### 98 Withdrawal and dismissal of application > > (1)  A person who has made an application may, by notice to the Commission, withdraw the application. > > > (2)  The Commission is to give notice to the following persons of the withdrawal of an application under [subsection (1)](#GS98@Gs1@EN) in relation to a relevant decision: > > > > > > (a) the person who is the subject of the relevant decision; > > > > > > > (b) the person who made the relevant decision; > > > > > > > (c) the PMP in relation to the person who is the subject of the relevant decision. > > > (3)  If the person who is the subject of a relevant decision to which an application relates dies, the application is taken to be withdrawn. > > > (4)  The Commission may at any time dismiss an application if, in the opinion of the Commission, the application is frivolous, vexatious, misconceived or lacking in substance or otherwise an abuse of process.
