### 62 Appointment of AHP
> > (1) If a person’s PMP gives advice to the person under [section 60(b)](#GS60@Hpb@EN) that the PMP does not intend to be the person’s AHP, the PMP must, as soon as reasonably practicable but in any case within 2 days, in writing, request the Commission to appoint an AHP in relation to the person.

> > (2) If the Commission receives a request under [subsection (1)](#GS62@Gs1@EN) from a person’s PMP, the Commission must, by an instrument in writing, signed by the Commission, appoint a medical practitioner, or a registered nurse, to be the person’s administering health practitioner (the person’s ***AHP***).
>
> > (3) A person may not be appointed under [subsection (2)](#GS62@Gs2@EN) to become a person’s AHP if the person is –
> >
> > > > (a) a member of the family of the person’s PMP or CMP; or
> > >
> > > > (b) employed by, contracted directly or indirectly by, or working under the supervision of, the person’s PMP or CMP; or
> > >
> > > > (c) the employer of, has a direct or indirect contract with, or is a supervisor of, the person’s PMP or CMP.
