Enclosed Lands Protection Act 1943

The central concept is “enclosed lands”. The dictionary defines it to mean any lands, “whether public or private”, that are enclosed or surrounded by any fence, wall or other erection, or partly by such a structure and partly by a canal or some natural feature such as a river or cliff, “by which the boundaries of those lands may be known or recognised”. This definition includes not only fully fenced properties but also land where boundaries are marked by a combination of artificial and natural features. The crucial point is that the boundary must be ascertainable; unenclosed, open-range land is not covered by the Act. A road lawfully enclosed with the land of any person is excluded from the definition for the purposes of that land holder - that is, the road itself is not deemed to be part of the enclosed lands, but the surrounding land is deemed to be the enclosed lands of that person. This prevents a land holder from prosecuting a person merely for travelling on a public road that passes through their property.

A “road” is defined as any land proclaimed, resumed or otherwise provided as a public thoroughfare or way, including land defined, reserved or left as a road in any subdivision. “Stock” includes horses, cattle, sheep, goats and pigs - a definition relevant to the drover exception and the goat destruction power.

“Lawful excuse” is not exhaustively defined, but section 4(2) provides a specific example: a drover or person in charge of stock being driven on a road lawfully enclosed with any person’s lands is taken to have lawful excuse for entering those lands to prevent straying or to regain control of stock that have strayed. Section 4(3) also clarifies that if a road is lawfully enclosed and is not clearly defined, then either the centre of a reasonably defined track is taken to be the centre of the road, or if no such track exists, a person passing through does not commit an offence unless the route taken was unreasonable having regard to the circumstances. These provisions recognise the practical difficulties of travelling through land that contains a road whose boundaries are not physically marked.

The Act does not define “consent”, leaving it to common law. Consent may be express or implied - a tradesperson with an invitation or a member of the public entering a shop with an implied invitation would likely have lawful excuse, but the Act creates no explicit exception for everyday entry such as deliveries, mail, emergency services, or utility workers. The reverse onus means that the entrant would have to prove they had consent or another lawful excuse. This is a significant burden.

The gate offence in section 5 applies to anyone who enters onto enclosed lands and “wilfully or negligently” leaves a gate open or a slip panel down. The inclusion of negligence means that even a careless act - forgetting to close a gate - can result in a criminal conviction. The offence applies not only to gates on the enclosed lands themselves but also to gates on a road lawfully enclosed with those lands. The penalty is the same five penalty units.

The Act affects every person who might enter land that qualifies as “enclosed” under the statutory definition. This includes individuals such as walkers, cyclists, horse riders, hikers, delivery drivers, tradespeople, utility meter readers, surveyors, political canvassers, protestors, and any member of the public who crosses a fence, wall or other boundary marker without explicit permission. Because the definition extends to public lands, a person entering a fenced public park or reserve outside of opening hours, or a government‑owned building site with a perimeter fence, may be committing an offence even if they would ordinarily have public access. The Act does not exempt federal or ACT government employees, emergency services personnel, or persons acting under statutory powers, although those persons might have a lawful excuse under other legislation. The burden of proving that excuse, however, would be on the defendant.

Landowners, occupiers, and persons in charge of enclosed lands are the primary beneficiaries of the Act. They have the right to demand the full name and home address of anyone they reasonably believe is committing an offence, and they may use that information to pursue further action. They also have the statutory right to destroy trespassing goats - but only goats, and only unmarked ones. This right is a form of self‑help that is otherwise rare in Australian property law, and it does not extend to any other species of stock or domestic animals. For example, a dog or horse trespassing cannot be destroyed under this section.

Livestock drovers and persons in charge of stock are given a specific lawful excuse under section 4(2), but only when driving stock on a road lawfully enclosed with the land and only to the extent necessary to prevent straying or regain control. Outside that narrow context, they are subject to the same entry offence as anyone else.

The Act also indirectly affects neighbours and adjoining landowners. For instance, if a landowner maintains a gate on a road that passes through their enclosed land, any person using that road must not leave the gate open or face a penalty. The landowner’s own visitors, staff, or agents are also bound by the gate provision when entering or leaving.

