Electricity Industry (Pilbara Networks) Regulations 2021

The regulations revolve around a small set of interlocking concepts that structure governance, liability and economic allocation in the Pilbara electricity arrangements.

• Pilbara networks rules and initial rule‑making. The regulations create a delegated rulebook specific to Pilbara networks. The Minister must make the initial Pilbara networks rules (reg 6). The rules are to address operation, management, security and reliability of interconnected Pilbara systems (reg 7(1)) and, subject to specified limits, may cover non‑interconnected covered Pilbara networks and other matters including metering, confidentiality, technical rules, governance, dispute resolution and allocation of costs (regs 7-8). Amending rules can be made, but Ministerial approval is required for rules that affect the Coordinator's functions or specified governance matters (reg 9(5)).

• Publication and accessibility. The Coordinator must publish the Pilbara networks rules as in force on a website (reg 13). Initial rules and amending rules made by the Minister must be notified in the Gazette and published on the Coordinator’s website; they must be tabled in both Houses of Parliament within 10 sitting days (regs 10-11, 12).

• Reviewable decisions and Board review. The regulations identify a set of rule‑made decisions as reviewable decisions under s 120Z(1) of the Act and provide a Board review process (reg 13A and Schedule 1). Applicants have 28 days to apply for review; the Board must determine within 120 days subject to limited extensions; procedural reviews are limited to whether required procedures were followed and must be conducted by a legal practitioner (regs 13B-13F).

• Pilbara ISO designation and reporting. Pilbara ISOCo Limited ACN 650 785 783 is expressly named as the Pilbara ISO for Part 8A purposes (reg 14). The Pilbara ISO must report in writing to the Minister or the Authority on certain networks if requested by the Coordinator or when it considers appropriate; it must prepare and publish information for certain networks in accordance with the Pilbara networks rules (reg 15). The rules may provide for further matters related to Pilbara ISO functions (reg 16).

• Competition authorisations. A temporary authorisation is provided for relevant events (arrangements, acts etc) done in the two years following a defined commencement day where those events are done by authorised persons or participants in carrying out functions under the Access Code, rules, or instruments made under them. This gives those activities an authorisation for the purposes of the Competition and Consumer Act 2010 and the Competition Code, subject to certain Commonwealth authorisations (reg 16A).

• Costs and fee recovery. Empowered persons (the Authority, Coordinator and Pilbara ISO) must implement accounting to identify costs of functions under the rules, submit costs for approval and the Pilbara ISO must allocate approved costs between participants in accordance with the Pilbara networks rules. Cost recovery is by fees from Pilbara networks participants (reg 17).

• Registration requirement and enforcement. Certain high‑voltage activities connected to the North West Interconnected System Network are specified activities which require registration under the Pilbara networks rules. From 1 October 2021 a person must not engage in those activities unless registered or derogated/exempted; penalty $1 000 (regs 18-19).

• Immunities, exceptions and caps. The regulations define the scope and limits of immunities granted under s 120ZB and prescribe the types of civil liabilities excluded from immunity (notably liabilities for personal injury, payment obligations under notes or the rules, and liabilities between related bodies corporate), allow contractual modification of immunity among sophisticated parties subject to exceptions, exempt certain public participants from some immunity limits, and prescribe monetary caps applying during an initial cap period and generally (regs 20-31).

• Procedural and transitional powers. The Minister may order treatment of pre‑commencement matters and the Authority must maintain a website to publish information to participants. The Authority has prosecutorial functions for Pilbara offences (regs 32-34).

• Arbitrator and Board funding adjustments. The regulations amend existing arbitrator and Board funding rules so costs related to Pilbara matters may be separately fixed and recovered, including quarterly charges to the Regional Power Corporation where applicable (Part 9, regs 35-39 and inserted regs 7A and 7B).

Each of these concepts is implemented through specific regulatory text in the numbered regulations and cross‑references to the Electricity Industry Act 2004 (the Act), especially the Part 8A provisions referenced in the regulations (for example Act s 119 in reg 4 and Act s 120K in reg 7).

These regulations affect a concentrated set of market and public actors operating in the Pilbara region and parties that deal with them.

• Pilbara networks participants. The primary group affected are entities defined or operating as Pilbara networks participants under the Pilbara networks rules and the Pilbara Networks Access Code. These include Pilbara network service providers, registered network service providers, registered controllers, generators, storage operators and large consumers connected to high‑voltage connections on the North West Interconnected System Network. The regulations require registration for specific activities connected to the NWIS (regs 18-19) and make participants liable for fees to recover allocated costs (reg 17).

