institution therefore is the funnel for nominations of technically competent engineers (reg 12(2)). Engineers who are members and who are competent in the relevant technical fields may be appointed and may receive remuneration determined by the chief executive officer on the recommendation of the Public Sector Commissioner (reg 12(4)).

Public Sector Commissioner. The Public Sector Commissioner is indirectly involved: the chief executive officer may determine remuneration for panel members on the recommendation of the Public Sector Commissioner (reg 12(4)). That ties panel remuneration to standard public service recommendations.

Courts and enforcement bodies. The Criminal Procedure Act 2004 Part 2 provides the legal mechanism for issuing infringement notices. The Fines, Penalties and Infringement Notices Enforcement Act 1994 is referenced in the infringement notice form and lists potential enforcement mechanisms for failure to pay the modified penalty (Form 2). Courts may also be engaged if the alleged offender elects prosecution rather than paying the modified penalty within 28 days (Form 2).

In short, the regulations primarily affect the Director and chief executive officer as decision makers, inspectors and authorised officers as agents of enforcement, network operators as the class with a specific appeal right, professional engineers as potential panel members, and regulated persons and corporations facing inspection, orders and financial penalties.

This section identifies the concrete duties imposed or rights created by the regulations, citing the specific provisions that impose them.

Duties on the issuing authority (Director)

• Satisfy themselves that a candidate for designation has adequate qualifications and experience before designating them as an inspector (reg 6). This is an administrative gatekeeping duty; the regulation does not supply objective minimum criteria but requires satisfaction.
• Issue a certificate of designation reflecting classification, powers and any limitations/restrictions (reg 7; Form 1).
• Vary or cancel certificates of designation if appropriate (reg 8(1)). Where varied or cancelled, the issuing authority must be prepared to receive the return of the old certificate (reg 8(2)).

Duties on designated inspectors

• Hold only the powers specified for their classification and the powers documented in their certificate (reg 7). The regulation plainly states the powers may only be exercised for the specified Acts (Table to reg 7) and subject to the certificate’s limitations and restrictions.
• Return a certificate when it is varied or cancelled (reg 8(2)). Failure to do so is an offence that attracts a $200 penalty (reg 8(3)).

Duties on the Director regarding infringement regime

• Appoint persons or classes of persons to be authorised or approved officers to operate under the Criminal Procedure Act 2004 Part 2 (reg 10(1)). The Director must issue to each authorised officer a certificate of appointment (reg 10(2)). The appointment duty is discretionary but the regulation requires issuance of a certificate once appointment is made.

Duties on authorised officers

• Issue infringement notices in the form prescribed in Schedule 1 (Form 2) for the offences listed in Schedule 2 (reg 9, reg 10, Schedule 1 Form 2).

Duties on appellants (network operators)

• Lodge an appeal by giving the chief executive officer a written notice of appeal within 30 days of receipt of the Director’s written notice under s 19A(5) or of the Director’s refusal under s 18C(6) (reg 13(1)-(3)). The notice must set out grounds of appeal and any representations the appellant wishes to make (reg 13(2)(a)-(c)).
• Provide the technical material necessary for a technical review of the specific matter; the panel are professional engineers competent to deal with the subject matter and will determine procedure subject to the minimum procedural requirements in reg 13 (regs 12-13).

Duties on the chief executive officer

• Convene the technical review panel when an appeal is made (reg 12(1)). The chief executive officer appoints panel members from nominees, appoints the chair, may direct payment of remuneration and must provide reasonable support services for the panel (reg 12(2)-(5)).
• Give the technical review panel the notice of appeal as soon as practicable after it is convened (reg 13(4)).
• Specify in writing the period within which the technical review panel must complete the review (reg 13(7)).

Duties on the technical review panel

• Be composed of three professional engineers competent in the subject matter and be appointed by the chief executive officer from nominees of the President of the WA Division of The Institution of Engineers Australia (reg 12(2)).
• Appoint one member as chair (reg 12(3)).
• Give the Director a copy of the notice of appeal and a reasonable opportunity to make submissions (reg 13(6)(a)-(b)).
• Complete the review and make a decision under section 19B(3) of the Act within the period specified by the chief executive officer, and give written notice of its decision to both the appellant and the Director (reg 13(7)-(8)).

Rights of alleged offenders

• Elect prosecution in court rather than paying a modified penalty by ticking the box on the infringement notice form and returning it within 28 days (Form 2). Payment of the modified penalty within 28 days avoids prosecution. The form also instructs how to pay and how to apply for an extension of time.