Commercial entities that operate on enclosed land, such as farms, stations, mining operations, or large industrial sites, may benefit from the Act as a low‑cost criminal deterrent against unauthorised entry. However, the penalty of five penalty units (currently a maximum $550 fine) may be too low to deter determined trespassers, especially those who are not rational economic actors. The Act’s value lies more in providing a clear legal basis to demand identification and to initiate criminal proceedings, which may be useful for establishing a pattern of trespass or for supporting a civil action for damages.

Because the Act’s definition of “enclosed lands” includes public lands, government entities may also be affected. For example, the ACT Parks and Conservation Service could use the Act to prosecute people entering closed areas in nature reserves, but they would need to show the land is enclosed by a fence, wall, or other erection. A simple sign without a physical barrier would not bring the land within the definition.

The Act imposes three main duties on entrants onto enclosed lands: (1) not to enter without lawful excuse (which includes consent); (2) not to wilfully or negligently leave a gate or slip panel open; and (3) to provide full name and home address when required by the owner, occupier or person in charge, provided that person has reasonable grounds to believe an offence is being committed. The duty to provide identification arises even if the entrant is not actually committing an offence, as long as the demand is based on a reasonable belief. Failure to comply is itself an offence. The Act does not define what constitutes a “home address”. The Legislation Act 2001 (ACT) dictionary would apply by default, but it does not appear in the source to have a specific definition. Presumably it means the residential address where the person ordinarily lives.

The rights of the landholder are: (1) to require the name and address as described; (2) to destroy any unmarked goat found trespassing; and (3) to rely on the criminal process to enforce the Act. There is no right to use force to evict a trespasser, nor any power of arrest, though the common law would permit reasonable force to remove a trespasser in some circumstances. The Act does not create a power to detain a person or to search them.

The landholder also has a right, under the drover exception, to enter enclosed land to control straying stock, but this is a narrow right only for persons in charge of stock being driven on an enclosed road.

The most significant duty on the landholder is arguably not stated in the Act: they must not make a demand for identification without reasonable grounds. If they do, the demand is not lawful and the person would not be required to comply, but the Act does not provide a clear penalty for making an unjustified demand. A landholder who repeatedly abuses the power could potentially face a civil claim for harassment, but the Act is silent on this point.

The Act does not impose any duty on the landholder to post signs, mark boundaries, or provide a means of obtaining consent. Consequently, an entrant may not know that they are on enclosed lands until it is too late. The definition of “enclosed lands” includes boundaries that are “known or recognised” by natural features or fences, but the onus is on the entrant to be aware of these boundaries.

The gate‑keeping duty is strict in the sense that negligence suffices for criminal liability. A person who enters enclosed lands and accidentally leaves a gate open is guilty, even if the gate was difficult to close or if the person had no intention to leave it open. There is no requirement that the gate was originally closed; the offence is leaving it open after entry. This could catch persons who pass through a gate that was already open and fail to close it behind them, though the wording “leaves any gate open” suggests an act of leaving rather than failing to close a gate that is currently open. The safer interpretation is that the person must have opened it or passed through it and then left it in an open state.

Each offence under sections 4, 5, and 6 carries a maximum penalty of five penalty units. At the republication date, one penalty unit was $110 for an individual and $550 for a corporation (see Legislation Act 2001, s 133). Thus the maximum fine for an individual is $550, and for a corporation $2,750. These are relatively low amounts compared to many modern regulatory fines. The Act does not impose imprisonment; the only sanction is a fine.

The enforcement mechanism is the ordinary criminal process. The police may lay charges upon complaint, or the landholder could report the matter to police. There is no provision for infringement notices (on‑the‑spot fines) in the Act itself, though the ACT may have a general infringement notice scheme that could apply. The source does not mention such a scheme, so it cannot be assumed.

The reverse onus in section 4(1) means that the defendant must prove lawful excuse on the balance of probabilities. This is a departure from the usual criminal principle that the prosecution bears the burden. However, the High Court has upheld reverse onus provisions in property offences in some contexts. Practitioners should be aware that the defendant may need to lead evidence to show consent, statutory authority, or the drover exception.

The penalty for failing to give name and address under section 6 is also five penalty units. This is a relatively minor penalty for a failure to cooperate, but it may be effective in encouraging compliance because most people would prefer to give their name than risk a criminal conviction. The landholder does not have any power to detain the person while awaiting police; they must rely on the person’s willingness to comply or on their ability to note identifying details for later reporting.

