Electricity Safety (Cathodic Protection) Regulations 2019

The Regulations rely on a small cluster of technical and legal definitions to structure duties and regulatory thresholds. Regulation 5 imports four specific Australian Standards by name and reference: AS 2832.1 (pipes and cables), AS 2832.2 (compact buried structures), AS 2832.3 (fixed immersed structures) and AS 2832.5 (steel in concrete structures). These Standards are the primary operational benchmarks that owners must follow unless Energy Safe Victoria determines a modified application (reg 16(1), (4)-(6); Explanatory Details table).

A “prescribed system” is central. Regulation 6(1) designates as prescribed either systems that use one or more galvanic anodes with a total output of more than 250 milliamperes connected at a single point to a structure, or systems that use impressed current connected at a single point. Regulation 6(2) excludes certain narrow categories: systems designed to protect internal surfaces where current is isolated from the external environment, marine vessels not permanently moored, and fixed offshore structures not electrically connected to land above sea level. Regulation 6(3) additionally treats systems that use electrolysis drainage bonds and associated apparatus as prescribed mitigation systems.

The instrument also uses two numeric thresholds repeatedly. The 250 milliampere threshold (reg 6(1)(a)) separates lower-output galvanic systems from higher-output systems for the purpose of prescription. The 2 ampere threshold appears in transitional and registration-duration rules, such that systems with a total output greater than 2 amperes have a 10-year registration term and specific re-registration procedures (reg 7(1), reg 10(2)(a), reg 15). These thresholds drive fee bands in Schedule 1, which lists registration fees in fee units for three bands: up to 250 mA, over 250 mA and up to 2 A, and over 2 A.

Other operational concepts include “stray current”, defined as current flowing through paths other than an intended circuit (reg 5), and “electrolysis drainage bond”, which is the path by which stray current from railway operation returns from an underground or underwater metallic structure to its source (reg 5). The register concept is important: Energy Safe Victoria must maintain a public register of certificates that includes owner details, system location and type, approved maximum operating current and any modification terms imposed by the regulator (reg 12).

The Regulations place explicit obligations on the owner of a cathodic protection system, and consequential duties on operators where the operator is not the owner. Regulation 8(1) makes it the owner’s responsibility to apply for registration where the owner “intends to operate that system, or intends to allow that system to be operated”. The application form must identify the owner and the operator, with ABN and ACN where applicable, and state the proposed maximum operating current (reg 8(2)(b)-(d)). Energy Safe Victoria is the decision maker for registration, modification of standards, exemptions and enforcement (see regs 9, 10, 11, 16, 18(3)-(6), 14).

Third parties whose metallic structures are affected or likely to be affected have procedural rights and de facto duties. The application must be accompanied by a report of consultations carried out with owners of metallic structures likely to be affected, including names, contact details, consultation dates and known objections (reg 8(2)(e)(iii)). After registration, persons “whose metallic structures are affected or likely to be affected” have a right to inspect annual operating current records prepared under reg 19(2). That creates a direct informational connection between owners of nearby metallic assets and the registered system owner.

Suppliers of cathodic protection equipment, designers and contractors will be affected in practice because the Standards (AS 2832 parts) are the operative technical benchmark for installation and operation, and Energy Safe Victoria can demand testing or modifications under reg 11. Rail operators are implicitly engaged by the definition of electrolysis drainage bond and the stray current concerns given in reg 1(d) and reg 5, as the Regulations aim to prevent damage to other metallic structures caused by stray currents.

Finally, the State regulator pays the administrative costs of maintaining the register, assessing applications and exercising discretion, yet it can recover fees from applicants through Schedule 1. The wider legal environment is affected because the Regulations interact with the Electricity Safety Act 1998 (authority and offence definitions), the Monetary Units Act 2004 for fee calculations, and the Sentencing Act 1991 for penalty unit valuation (Explanatory Details).

Duties flow primarily to the owner of a cathodic protection system. The owner must apply to Energy Safe Victoria to register any system the owner intends to operate or permit to be operated before operation (reg 8(1)). The application must be in the form approved by Energy Safe Victoria and include owner and operator identification, the proposed maximum operating current, a map locating the system and nearby metallic structures, detailed drawings and a report documenting consultations with owners of potentially affected metallic structures, together with the registration fee (reg 8(2)(a)-(e)). Energy Safe Victoria may ask for additional information necessary to determine registration (reg 9).

