#### 36 Improper creation of energy savings certificates 36 Improper creation of energy savings certificates > > (1) A person must not create or purport to create an energy savings certificate in contravention of this Act, the regulations or the scheme rules (including any conditions of accreditation imposed by or under this Act). > > > > Maximum penalty—2,000 penalty units. > > > (2) For avoidance of doubt, a person may be found guilty of an offence against this clause whether or not the certificate concerned is registered in the register of energy savings certificates kept under this Part.