Section 7 (goat destruction) does not create a penalty; it is a statutory defence to what would otherwise be destruction of property. The person destroying the goat would not face criminal charges for criminal damage or theft, but they might still be liable under animal cruelty legislation if the destruction is not humane. The Act does not specify a method of destruction. The authorised person may destroy the goat only if it is trespassing and not legibly branded or collared. If the goat is branded or collared, the owner has a form of property protection, and the landholder must not destroy it. There is no penalty for wrongly destroying a marked goat, but the landholder could be sued for damages or charged with an animal welfare offence.

The Act has been amended several times to update penalties. The decimal currency amendment in 1966 converted fines from pounds to dollars. The Statute Law Revision (Penalties) Act 1994 standardised the penalty references. The 2013 amendment (A2013‑19) appears to have been a further standardisation. The actual dollar amount of the fine has increased over time but remains modest.

This Act does not replace the common law of trespass. A person who enters enclosed land without permission may still be sued for damages in tort, and the landholder may obtain an injunction. The criminal offence under this Act is additional and not exclusive. Conviction under the Act does not prevent a civil action, and vice versa.

The Act interacts with the ACT Criminal Code 2002. The Criminal Code contains general offences of unlawful entry onto premises (s 114) and other property offences. The Enclosed Lands Protection Act is a specific, older law that may be preserved by the Criminal Code’s savings provisions. The narrow definition of “enclosed lands” and the reverse onus mean that the Act could be used in circumstances where the Criminal Code might not apply (for example, land that is not a “premises” but is enclosed). However, the penalty is lower. Prosecutors may choose whichever charge is easier to prove. The Criminal Code offence may carry higher penalties and a lower evidentiary burden for the prosecution.

The Act’s definition of “enclosed lands” includes public lands. This may intersect with the common law principle that members of the public have a right to enter public spaces for lawful purposes. However, if a public park is fenced and locked at night, the Act could be used to prosecute a person entering after hours. The ACT Human Rights Act 2004 protects the right to peaceful enjoyment of property and the right to freedom of movement. A court may need to consider whether the Act is applied consistently with human rights, but no such challenge is recorded in the source.

The self‑help goat destruction power under section 7 may conflict with the ACT Animal Welfare Act 1992. That Act prohibits cruelty to animals and may require that any destruction be carried out humanely. A landholder who shoots a goat in a painful or prolonged manner could be prosecuted under the Animal Welfare Act. The statutory defence in section 7 may not extend to the manner of killing. Additionally, the Destruction of the goat could be a seizure of property - if the goat is owned by another, the owner could sue for conversion or detinue. The Act does not provide a defence to civil liability, only to criminal offences.

The ACT Planning and Land Authority may have regulations about fencing and enclosing public land. If a fence is erected in breach of planning laws, the land may not be “lawfully enclosed” under the Act, but the Act does not require that the enclosure itself be lawful. The definition says “enclosed or surrounded with any fence, wall or other erection” without requiring that the fence be authorised.

The Act does not mention the ACT Courts or the Magistrates Court specifically for enforcement, but as a summary offence it would be heard in the Magistrates Court. The amendments in 1985 (Magistrates Court Ordinance 1985) likely aligned the Act with the then magistrates court jurisdiction.

Overall, the Act operates in a fragmentary manner alongside a range of laws. It does not consolidate all trespass laws, nor does it repeal any. Practitioners should check the specific circumstances to determine which laws apply.

The Act was originally enacted as the Enclosed Lands Protection Ordinance 1943 (Commonwealth) and notified on 4 February 1943. It commenced on that date. It has been amended nine times (including editorial changes). The first amendment was the Ordinances Revision (Decimal Currency) Ordinance 1966, which converted fines from pounds, shillings and pence to dollars. The second was the Magistrates Court Ordinance 1985, which updated references to the court. The most significant substantive change came after self‑government, when the Acts Revision (Arrest Without Warrant) Act 1989 substituted section 6. The original section 6 likely contained a power of arrest; the substituted version replaced it with the current provision requiring the giving of name and address, without any arrest power. This change removed a substantial enforcement tool from the landholder.

