### 80 Notice where AHP determines person does not have decision-making capacity or is not acting voluntarily
> If a person’s AHP determines under [section 78](#GS78@EN) that the person does not have decision-making capacity or is not acting voluntarily, the AHP must, as soon as reasonably practicable, but in any case within 24 hours –
>
> > > (a) notify the person, a guardian of the person or another person who cares for or who has responsibility for the person, of the determination; and
> >
> > > (b) notify the Commission of the determination; and
> >
> > > (c) if the AHP is not the person’s PMP, notify the person’s PMP of the determination.
