#### 120 Preliminary inquiries
If a complaint has been made, or purportedly made, to ESRA under section 118, ESRA may make inquiries of the respondent for the purposes of determining:
(a) whether ESRA has power to investigate the matter to which the complaint relates; or
(b) whether ESRA should, in its discretion, investigate the matter.