Rights and obligations arising under the infringement regime

• The prescribed offences and their modified penalties are set out in Schedule 2; the modified penalty is the amount for the purposes of the Criminal Procedure Act 2004 s 5(3) (reg 9(2)). An alleged offender can therefore choose between paying the modified penalty under the Criminal Procedure Act or facing prosecution.

Administrative rights

• Panel members may be remunerated at a level determined by the chief executive officer on the recommendation of the Public Sector Commissioner, and they are entitled to reasonable support services from the chief executive officer (reg 12(4)-(5)).

These duties and rights are principally administrative and procedural. The regulations do not create or define the underlying substantive offences beyond specifying which provisions of the Energy Coordination Act 1994 are subject to the infringement penalty regime (Schedule 2). They also do not specify the detailed content of inspectors’ powers under the parent statutes; they confine and document the exercise of those powers by classification and certificate.

The regulations prescribe monetary penalties for specific offences and embed those penalties within an infringement notice enforcement framework, while also specifying a separate monetary penalty for a discrete administrative offence.

Infringement notice framework. Regulation 9(1) designates the offences in Schedule 2 as offences for which an infringement notice may be issued under Part 2 of the Criminal Procedure Act 2004. Regulation 9(2) makes the modified penalty shown opposite an offence in Schedule 2 the modified penalty for the purposes of the Criminal Procedure Act 2004 section 5(3). The practical enforcement mechanics are visible in the prescribed Form 2: an alleged offender is given 28 days to pay the modified penalty to the Director of Energy Safety (Form 2). If the modified penalty is not paid within 28 days, the notice warns the recipient of possible prosecution or enforcement action under the Fines, Penalties and Infringement Notices Enforcement Act 1994 and lists potential enforcement measures such as suspension of licences, publication of details, garnishment and seizure and sale of property (Form 2). The form also allows the recipient to elect prosecution in court by returning the notice within 28 days.

Schedule 2 specifics. Schedule 2 itemises the Energy Coordination Act offences and sets separate modified penalties for individuals and bodies corporate. The listed offences and figures are:

• s 20(1)(b): Failing to give inspector access to land, premises or thing, or to give reasonable assistance when required under s 14(b) , modified penalty $1,000 (individual), $5,000 (body corporate).
• s 20(2): Failing to provide information, records or documents when requested under s 14(d) , modified penalty $1,000 (individual), $5,000 (body corporate).
• s 20(3): Giving false or misleading information in response to a request under s 14(d) , modified penalty $1,000 (individual), $5,000 (body corporate).
• s 20(4): Failing to comply with an order given by an inspector under s 18 , modified penalty $2,000 (individual), $10,000 (body corporate).
• s 20(4): Failing to comply with an order given by an inspector under s 18A, 18B or 18C , modified penalty $3,000 (individual), $15,000 (body corporate).

These figures create a stepped monetary regime where bodies corporate face fivefold higher penalties than individuals for the listed breaches, and different statutory bases for inspector orders attract different levels of penalty.

Administrative offence for failure to return certificate. Regulation 8(3) makes it an offence for a person who has had their certificate of designation varied or cancelled to fail to return the certificate to the issuing authority, with a specified penalty of $200.

Authority to appoint infringement officers and certificates. The Director may appoint persons or classes of persons to be authorised or approved officers for the Criminal Procedure Act 2004 Part 2 (reg 10(1)). The Director must issue to each authorised officer a certificate of appointment (reg 10(2)). That confers delegated enforcement capacity to persons the Director appoints and provides a documented record that can be produced in enforcement or challenge.

Procedural enforcement and rights. The infringement notice form (Form 2) prescribes the mechanics for notice delivery, payment, and election of prosecution. It sets a 28 day timeframe to pay or to elect prosecution, provides payment channels, states the possible enforcement responses under the Fines Act, and offers a procedure for requesting an extension of time. The form also includes a box the recipient can tick to elect court prosecution rather than paying the modified penalty.

Interaction with criminal and enforcement statutes. The regulations do not themselves contain enforcement powers beyond the specified penalties and the authorised officer appointment mechanism; they rely on the Criminal Procedure Act 2004 for the legal mechanics of infringement notices and on the Fines, Penalties and Infringement Notices Enforcement Act 1994 for enforcement actions following non‑payment (reg 9; Form 2). That means enforcement measures such as licence suspension and garnishee orders are exercised under those separate Acts, as notified on the prescribed infringement notice.

