### 40 Refusal to accept referral > > (1) A medical practitioner to whom a person is referred under [section 37(1)](#GS37@Gs1@EN) must refuse to accept the referral if the medical practitioner is not an authorised medical practitioner in relation to the person. > > > (2) A medical practitioner to whom a person is referred under [section 37(1)](#GS37@Gs1@EN) may refuse to accept the referral for any reason, including, but not limited to, because the medical practitioner has a conscientious objection to providing assistance to the person to die.
