### 61 AHP in relation to person
> > (1) Subject to [subsection (2)](#GS61@Gs2@EN) , if a person’s PMP has determined a final request by the person by determining under [section 55(a)](#GS55@Hpa@EN) that the person is eligible to access voluntary assisted dying, the person’s PMP (whether or not that PMP was the PMP who made the determination) becomes the person’s administering health practitioner (the person’s ***AHP***).

> > (2) [Subsection (1)](#GS61@Gs1@EN) does not apply in relation to a person’s PMP if –
> >
> > > > (a) the PMP has advised the person under [section 60(b)](#GS60@Hpb@EN) that the PMP does not intend to be the person’s AHP; or
> > >
> > > > (b) [subsection (3)](#GS61@Gs3@EN) applies in relation to the person.

> > (3) If a person is appointed under [section 62(2)](#GS62@Gs2@EN) to be the administering health practitioner in relation to a person, the person so appointed is the person’s AHP.