Allocation of enforcement discretion. The Director’s discretion to appoint authorised officers (reg 10(1)) and to vary or cancel certificates of designation (reg 8(1)) assigns central administrative discretion that can affect how enforcement is implemented. The chief executive officer also exercises administrative discretion over the technical review panel’s timeframe and remuneration (reg 12(4), reg 13(7)). These are implementation levers that affect the realisation of penalties and the speed of dispute resolution.

In sum, the regulations create a prescribed monetary penalty schedule for select administrative failures and embed those penalties in an infringement notice framework governed by other statutes. They also create a modest administrative offence for failing to return a cancelled or varied certificate. Enforcement is a mix of administrative notice, statutory enforcement under the Fines Act, and optional criminal prosecution if the alleged offender elects that process.

These regulations operate as subordinate legislation to the Energy Coordination Act 1994 and interact explicitly with several other statutes, depending on the function being implemented.

Energy Coordination Act 1994. The regulations are made under the Energy Coordination Act and implement procedural aspects of that Act. References throughout the instrument point readers back to specific provisions of the Act that create the substantive powers (for example sections 12-13 for designation, 14 for powers of inspectors and access, 18-18C for inspector orders, 19A-19B for appeal mechanics). The regulations therefore do not recreate substantive inspection powers or offences; they supply the administrative detail required to exercise those powers and to administer appeal and infringement mechanisms.

Gas Standards Act 1972 and Electricity Act 1945. Regulation 7’s Table links the inspector classifications to the Acts for which the class may exercise powers. Inspectors (Gas) may exercise powers for the Gas Standards Act 1972 and the Energy Coordination Act 1994; Inspectors (Electricity) may exercise powers for the Electricity Act 1945 and the Energy Coordination Act 1994 (reg 7 and the Table). That linkage means that when an inspector of a given class exercises powers, those powers must be exercised in the statutory context of the relevant Act. The regulations do not amend those Acts; rather they limit which Act a particular inspector classification can operate under.

Criminal Procedure Act 2004. Regulation 9 designates Schedule 2 offences as those for which infringement notices may be issued under Part 2 of the Criminal Procedure Act 2004. It also makes the Schedule 2 modified penalty amounts the relevant figures for the Criminal Procedure Act section 5(3) purposes. The mechanics of serving an infringement notice, payment, and the consequences for non‑payment are therefore governed procedurally by the Criminal Procedure Act and are not restated in full in these regulations.

Fines, Penalties and Infringement Notices Enforcement Act 1994. The infringement notice form (Form 2) explicitly warns alleged offenders that if the modified penalty is not paid within 28 days "enforcement action may be taken under the Fines, Penalties and Infringement Notices Enforcement Act 1994" and lists the types of enforcement that may follow. The substantive enforcement options available after non‑payment (for example licence suspension, publication, garnishment, seizure and sale) are therefore exercised under that separate statute.

Reprints Act 1984 and amendment instruments. The compilation table and notes show that the regulations’ citation and content have been amended over time and that reprints have occurred under the Reprints Act 1984 (Notes and Compilation table). Several discrete amendment instruments (2004, 2007, 2009, 2011, 2013, 2020) modified the regulations; the compilation table records those changes and their commencement dates. The regulations therefore must be read in the context of their amendment history.

Public sector remuneration procedures. The chief executive officer may determine remuneration for technical review panel members on the recommendation of the Public Sector Commissioner (reg 12(4)). That cross‑reference connects panel member remuneration to public sector remuneration processes established elsewhere in public sector law and practice.

Institutional nomination role. The Institution of Engineers Australia (Western Australian Division) is given an institutional role: the President of that Division nominates individuals from whom the chief executive officer appoints the technical review panel members (reg 12(2)). That interaction creates a formal linkage between a professional body and the administrative appeal procedure.

Forms and administrative law practice. The prescribed forms operate by reference to the Director of Energy Safety and include placeholders for addresses and certificate numbers (Schedule 1). The use of prescribed forms aligns with standard administrative practice for record keeping and evidentiary clarity across interacting statutes.

In short, the regulations do not stand alone: they implement procedural specifics for inspector designation, infringement notices and appeals and rely on, and interact with, the substantive Acts that confer inspection and order powers, the Criminal Procedure Act for infringement mechanics, the Fines Act for enforcement, public sector remuneration mechanisms, and the Institution of Engineers Australia for nominations to technical review panels. Any party working under the regulations therefore needs to read them alongside the referenced Acts to fully understand rights, powers and enforcement pathways.