The Statute Law Revision (Penalties) Act 1994 amended sections 4, 5, and 6 to standardise penalty references, replacing specific dollar amounts with penalty units. The Legislation (Consequential Amendments) Act 2001 moved the dictionary definitions from section 3 to a separate dictionary section (s 2 was omitted and later reinserted). The Statute Law Amendment Act 2007 relocated definitions to the dictionary and made editorial changes. The 2009, 2011, and 2013 Statute Law Amendment Acts made minor amendments to sections 4, 5, 6, and the dictionary, mostly updating cross‑references and clarifying language. For example, the 2013 amendment (A2013‑19) changed the wording of the maximum penalty in sections 4 and 5 from “5 penalty units” to “5 penalty units” (the wording remained the same but the penalty unit value had already been updated by reference to the Legislation Act). The 2011 amendment to the dictionary inserted “stock” into the definition to include goats, thereby aligning the definition with the goat destruction provision.

Thus, the core provisions have remained remarkably stable for over 80 years. The only significant policy change was the removal of arrest power in 1989. The rest are housekeeping amendments. This stability suggests that the Act has not attracted much legislative attention or controversy. It also means that the Act’s language is archaic in places, such as the reference to “slip panel” (a removable section of fence) which is not defined.

The source does not mention any cases that have considered the Enclosed Lands Protection Act 1943. The endnotes and amendment history contain no references to judicial decisions, and the Act itself does not list any case law. This absence suggests that the Act has generated little reported litigation. It may be that the Act is infrequently enforced, or that any prosecutions are minor and do not reach the level of reported judgments. Alternatively, cases may have been resolved in the Magistrates Court without being published.

Practitioners should be aware that the Act’s provisions have not been authoritatively interpreted by higher courts. The reverse onus clause, the definition of “enclosed lands”, and the interaction with natural features have not been tested in a superior court under the ACT regime. Some historical cases from the pre‑1989 Commonwealth era may exist, but the source does not provide them. The absence of litigation does not mean the Act is ineffective; it may simply mean that the low penalty discourages appeals or that disputes settle.

Given the Act’s length of operation, a cautious lawyer might expect that some principles have been assumed by the legal community, but without a reported decision, those assumptions are not binding. For example, it is unclear whether a court would imply consent for public access to fenced government land, or whether the Act would apply to a fenced construction site that is open to the public during certain hours. Litigation could arise in the future if the Act is used more aggressively.

The source also indicates that the Act was amended several times by “Statute Law Amendment” Acts, which typically make minor corrections and do not reflect any judicial interpretation. This pattern is consistent with the Act being a minor, rarely‑litigated piece of legislation.

Several aspects of the Act are likely to catch practitioners and citizens off guard.

First, the reverse onus for lawful excuse (section 4(1)). The defendant bears the legal burden of proving that they had lawful excuse - including consent - on the balance of probabilities. This is a significant departure from the usual criminal standard. A person charged with unlawful entry cannot simply remain silent and rely on the prosecution to prove a lack of consent; they must lead evidence. If they fail, they may be convicted even if the prosecution’s case is weak. This is a trap for those who assume the prosecution must prove every element.

Second, the inclusion of negligence in the gate offence (section 5(1) and (2)). A person can be convicted for accidentally leaving a gate open. There is no requirement of intention. This means that a courier who passes through a gate and neglects to close it properly because they are in a hurry can be criminally liable. The penalty is not large, but a criminal conviction can have collateral consequences (e.g., affecting visas, professional registration, or security clearances).

Third, the definition of “enclosed lands” includes lands partly bounded by natural features. A person may not realise that a river or cliff line legally marks the boundary of enclosed land. Walking along a riverbank in a private rural property could be an offence if the property is enclosed by that river. The onus would be on the entrant to prove they had consent.

Fourth, the landholder’s power to demand name and address (section 6) is not limited to persons who are actually committing an offence. The landholder only needs reasonable grounds to believe an offence is being committed. If the belief is reasonable but mistaken, the demand is still valid, and the person must comply or face a penalty. This creates a risk for innocent persons who are just passing through.

Fifth, the goat destruction provision (section 7) is very specific. It only applies to goats, not to other livestock or domestic animals. It only applies to goats that are not legibly branded or collared with the owner’s name and address. If a goat is branded, the landholder cannot destroy it. The Act does not require the landholder to attempt to return the goat or to notify anyone; they may destroy it immediately. This could lead to disputes and potentially civil claims if the owner can prove the goat was marked.

