#### 54 Guarantees and security deposits relating to compliance with obligations of accredited case managers Possible condition of accreditation (1) A condition of an entity’s accreditation under the accreditation scheme may relate to the giving of: (a) one or more guarantees; or (b) one or more security deposits; in respect of compliance by the entity with the entity’s obligations under, or arising out of, this Act. Examples of cases where guarantees or security deposits could be given (2) The following are examples of cases where a guarantee or security deposit might be given: (a) each of the directors of a company give ESRA a guarantee that the company will pay any case management debts (within the meaning of section 170) owed by the company; (b) a holding company gives ESRA a guarantee that a subsidiary of the holding company will pay any case management debts (within the meaning of section 170) owed by the subsidiary; (c) an entity gives ESRA a security deposit in respect of compliance by the entity with the entity’s obligations to pay any case management debts (within the meaning of section 170). This section does not limit accreditation scheme (3) This section does not, by implication, limit the generality of section 50 (which deals with conditions under the accreditation scheme).