• Pilbara ISO and its delegates. Pilbara ISOCo Limited is designated as the Pilbara ISO (reg 14). The Pilbara ISO gains rule‑based functions, reporting obligations (reg 15), and potential capacity to make protocols and procedures as authorised by the Pilbara networks rules (reg 8(d)). The ISO is an empowered person required to implement accounting and submit costs for approval (reg 17(1)-(3)).

• The Coordinator of Energy. The Coordinator is given roles in publishing and maintaining rules on a website (reg 13), in requesting reports from the Pilbara ISO (reg 15(1)(a)), and may be assigned functions under the rules which attract ministerial approval requirements for rule amendments (reg 9(5)). The Coordinator must also maintain public availability of rules and notices (regs 10, 13).

• The Economic Regulation Authority (the Authority). The Authority is an empowered person under reg 17. It has prosecutorial functions for Pilbara offences and must maintain a website for participant information (regs 33-34). The Authority may be directed by the Board to provide assistance and reports in proceedings under the review regime (reg 13F(5)).

• The Minister and Parliament. The Minister must make the initial Pilbara networks rules (reg 6) and may make amending rules within specified periods (reg 9(6)-(7)). Ministerial orders can determine how pre‑commencement matters are treated under the Access Code and rules (reg 32). The Minister must approve certain amending rules that affect Coordinator functions or specified governance matters (reg 9(5)). Initial rules and amending rules made by the Minister must be gazetted and tabled in Parliament (regs 10-11).

• Generators, storage operators and large consumers. Entities operating generation, storage or large consumer works connected to high‑voltage points on the NWIS are explicitly captured as activities for which registration is required (reg 18(2)(b)-(d)). These entities must register, comply with metering and information obligations as specified in the rules, and may be subject to fees allocated under reg 17.

• Commercial counterparties and sophisticated parties. The regulations recognise a class of sophisticated parties (sophisticated party defined at reg 20) and permit contractual modification of immunities between such parties subject to specified limits (reg 24). Parties to high‑voltage contracts and related bodies corporate are explicitly engaged in the liability and immunity provisions.

• Dispute resolution participants and litigants. Persons adversely affected by reviewable decisions specified in Schedule 1 may apply to the Board for review; parties to Board proceedings in Pilbara matters will be affected by the Board’s power to fix, allocate and recover costs under the amended Arbitrator and Board Funding Regulations (Part 9, regs 7A and 7B).

• The Regional Power Corporation. The amended charging regime in reg 7B places a quarterly payment obligation on the Regional Power Corporation where the arbitrator fixes an amount representing the Board’s costs in relation to Pilbara matters generally (Part 9, reg 7B).

Who pays. The regulations make clear that Pilbara networks participants are the group that pays for costs identified under reg 17 by way of fees. The Board may allocate hearing costs for Pilbara matters to parties in those proceedings under reg 7A, and the Regional Power Corporation may be charged quarterly amounts under reg 7B.

Who decides. Rule content is initiated by the Minister for the initial rules but the Pilbara networks rules themselves may provide for who makes amending rules, subject to Ministerial approval for certain matters (reg 9). The Board has review and cost allocation powers (regs 13B, 7A). The Pilbara ISO, Coordinator and Authority have functions and administrative roles assigned through rules and regulations.

The regulations create statutory duties, procedural rights and administrative powers. Below are the principal duties and rights with relevant provisions.

Duties

• Ministerial duties. The Minister must make the initial Pilbara networks rules (reg 6). The Minister may also make amending rules during specified periods and must approve amending rules that affect the Coordinator’s functions or specified governance matters (reg 9(5)-(7)). The Minister may determine treatment of pre‑commencement matters by order in the Gazette (reg 32).

• Coordinator duties. The Coordinator must publish a copy of the Pilbara networks rules as in force on a website maintained by the Coordinator (reg 13). The Coordinator can request written reports from Pilbara ISO on certain networks (reg 15(1)(a)).

• Pilbara ISO duties. Pilbara ISOCo Limited is the Pilbara ISO for Part 8A purposes (reg 14). It must report to the Minister or Authority when requested by the Coordinator or when it considers appropriate in relation to non‑covered networks (reg 15(1)). It must also prepare and publish information as required by the rules (reg 15(2)). The Pilbara ISO must implement accounting arrangements to identify its costs and submit identified costs for approval as specified in the rules (reg 17(2)-(3)).

