28 Code requirements and compliance

(1) A code may—

(a) specify—

(i) the amount assessed by the Minister as the estimated cost to a relevant person of efficiently complying with the code, or

(ii) a methodology by which the cost of efficiently complying with the code may be assessed by the Minister, and

(b) specify arrangements for the payment to the relevant person of—

(i) an amount equivalent to the costs assessed under paragraph (a), or

(ii) if the relevant person disputes the assessment under paragraph (a)—the costs determined on a re-assessment under section 29, and

(c) specify circumstances in which a relevant person ceases to be eligible to receive a payment.

(2) A code may require that—

(a) particular services of relevant persons be provided to particular classes of persons—

(i) free of charge, or

(ii) at specified charges, or

(iii) subject to specified discounts or rebates, and

(b) particular classes of customers be—

(i) supplied with electricity at discounted charges, or

(ii) given rebates on the supply of electricity, and

(c) a retailer or exempt person establish and maintain facilities to ensure Government payments given for the supply of electricity at discounted charges are applied in accordance with the code, and

(d) a retailer or exempt person establish and maintain trust accounts in which Government payments given for the supply of electricity at discounted charges must be held before application in accordance with the code, and

(e) a relevant person give the Minister periodic reports about compliance with the code, and

(f) a relevant person establish and maintain accounting procedures to enable the preparation of reports.

(3) It is a condition of a distributor’s licence that the distributor must take the action required by a code applying to the distributor.
