#### 202 Double jeopardy 202 Double jeopardy > > (1) A scheme entity may not issue a civil penalty order to a person if— > > > > > (a) another civil penalty order has been issued to a person for the contravention, or > > > > > (b) the person has been found guilty, whether a conviction is recorded or not, of an offence under this Act or the regulations for the contravention. > > > (2) If criminal proceedings are taken against a person for a contravention after the person pays the monetary penalty imposed by a civil penalty order, a court that finds the person guilty of an offence must discount any penalty imposed by the civil penalty amount paid by the person.