• Empowered person accounting and cost recovery. Each empowered person (the Authority, Coordinator and Pilbara ISO) must implement accounting arrangements to identify their costs in performing functions under the Pilbara networks rules and submit those costs for approval; the Pilbara ISO must then allocate approved costs between participants and recovery is by fees payable by participants (reg 17(1)-(4)).

• Registration duty for operators. From 1 October 2021, persons must not engage in specified activities (operating NWIS network, generating works, storage works, large consumer works connected to NWIS) unless registered in accordance with the Pilbara networks rules or the subject of a derogation or exemption under those rules (regs 18-19). Penalty $1 000 (reg 19).

• Reporting and cooperation duties. The Pilbara networks rules may impose obligations on Pilbara network service providers to provide information to and assist the Pilbara ISO in performing its functions (reg 7(3)(b)).

• Prosecution and enforcement functions. The Authority has the function to commence prosecutions for Pilbara offences and to authorise others to commence prosecutions (reg 34(2)-(3)).

Rights

• Right to Board review. Persons whose interests are adversely affected by a reviewable decision can apply to the Board for review (reg 13B(1)). The Board may affirm, set aside or vary decisions and may exercise the same powers as the original decision maker in relation to the subject matter (reg 13B(2) and (4)).

• Procedural protections in review. Applicants have 28 days to apply for review following notice of a decision; the Board must give written reasons if it refuses to review on the basis that the application is trivial or vexatious or if the applicant is not adversely affected (regs 13D(1), 13B(3)-(5)).

• Right to confidentiality in Board proceedings. The Board may, on application, conduct proceedings in private and may issue orders restricting publication of evidence or restricting disclosure of documents to parties where justified, taking as the default position that evidence should be available to all parties unless reasons support restriction (reg 13F(7)-(9)).

• Contractual allocation of immunity between sophisticated parties. Parties that are all sophisticated parties may agree in contract to limit the extent of immunity as between them, subject to specific exceptions, including that such contractual limits cannot affect immunity related to system management functions or the operation of reg 22 (reg 24).

• Competition authorisation protection. For a two year period following a defined commencement day, relevant events done by authorised persons in performance of functions under the Access Code, rules, or instruments made under them are authorised for the purposes of the Competition and Consumer Act 2010 and the Competition Code, subject to certain qualifications (reg 16A).

Administrative powers

• Board’s procedural powers and timing. The Board must make determinations on review within 120 days, with possible 30 day extensions for complexity or special circumstances; the Board may stay or vary operation of decisions to secure a fair hearing and determination (regs 13F(2)-(4), 13E(2)-(3)).

• Rule‑making delegations. The Pilbara networks rules may provide for the Minister or the Coordinator to make amending rules and may authorise the Pilbara ISO to make instruments establishing protocols and procedures related to its functions; rules may contain provisions about the effect and process of those instruments (reg 9(4), reg 8(d)-(e)).

• Board cost allocation and recovery. Under the amendments to the Arbitrator and Board Funding Regulations, the Board may fix costs for hearing Pilbara matters and allocate payment obligations among parties, and the Regional Power Corporation may be required to pay specified quarterly amounts (Part 9, regs 7A and 7B).

These duties and rights are implemented primarily by the Pilbara networks rules read with the regulatory prescriptions in the 2021 Regulations. Many operational details, including the content and procedures for registration, cost allocation methodology, fee structures and technical rules, are delegated to the Pilbara networks rules themselves (reg 7(3)-(4), reg 8).

The regulations set a limited set of express penalties and vest enforcement powers in the Authority and the Board while also constraining civil liability through immunities and caps.

Penalties

• Registration contravention. A person who engages in any of the activities specified in reg 18(2) without being registered under the Pilbara networks rules, or without a derogation or exemption, commits an offence with a monetary penalty of $1 000 (reg 19). The regulations do not specify additional criminal penalties in the text provided for other breaches of the regulations, but they define Pilbara offences and provide for prosecution powers (reg 34).

Enforcement powers and responsibilities

• Authority prosecution role. The Authority is explicitly assigned the function to commence a prosecution for a Pilbara offence and to authorise another person to commence such a prosecution (reg 34(2)-(3)). A person authorised by the Authority may commence a prosecution. This centralises prosecutorial initiation authority in a regulatory body rather than leaving it to private parties.

• Board enforcement of review outcomes. The Board may make orders in a review that affirm, set aside or vary decisions, with the effect that a Board determination has the same legal effect as if it were made by the original decision maker (reg 13B(2), (4)). The Board may also issue orders staying operation of a decision pending review if it considers it appropriate to secure the effectiveness of the hearing and determination (reg 13E(2)).