Sixth, the Act does not require the landholder to post any signs or warnings. A person unfamiliar with the area may walk through a fenced paddock thinking it is public land, unaware that it is enclosed private land. The Act does not give them any defence of mistake; the only defence is lawful excuse, which they would have to prove.

Seventh, the Act applies to “any lands, whether public or private”. This means that enclosed public land such as a fenced government building, a locked public garden, or a fenced nature reserve can be the subject of an offence. A person who enters such land without authority - even if they are a taxpayer - may be liable.

Eighth, the absence of any mention of emergency services, utility workers, or other statutory entry rights. While a police officer or firefighter may have a lawful excuse under other legislation (e.g., emergency powers), they must still prove that excuse if charged. Landholders could potentially be obstructive by demanding name and address, though that would be risky.

Ninth, the Act uses the term “slip panel” without definition. This is an historical term for a removable section of fence. The meaning may not be clear to modern readers.

Tenth, the Act does not define “consent”. It is left to the common law. Consent may be implied in some circumstances, such as a person walking through an open unmarked gate to reach someone’s front door. But the line is uncertain. Practitioners need to assess the facts carefully.

Compliance with the Act is straightforward in theory but can be ambiguous in practice.

For a person entering any land that might be enclosed, the safest strategy is to obtain express permission from the owner, occupier, or person in charge before crossing any fence, wall, or natural boundary. If permission is given, note the details: the name of the person giving permission, the date, and the scope (e.g., “you may enter on 15 March 2025 to inspect the fence”). If the land is clearly open to the public, such as a shopping centre with an invitation to enter, consent may be implied, but the entrant should be mindful of any notice that restricts access (e.g., “no trespassing” signs). If there is any doubt, seek permission.

When entering enclosed land through a gate, ensure the gate is closed and secured after passing. If the gate was open when you arrived, closing it may be unnecessary but still advisable to avoid confusion. The safest practice is to close every gate you encounter, whether it was open or closed, unless you have a specific instruction to leave it open.

If an owner, occupier, or person in charge demands your full name and home address, provide that information without argument. The demand must be based on a reasonable belief that you are committing an offence, but you are not in a position to judge that at the time. Failure to comply is a separate offence. If you believe the demand is unwarranted, you can later dispute the original allegation in court; do not risk a penalty by refusing.

For persons driving stock on a road lawfully enclosed with land, the drover exception provides a defence. Ensure that you are actually on the road (as defined) and that the entry onto the surrounding land is only to prevent straying or regain control of stock. Do not stray beyond what is necessary.

Landholders should be cautious when using the power to demand identification. Ensure there are objective grounds for believing that the person is committing an offence - not just that they are on the land. For example, seeing someone walking through a fenced paddock without apparent permission would likely give reasonable grounds. However, a person who appears to be a delivery driver with a parcel may not. If in doubt, ask politely first.

When dealing with trespassing goats, check whether the goat is legibly branded or has a collar with an engraved name and address. If it does, you cannot destroy it; you should attempt to return it to its owner. If it is unmarked, you may destroy it, but do so humanely and in accordance with animal welfare laws. Disposal of the carcass may also be regulated.

Landholders may wish to install clear signage to indicate that the land is enclosed and that entry requires permission. While not required by the Act, signs can help establish that any entrant should have known they were on enclosed lands and that they did not have implied consent. This may reduce the burden of proving lawful excuse if a prosecution is brought.

Businesses that operate on enclosed land should train employees on these requirements. For example, delivery drivers should be instructed to obtain permission before entering, to close gates, and to comply with requests for identification. Failure to do so could result in fines for the driver and potential liability for the company as the employer, although the Act does not specifically create vicarious liability.

Legal practitioners advising clients should note the reverse onus and the possibility that a person could be convicted for accidental gate‑leaving or for failing to give a name. Advise clients to always comply with a demand for name and address, and to report any unreasonable demand to the authorities separately. For clients charged with an offence, the key will be gathering evidence of lawful excuse - such as a photo of a sign that suggests public access, or testimony from the landholder about prior permission.