If Energy Safe Victoria is satisfied, it may register the system and grant a certificate; registration for systems over 2 amperes is time-limited to 10 years unless withdrawn earlier (reg 10(1)-(2)). The owner must supply details of a change in name, address or ownership to Energy Safe Victoria within 20 business days after the change (reg 13(1)). The regulator may grant a fresh certificate to a new owner upon notification of a change in ownership (reg 13(2)). Energy Safe Victoria may withdraw registration at the owner’s request, or if a person fails to comply with directions given under s 96 of the Act, provided the regulator gives 10 business days’ written notice before withdrawal in that enforcement case (reg 14).

On operation, owners must run systems in accordance with the relevant Cathodic Protection Standard identified in reg 16(1), or a modified application of that Standard where Energy Safe Victoria has made a determination under reg 16(4). Owners may apply in writing for modifications to the Standard to apply to their system, and must set out the terms of the proposed modification (reg 16(2)-(3)). Determinations and modification terms must be given to the applicant and entered into the register (reg 16(5)-(6); reg 12(2)(iv)).

Specific operational duties include: giving Energy Safe Victoria at least 5 business days’ notice before commencing operation of impressed-current systems (reg 17); making impressed-current systems capable of having their power supply interrupted for testing, for example by a time switch (reg 18(1)); making galvanic-anode circuits readily disconnectable for test purposes unless an exemption is granted (reg 18(2)-(7)); conducting and recording an annual inspection of operating current (reg 19(1)); keeping such records available for inspection by Energy Safe Victoria and persons whose metallic structures are affected or likely to be affected (reg 19(2)); and notifying the regulator within statutory timeframes of any change in operation or removal of the system (reg 20(1)-(2)). Owners may apply for exemptions from certain testing disconnect requirements and Energy Safe Victoria may grant exemptions with conditions (reg 18(3)-(6)).

Rights created by the Regulations include the owner’s right to seek modifications or exemptions and to be given written terms of a determination (reg 16(2)-(5); reg 18(3)-(6)). Persons whose metallic structures may be affected have the right to inspect annual operating current records (reg 19(2)). Energy Safe Victoria holds broad administrative discretion to refuse or condition registration where it reasonably believes the system may change the electrical potential of other metallic structures, and to require testing or modifications before permitting registration (reg 11).

The Regulations identify specific contraventions that are “prescribed provisions” for the purposes of the Act’s infringement-notice framework (reg 21). The listed provisions are reg 13(1) (change of name, address or ownership notification), reg 17 (notice before commencing operation of impressed-current systems), reg 18(1), 18(2) and 18(7) (provisions about testing and disconnection or exemption conditions), reg 19(1) and 19(2) (annual inspection and record availability), and reg 20(1) and 20(2) (notification of change in operation or removal). Those provisions are therefore available grounds for infringement notices under the Act (reg 21).

The Regulations attach penalty units to several duties. The specific annotations in the text show that reg 13(1) carries a penalty of 10 penalty units, while reg 17, reg 18(1) and (2) and reg 18(7), reg 19(1) and (2), and reg 20(1) and (2) each carry penalties of 20 penalty units where indicated beside the provision. The Explanatory Details provide the monetary value of a penalty unit for the financial year commencing 1 July 2019 as $165.22, and indicate penalties may be rounded to the nearest dollar. That produces, for that year, approximate monetary equivalents of $1,652 for 10 penalty units and $3,304 for 20 penalty units after rounding to the nearest dollar. These dollar figures change in future financial years because the Treasurer fixes fee and penalty unit values under the Monetary Units Act 2004 and the Sentencing Act 1991, and the Regulations explicitly rely on those Acts for fee and penalty calculation (Explanatory Details).

Beyond infringement notices and monetary penalties, Energy Safe Victoria has direct regulatory levers. The regulator may refuse registration pending completion of required testing or if it reasonably believes that the proposed system may alter the electrical potential of other metallic structures (reg 11). Energy Safe Victoria may require modification of a system before registration is granted (reg 11(2)). The regulator can withdraw registration at the owner’s request or if a person fails to comply with directions given under s 96 of the Electricity Safety Act 1998, providing 10 business days written notice before withdrawal in that enforcement circumstance (reg 14). Registration also has a temporal limit for systems over 2 amperes, creating a re-registration compliance step and potential enforcement point (reg 10(2)(a), reg 15).