• Board cost recovery. Under the amendments in Part 9 the Board may fix amounts representing the cost and expenses of hearing Pilbara matters and allocate liability for payment among parties or require payment by the Regional Power Corporation for general costs fixed for the quarter. Unpaid amounts and interest are recoverable as a debt owing to the arbitrator (Part 9, regs 7A(1)-(6) and 7B(2)-(6)).

Limits on civil liability and immunities

• Statutory immunities. The Act grants certain immunities under s 120ZB and the regulations limit the scope of those immunities and prescribe exceptions. The regulations limit immunities expressly to civil monetary liabilities that are not liabilities arising from personal injury (reg 22), and to civil monetary liabilities that are not liabilities to pay amounts that are payment obligations arising under notes or the Pilbara networks rules (reg 23). They also allow sophisticated parties to agree contractual limits on immunity (reg 24), subject to constraints.

• Monetary caps. The regulations prescribe prescribed maximum amounts of civil monetary liability where immunity does not apply. During an initial cap period the maximum per entity per act or omission is $10 000 subject to a cap of $100 000 across related bodies corporate for the initial cap period (reg 29). Outside the initial cap period the maximum per entity per act is $100 000 with a 12 month related‑body corporate cap of $10 000 000 (reg 30). Officers and employees of entities have a nominal maximum liability of $1 to another entity for an act or omission (reg 31). These limits explicitly do not apply to liabilities for personal injury, liabilities between related bodies corporate, or liabilities incurred by officers or employees (regs 29(2), 30(2)).

Procedural constraints on enforcement

• Timeframes for review and extensions. An application for Board review must generally be made within 28 days after notice is given or published on the Coordinator website (reg 13D(1)-(2)). The Board must make a determination within 120 days, extendable by up to 30 days for complexity, with notice to the applicant of the extension and reasons (reg 13F(2)-(4)). The Board may extend an applicant’s time to apply for review by 14 days even after the time has elapsed (reg 13D(4)).

• Procedural review limitation. Where a decision is a listed procedural decision the Board is limited to assessing whether the decision maker followed the required procedure, and the Board must be constituted by a legal practitioner for such reviews (reg 13C(1)-(3)). If procedure was not followed, the Board sets aside the decision and remits it (reg 13C(3)(b)).

Publication, confidentiality and evidence

• Confidentiality orders in Board proceedings. The Board may order restrictions on publication of evidence or documents or restrict disclosure to parties where it is satisfied doing so is desirable because of confidentiality or other reasons related to proceedings. The Board must base its consideration on making evidence available to all parties but weigh reasons for restriction (reg 13F(8)-(9)).

• Summoning and compulsion protections. The Board may summon witnesses and determine allowances and expenses; persons may refuse to answer questions or produce documents where doing so might tend to incriminate them (reg 13F(6)-(10)).

Collectively, the enforcement architecture combines a limited criminal monetary penalty for unregistered operation, an administrative prosecution/authorisation model vested in the Authority, Board supervision and remedial powers for reviewable decisions, and statutory constraints on civil liability that narrow the scope of damages recoverable from participants and public bodies while providing specified caps and exceptions.

The regulations are constructed to operate within a broader legal architecture: they cross‑refer to the Electricity Industry Act 2004, the Pilbara Networks Access Code and the Pilbara networks rules, and they engage federal competition law and existing arbitrator and Board funding regulations. Key interaction points follow from the text.

Interaction with the Electricity Industry Act 2004

• Part 8A scaffolding. The regulations implement and give effect to Part 8A of the Electricity Industry Act 2004. They explicitly reference sections of the Act when listing matters to be included in the rules and when limiting immunities and liabilities. For example, reg 4 cites Act s 119 for matters to have regard to when performing functions under Part 8A; reg 7 cites Act s 120K as to matters the rules must deal with; and regs 21-31 operate to limit immunities under s 120ZC and prescribe maximum civil monetary liabilities under s 120ZD.

• Delegation and rule content. The Pilbara networks rules are made under the Act and the regulations set processes for the initial rule‑making and for amending rules while requiring Ministerial approval for rules that affect certain Coordinator functions or governance matters (reg 9(5)). Therefore these regulations operate as delegated law under the Act and as procedural constraints on further subordinate instruments.