The regulations have been amended multiple times since their initial publication. The Compilation table records the sequence of instruments and dates that altered citation, content, and commencement arrangements. The following timeline is drawn from the compilation material included in the source.

Initial instrument and reprints

• The instrument was originally published as the Energy Coordination (Designation of Inspectors) Regulations 1995, published 23 December 1994 and commencing 1 January 1995 (see r 2 and Gazette references in the Compilation table).
• A reprint entitled Reprint 1 (as at 7 May 2004) consolidated earlier changes up to that date.

Amendments

• Commerce Regulations Amendment (Infringement Notices) Regulations 2020 Pt. 13 (SL 2020/163 25 Sep 2020). This amendment is recorded in the compilation table with commencement 29 Sep 2020 (see SL 2020/159 cl. 2(a)) and is reflected in the forms and infringement notice machinery.

Citation changes and reclassification

• The regulations’ citation was altered through their history. The instrument was initially the Energy Coordination (Designation of Inspectors) Regulations 1995 but was subsequently retitled Energy Coordination (Inspectors and Infringement Notices) Regulations 1995 and later the Energy Coordination (General) Regulations 1995. The Notes explain that the citation change was effected and is reflected in the Reprints Act 1984 cross references.

Notable insertions and structural changes

• Part 4 , Appeals under s 19B(2)(b) , was inserted and is dated in the Gazette to 30 Nov 2007 with subsequent amendments in 2011 to reg 12.
• Schedule 1 (Forms) was amended and expanded in 2007 and later in 2013 and 2020 to update the prescribed forms and the text included on the infringement notice form.
• Schedule 2 (Prescribed offences and modified penalties) was added in 2009 to implement the infringement notice regime for specified offences and to set the modified penalty amounts for individuals and bodies corporate.

This amendment history matters for compliance and interpretation because the current obligations, offence lists and forms reflect those staged changes. Agencies, regulated entities and practitioners need to ensure they are using the current forms (Schedule 1) and are aware of the list of prescribed offences in Schedule 2 as established by the 2009 amendment and later adjustments. The compilation table serves as the authoritative ledger for what versions and commencement dates applied at various points.

The source material supplied contains no reported litigation, cases, or judicial interpretations of these regulations. The regulations themselves reference appeal rights under the Energy Coordination Act 1994 (for example section 19B(2)(b)) and set out the administrative appeal process to a technical review panel (Part 4, regs 11-13), but the instrument does not identify any case law or past decisions.

What the source shows

• The regulations provide a statutory appeal pathway for network operators to obtain a technical review of a Director’s determination under section 19B(2)(b) of the Act, but do not reference any judicial review or court decisions on the merits or on procedural fairness regarding those panels.
• There is no bibliography of cases, no decisions attached, and no mention of precedent or judicial guidance in the text provided.

Consequences for practitioners

• Because there is no litigation history in the source, practitioners should treat the procedural requirements in regs 11-13 as the governing administrative process for those appeals and be cautious that any legal challenge to panel decisions would likely proceed under general administrative law principles rather than under a body of decisions specific to these regulations, at least insofar as the compiled material does not record such decisions.
• Where contested matters arise involving the interpretation of the regulations or of the Director’s underlying determinations under the Energy Coordination Act, parties will need to rely on the statutory text, the regulations, and general administrative law; any precedent must be identified by searching court databases and subsequent case law not provided in this instrument.

In short, the compiled regulations themselves contain no litigation history. Any analysis of how courts have treated the appeal mechanism, the inspector designation regime, the validity of infringement notices or the enforcement under the Fines Act will require independent research of case law beyond the material contained in the regulations as presented.

The regulations are concise but contain several practical traps and administrative levers that frequently lead to disputes or compliance failures in regulatory practice. These are specific mechanics, not opinions.

1. Certificate return obligation is a stand‑alone offence with a low fixed penalty. When a designation is varied or cancelled, the designated person must return the certificate to the issuing authority (reg 8(2)). Failure to return it attracts a specific $200 penalty (reg 8(3)). That is a discrete administrative offence and is not subsumed under other penalties. Practically, an individual who loses or misfiles a certificate following variation or cancellation can incur this penalty if they do not proactively return the physical certificate.

2. Inspector powers are tightly linked to classification and certificate. An inspector’s statutory powers may only be exercised for the Acts listed opposite their classification in the Table to reg 7 and are further constrained by any limitations and restrictions on the certificate (reg 7 and Table). If an inspector attempts to exercise a power outside the Acts specified for their classification or contrary to the certificate’s limitations, that act may lack legal authority. The regulations require explicit documentation of the scope of powers on Form 1. Practically, regulated entities should require inspectors to produce their certificate and confirm the scope before providing access or information.