Record access is an enforcement and transparency mechanism. Owners must make annual inspection records available to Energy Safe Victoria and to affected third parties (reg 19(2)), which allows detection of non-compliance through audit or complaint. The combined suite of infringement notice provisions, monetary penalties and registration-withdrawal powers concentrates enforcement control with Energy Safe Victoria, using both administrative decisions and penalty regimes to secure compliance.

The Regulations are an instrument made under the Electricity Safety Act 1998, specifically under sections 155 and 157, which provide the authorising power for subordinate rules of this type (reg 2). They directly reference provisions of the Act in operational and enforcement provisions: for example, reg 16 operates for the purposes of section 93(2) of the Act, and reg 14(2) links withdrawal of registration to non‑compliance with directions under s 96 of the Act. Regulation 21 explicitly cross-references the Act’s definition of “prescribed offence” in s 140A for the purpose of listing prescribed provisions to which infringement notices may apply.

The Explanatory Details make the Regulations’ dependence on other monetary and sentencing statutes explicit. Fees are expressed in fee units and are to be calculated under the Monetary Units Act 2004, including the Treasurer’s annual setting of the fee unit value and the prescribed rounding conventions (Explanatory Details, Fee Units). Penalties are expressed in penalty units and are to be calculated in accordance with s 110 of the Sentencing Act 1991, with the explanatory note supplying the applicable value for the 2019 financial year and the rounding rule (Explanatory Details, Penalty Units). Those linked statutes mean that fee and penalty dollar amounts fluctuate automatically with changes in fee and penalty unit values fixed by separate Acts or Treasury instruments.

The Regulations also adopt or incorporate technical standards through the device of applied matter. Regulation 5 defines “Cathodic Protection Standard 1, 2, 3, 5” by reference to AS 2832 parts, and the Explanatory Details contain a Table of Applied, Adopted or Incorporated Matter that identifies the exact Standards and publication dates. That incorporation links compliance obligations to an external body of technical rules published by Standards Australia; those Standards sit outside the Statutory Rule text but are made operative by reference. Energy Safe Victoria also retains the discretion to modify the application of those Standards to particular systems (reg 16(4)-(6)), which creates a two-tiered interaction between statutory prescription and administrative discretion.

The Regulations also sit against the Subordinate Legislation Act 1994 by virtue of the Endnote. The instrument will sunset ten years after the making date unless saved or re-made in accordance with the Subordinate Legislation Act 1994 (Endnote 1). That creates an administrative horizon for legislative review and potential revision.

Finally, the Regulations repeal and replace the earlier 2009 subordinate instruments (reg 4 and reg 7 references), so any transitional rights or obligations from the old regime are expressly managed by reg 7, which preserves registration for systems registered under the old rules subject to the transitional timing rules.

The version provided records no amendments since enactment. The Explanatory Material contains a Table of Amendments, which states there are no amendments made to the Electricity Safety (Cathodic Protection) Regulations 2019 by statutory rules, subordinate instruments or Acts. The Endnotes supply making and commencement details: the Regulations were made on 26 November 2019 and entered into force on 29 November 2019 (Endnote 1, and reg 3). Regulation 4 explicitly revokes the Electricity Safety (Cathodic Protection) Regulations 2009 (and reg 7(2) defines “old regulations” to include the Electricity Safety (Stray Current Corrosion) Regulations 2009), so the 2019 instrument replaced the prior 2009 instruments.

The Explanatory Details also record tabled material such as the incorporation table for the AS 2832 Standards and provide the monetary bases for fee and penalty calculations for the 2019 financial year: a fee unit value of $14.81 for 2019-20 and a penalty unit value of $165.22 for 2019-20, together with the mandatory rounding prescriptions (Explanatory Details). The Endnotes also state the Regulations will sunset ten years after the day of making, which is 26 November 2029 under the Subordinate Legislation Act 1994 (Endnote 1).

