Tasmania regulation
These regulations narrow the Electronic Transactions Act by excluding certain matters from the Act’s electronic-execution and delivery rules. Specifically, they mean wills and codicils, instruments appointing enduring guardians or attorneys, and transactions that must be effected by personal service are not covered by the Act’s electronic provisions. This affects people making or witnessing those instruments, lawyers and guardianship/power-of-attorney processes by preserving pre-existing non-electronic formalities (see regs 4–5).