3. The issuing authority’s qualification test is subjective. Regulation 6 requires the issuing authority to be "satisfied" that a candidate has qualifications and experience sufficient to carry out the duties of the specified classification. The regulation does not set objective minimum qualifications. That creates decision‑making discretion and potential litigation risk where an appointment or refusal to appoint is contested, because the legal standard is administrative satisfaction rather than a fixed credential.

4. Authorised officer appointments may be broad. The Director may appoint "persons or classes of persons" to be authorised officers for the Criminal Procedure Act 2004 Part 2 (reg 10(1)). That permits appointment of broad classes (for example, contractors or administrative staff) unless the Director constrains appointments. Reg 10(2) requires certificates of appointment but does not prohibit appointment of non‑specialist classes, which can affect enforcement consistency and challengeability.

5. Time limits for appeals are short and state‑triggered. A network operator must give the chief executive officer a notice of appeal within 30 days after receiving the Director’s written notice under s 19A(5) or a refusal under s 18C(6) (reg 13(3)). The 30 day clock is strict; failing to meet it risks losing the right to the technical review panel. The notice must set out grounds and any representations, which requires preparation of technical material within the timeframe.

6. Panel procedure and timeline are internally set. The technical review panel "may determine its own procedure" (reg 13(5)), subject to giving the Director a copy of the notice of appeal and a reasonable opportunity to make submissions (reg 13(6)). The critical variable is reg 13(7): the panel must complete the review within the period specified by the chief executive officer in writing. That means the chief executive officer controls the overall timeframe, which could be short. Appellants therefore confront procedural uncertainty about how quickly the panel will act unless timeframes are specified in writing early.

7. Panel nominations channel through a single professional body. Panel members must be appointed from individuals nominated by the President of the Western Australian Division of The Institution of Engineers Australia (reg 12(2)). This centralises nominations in a single professional body. If the pool of nominees is small or if conflicts of interest arise within that body, parties may find limited practical options for changing panel composition.

8. Disparity in modified penalties between individuals and corporate entities. Schedule 2 sets modified penalties that are five times higher for bodies corporate than for individuals across the listed offences. Entities that contractually allocate regulatory risk should note the significantly higher exposure for corporate entities (Schedule 2).

9. Overlap with other statutes for enforcement. The infringement notice warns of enforcement measures under the Fines, Penalties and Infringement Notices Enforcement Act 1994, including licence suspensions, garnishment and seizure (Form 2). Those enforcement pathways are powerful and not administered under these regulations; parties may be surprised by the range of enforcement tools available once a modified penalty is not paid.

10. Form reliance and placeholders. The prescribed forms include placeholders (for addresses, certificate numbers and the Director of Energy Safety details) which must be correctly completed. An incorrectly completed Form 2 could be contested on procedural grounds. Practically, authorised officers must ensure correct completion and record keeping to support enforcement.

11. Remuneration and support services discretion. The chief executive officer may direct payment of remuneration to panel members and determine its amount on the recommendation of the Public Sector Commissioner; the chief executive officer must also provide reasonable support services to the panel (reg 12(4)-(5)). That discretion affects costs and speed of the appeal process, and network operators should budget for potential fees or administrative costs tied to panel support.

Addressing these gotchas requires operational steps: insist on certificate production, track and calendar appeal timeframes, ensure document retention and swift assembly of technical grounds, and maintain awareness of the authorised officer appointment certificates and the exact form content.

This section gives a practical compliance checklist tied to the regulations’ text for (a) persons who might be designated inspectors, (b) authorised officers and the Director, and (c) regulated entities (including network operators and other persons likely subject to inspection or orders).

For candidates for designation as inspectors (Inspector (Gas) or Inspector (Electricity))

• Ensure documentary proof of qualifications and experience is prepared and available. The issuing authority must be "satisfied" that you possess qualifications and experience to carry out duties of the classification (reg 6). Prepare CVs, certificates, registration numbers, practising certificates and evidence of technical experience relevant to gas or electricity operations.
• Obtain and retain the Certificate of Designation once issued. The certificate documents the classification, specified Acts, the powers the inspector may exercise, and any limitations or restrictions (Form 1). Keep the original safe because if the certificate is varied or cancelled you must return it (reg 8(2)), and failure to return is a $200 offence (reg 8(3)).
• Familiarise yourself with the Acts linked to your classification. Inspectors (Gas) operate under the Gas Standards Act 1972 and the Energy Coordination Act 1994; Inspectors (Electricity) operate under the Electricity Act 1945 and the Energy Coordination Act 1994 (reg 7 and Table).