There are no entries in the published Table of Amendments showing later variations, and the Explanatory Notes list no amendments not in operation. If the Regulations are to change, amendments will appear as statutory rules under the relevant subordinate instrument processes, and the incorporated Standards may be updated by Standards Australia; the Regulations already permit the referenced Standards to be “published or amended from time to time” in their definitions (reg 5).

The text provided contains no litigation history. The instrument and its Endnotes do not name any cases, judicial decisions or tribunal rulings arising under these Regulations. The Regulations do, however, refer to enforcement powers and mechanisms in the Electricity Safety Act 1998 that could give rise to administrative or civil proceedings in future, such as directions under s 96 of the Act and the listing of prescribed provisions for infringement notices under s 140A (reg 14(2); reg 21). But the Regulations themselves record no past litigation or appellate authority.

Because the operative enforcement powers are delegated to Energy Safe Victoria and because the Act supplies the broader legal framework, any litigation that might follow would depend on how Energy Safe Victoria exercises discretion under regs 9, 10, 11, 14, 16 and 18, or on prosecutions or administrative review arising from alleged breaches of the prescribed provisions. The absence of recorded litigation in the instrument means there is no statutory record here to draw on for precedent or interpretation of the Regulations’ provisions.

Thresholds matter. The instrument uses two numeric cut-offs that change obligations. A total output over 250 milliamperes for galvanic-anode systems is the line for prescription (reg 6(1)(a)). Owners may not appreciate that a seemingly low-output galvanic system crosses the “prescribed” threshold at 251 mA and thereby triggers registration and operational duties. Separately, a total output over 2 amperes alters the registration rhythm: existing systems over 2 A registered under the old rules are taken to be registered under these Regulations only until the earlier of 10 years after registration or withdrawal, and newly registered systems over 2 A have registration that ceases 10 years after grant unless renewed (reg 7(1); reg 10(2)(a)). That produces a discrete administrative re-registration event for higher-output systems.

Timing obligations are specific and short. Owners of impressed-current systems must give Energy Safe Victoria at least 5 business days’ notice before commencing operation (reg 17). Owners must notify the regulator of changes to operation or removal within 4 business days and follow up with written notice within 10 business days (reg 20(1)-(2)). Change of ownership or address must be notified within 20 business days (reg 13(1)). Failure to meet these short windows attracts infringement mechanisms and penalty units (reg 21 and the penalties annotated in regs 13, 17, 18, 19 and 20).

Testing and disconnection requirements can be operationally burdensome. Impressed-current systems must be capable of having their power supply interrupted for testing, for example by fitting a time switch (reg 18(1)). Galvanic anode circuits must be readily disconnectable unless an exemption is granted (reg 18(2)-(5)). The exemption route exists, but it requires a written application and justification, and any exemption may be conditional (reg 18(3)-(6)). Owners relying on the exemption should expect conditions and the ongoing obligation to comply with them (reg 18(7)).

Consultation is a documented duty. The registration application requires a report detailing consultations with owners of metallic structures likely to be affected, including contact details, dates and any objections (reg 8(2)(e)(iii)). That is a concrete pre-registration cost and a potential source of objections which Energy Safe Victoria may treat as relevant under its power to refuse registration where it reasonably believes other structures may have their electrical potential changed (reg 11(1)(b)).

Discretion from Energy Safe Victoria creates variability. The regulator can require additional testing or modifications before registration (reg 11), determine modified applications of the Standards to individual systems (reg 16(4)-(6)), grant exemptions with conditions (reg 18(5)-(6)) and withdraw registration for failure to comply with directions under the Act (reg 14(2)). Practitioners should budget for regulatory negotiation, potential conditions and the need to secure written determinations to lock in a modified compliance position (reg 16(5)).

Fees, penalties and annual adjustments matter. Fees in Schedule 1 are expressed in fee units, and the fee unit value is set annually by the Treasurer under the Monetary Units Act 2004 (Explanatory Details). Penalty units are likewise set annually and may be rounded as prescribed (Explanatory Details). That means dollar amounts for registration and fines change over time; the Schedule gives fee-unit quantities but not fixed dollar sums.

Public register and privacy. Entry of modification terms into the register is mandatory (reg 16(6) and reg 12(2)(iv)). If an owner obtains a bespoke modification from Energy Safe Victoria, the terms become register particulars and thus publicly available. Owners should consider confidentiality or commercial sensitivity when negotiating modification terms.