For the Director and chief executive officer (administrative implementers)

• Maintain objective appointment records and written satisfaction notes for inspector designations. The qualification test is subjective, so contemporaneous records explaining how the issuing authority was satisfied will reduce challenge risk (reg 6).
• When varying or cancelling certificates, ensure a clear return process and receipt system for returned certificates to avoid the $200 penalty being triggered inadvertently (reg 8).
• Issue and archive certificates of appointment for authorised officers. Regulation 10(2) requires a certificate for each authorised officer. Keep copies for enforcement action support and public transparency.
• Maintain up to date forms and addresses. Schedule 1 prescribes forms that include addresses for payment to the Director of Energy Safety; these must be current and correctly filled when issuing an infringement notice (Schedule 1, Forms 2-3; reg 4).
• For technical review panels: ensure nomination processes are triggered with the President of the WA Division of The Institution of Engineers Australia and that appointed engineers are competent in the subject matter. Provide the panel with reasonable support services promptly and specify the review period in writing (regs 12-13).
• If determining remuneration for panel members, follow the required process of basing the amount on the recommendation of the Public Sector Commissioner (reg 12(4)).

For authorised officers and enforcement staff

• Use the prescribed Form 2 when issuing infringement notices and ensure all mandatory content is included. The 28 day timeframe for payment runs from the date on the prescribed form (Form 2).
• Keep clear records of service of infringement notices and follow the Criminal Procedure Act 2004 Part 2 mechanics for enforcement, as the regulations only designate the offences and set the modified penalties (reg 9, Schedule 2).
• If an alleged offender pays, process the payment and track any necessary refund obligations if a notice is later withdrawn (Form 3).

For regulated entities and persons likely to be inspected

• Verify the inspector’s designation on request. Before giving access, assistance or documents, ask for the Certificate of Designation to ensure the inspector is acting within the classification and within any limitation(s) listed on the certificate (Form 1; reg 7).
• Maintain a clear internal point of contact for inspector interactions. Train staff to provide reasonable assistance but to escalate requests for access or production of documents to a nominated compliance officer or legal counsel to ensure the response aligns with legal obligations under the Energy Coordination Act and the inspector’s remit.
• Preserve and produce documents when properly requested. Schedule 2 prescribes penalties for failure to provide information, records or documents when requested under s 14(d) (Schedule 2). Have document retrieval processes and retention policies to meet requests promptly.
• Avoid giving false or misleading information in response to requests. Schedule 2 prescribes a modified penalty for giving false or misleading information in response to a request under s 14(d) (Schedule 2).
• Comply with lawful inspector orders. Schedule 2 provides modified penalties for failing to comply with orders under s 18 and under s 18A-18C (Schedule 2). If an order is contested, challenge mechanisms include an appeal under s 19B(2)(b) (reg 11-13), but do not ignore orders while contesting them without legal advice.
• If served with an infringement notice, note the 28 day payment window and the option to elect prosecution. If you do not wish to pay the modified penalty and prefer court proceedings, tick the box on Form 2 and return it within 28 days (Form 2). Consider seeking an extension in writing to the Director if more time is needed (Form 2).
• For network operators contemplating an appeal under s 19B(2)(b): prepare a written notice of appeal within 30 days of receiving the Director’s written determination or refusal under the relevant Act sections, and include clear grounds and any technical representations (reg 13(1)-(3)). Anticipate that the chief executive officer will convene a panel and will specify the review period in writing; prepare to submit technical evidence promptly.

Record keeping and compliance systems

• Document every interaction with inspectors, keep copies of all certificates and infringement notices, and retain a log of requests for information and responses. The infringement enforcement process is coordinated with other statutes and can result in downstream enforcement actions under the Fines Act if a modified penalty is not paid (Form 2).
• Establish incident protocols for the receipt of an inspector’s order: immediate legal review, identification of affected assets and records, and a strategy to comply or to promptly commence a technical appeal where relevant.

In short, comply by verifying inspector authority, keeping documentary evidence of qualifications and appointments, responding promptly to legitimate requests for access and documents, contesting orders through the specified appeal route where appropriate, and treating infringement notices seriously within the 28 day payment or election period.