Sunset planning. The Regulations will sunset ten years after making, that is on or about 26 November 2029 unless otherwise extended (Endnote 1). Large capital investments timed with registration cycles, especially for systems over 2 amperes, should consider the legislative sunset as an administrative risk.

Step 1: confirm whether the system is “prescribed”. Check regulation 6. If the system uses one or more galvanic anodes with total output greater than 250 mA connected at a single point, or impressed current connected at a single point, the system is prescribed and registration is required before operation (reg 6(1); reg 8(1)). If the system falls into the limited exclusions in reg 6(2), registration may not be required.

Step 2: prepare the registration application. Use the Energy Safe Victoria approved form and assemble the required content: owner and operator details with ABN/ACN where applicable; proposed maximum operating current; a map showing the protection system and all metallic structures likely to be affected; detailed drawings of the proposed system; a consultation report listing owners contacted, dates and any objections; and the relevant registration fee in Schedule 1 (reg 8(2)(a)-(e); Schedule 1). Expect Energy Safe Victoria to request further information under reg 9 if necessary.

Step 3: consult and document. The consultation report is mandatory and must include names, addresses and telephone numbers of consulted owners, the dates of consultation and any known objections (reg 8(2)(e)(iii)). Keep contemporaneous records of consultations to avoid application rejection on procedural grounds or later disagreement about consultation content.

Step 4: plan operation to meet the Standards or apply for modification. Operate the system in accordance with the relevant AS 2832 Standard applicable to the structure type (reg 16(1)). If a Standard should apply in a modified way, lodge a written application setting out the terms sought; Energy Safe Victoria may determine a modified application and will provide written terms which must be entered in the register (reg 16(2)-(6); reg 12(2)(iv)). Keep copies of any determination.

Step 5: make testing arrangements. For impressed-current systems, ensure the power supply can be interrupted for test purposes, for example by fitting a time switch (reg 18(1)). For galvanic-anode systems, make circuits readily disconnectable for test purposes, unless an exemption is sought and granted (reg 18(2)-(6)). If applying for an exemption, do so in writing and state reasons; an exemption may carry conditions which must be complied with (reg 18(3)-(7)).

Step 6: give pre‑operation notice and manage notifications. If the system uses impressed current, give at least 5 business days’ notice to Energy Safe Victoria before commencing operation (reg 17). If the owner changes the operation or becomes aware of a change, notify Energy Safe Victoria within 4 business days and provide written notice within 10 business days (reg 20(1)). Do the same for removal of the system (reg 20(2)). Update name, address or ownership within 20 business days (reg 13(1)).

Step 7: audit and record keeping. Perform an annual inspection and record operating current, and keep that record available for Energy Safe Victoria and for persons whose metallic structures are affected or likely to be affected (reg 19(1)-(2)). Retain copies of inspection records and make them available on reasonable request.

Step 8: manage registration lifecycle and fees. Know which fee band applies from Schedule 1 and be aware that the monetary value of fee units will change annually (Explanatory Details). For systems with output over 2 A, plan for re-registration before the 10‑year end of the registration term, and lodge an application for further registration in the approved form with the necessary documentation and fee (reg 15(1)-(3)).

Step 9: prepare for regulator conditions and enforcement. Energy Safe Victoria may refuse registration pending satisfactory testing, or if it believes other metallic structures may be affected, and may require modification to the system before registration is granted (reg 11). Keep records of all communications and determinations, and promptly comply with any directions given under the Electricity Safety Act 1998, noting that failure to comply with section 96 directions can lead to withdrawal of registration (reg 14(2)).

Step 10: budget for penalties and administrative costs. Be aware of the prescribed infringement provisions (reg 21) and the penalty unit annotations attached to the relevant regulations. For the 2019 financial year the Explanatory Details give a fee unit value of $14.81 and a penalty unit value of $165.22, producing approximate dollar equivalents for the Schedule 1 fees and for common penalties as set out in the Explanatory Details, subject to annual adjustment by the Treasurer.

Following these steps aligns operational practice with the specific text of the Regulations, secures the necessary administrative approvals and reduces the risk of infringement notices or registration withdrawal. Keep copies of applications, consultation reports, test records, exemption decisions and register certificates for audit and for any third-party inspection requests under the Regulations.