Interaction with the Pilbara Networks Access Code and Pilbara networks rules

• Delegated content. Much of operational detail is deferred to the Pilbara networks rules and the Pilbara Networks Access Code. The regulations authorise the rules to address numerous operational and governance matters, including metering, confidentiality, technical rules, cost allocation and registration (regs 7-8). The rules themselves contain reviewable and procedural decision provisions, which the regulations link to Board review (Schedule 1).

• Publication and Gazettal. The regulations require Gazettal and publication of the initial Pilbara networks rules and any Ministerial amending rules, and require tabling before Parliament (regs 10-12). The Coordinator must publish the current rules on its website (reg 13).

Interaction with Commonwealth competition law

• Competition authorisations for a transitional period. Regulation 16A provides an express authorisation for relevant events done in a two year window by authorised persons or by persons in performance of functions under the Access Code or Pilbara networks rules, for the purposes of the Competition and Consumer Act 2010 (Cth) and the Competition Code. This creates a state‑level authorisation aimed at reducing the risk that compliance with the Pilbara rules would contravene federal competition prohibitions. It expressly does not authorise conduct that is already specified in an existing Commonwealth Part VII Division 1 authorisation (reg 16A(4)).

Interaction with the Competition Code and other State Acts

• Codified nexus. The regulations treat competition and procurement interactions by giving temporary cover for contraventions of federal competition law where those acts are performed under the state rules. That avoids a direct inconsistency but only for a limited period; after that period parties must rely on other Commonwealth or State authorisations or ensure compliance (reg 16A(2)-(3)).

Interaction with arbitrator and Board funding rules

• Amendments to funding regulations. Part 9 amends the Electricity Industry (Arbitrator and Board Funding) Regulations 2009 to create separate cost and charging mechanisms for Pilbara matters. The Board may fix costs for hearing and determining Pilbara matters and require parties to pay, and the arbitrator may issue a quarterly notice to the Regional Power Corporation for general Pilbara matter costs (Part 9, regs 7A and 7B). These amendments interact with the existing core funding scheme by excluding Pilbara hearing costs from the definition of core function costs and allowing separate recovery.

Interaction with corporation and contract law

• Contractual adjustment of immunity. The regulations permit parties that are sophisticated to contractually agree to limit the extent of immunity as between them (reg 24). That interacts with general principles of contract law and the Corporations Act in that it allows private allocation of risk among sophisticated commercial parties, but it is expressly constrained where it would attempt to affect immunity for system management functions or the operation of reg 22.

Interaction with evidence and enforcement rules

• Board procedures and privileges. The Board’s review and hearing procedures allow witnesses to refuse to answer or produce documents where doing so might tend to incriminate them (reg 13F(6)). That interacts with privilege and compulsion principles in criminal and civil procedure.

Interaction with workplace health and safety and personal injury law

• Immunities excluded for personal injury. The regulations explicitly exclude liabilities arising from personal injury from the operation of specified immunity limitations (regs 22, 29(2)(a), 30(2)(a)). That preserves the ability of individuals or estates to recover for personal injury in other legal regimes, such as workers compensation or tort law, notwithstanding Pilbara immunities for other types of civil monetary liability.

Taken together, the regulations form an integrated set of subordinate instruments that sit under the Electricity Industry Act 2004, rely on the content and operation of the Pilbara Networks Access Code and Pilbara networks rules for operational detail, provide a temporary federal competition law shield for certain activities, and amend funding rules for adjudicative processes to ensure costs of Pilbara matters can be recovered. The precise operational consequences will depend heavily on the content of the Pilbara networks rules and the Access Code, which are instruments the Minister must make and that the Coordinator must publish.

The compilation table and the amendments recorded in the text show a sequence of updates and insertions since the original 2021 regulations. The regulations have been amended multiple times, with certain key additions noted below. The text of the regulations contains incorporated amendments through to 2025.

• Initial instrument. Electricity Industry (Pilbara Networks) Regulations 2021, SL 2021/95, published 18 June 2021 and coming into force between 18-19 June 2021 (reg 2). That instrument established the Pilbara rules regime including registration, liabilities and the Pilbara ISO designation framework.

• 2022 amendment. Electricity Industry (Pilbara Networks) Amendment Regulations 2022, SL 2022/183, published 4 November 2022 and largely commencing 5 November 2022. That instrument inserted reg 16A (Competition authorisations) into the regulations (reg 16A inserted: SL 2022/183 r. 4).

• 2023 amendments. Energy Regulations Amendment Regulations 2023 Pt. 2, SL 2023/32, published 21 April 2023 and with certain parts commencing 1 October 2023. Those amendments added Division headings for Part 3, inserted regs 13A-13F relating to Board reviewable decisions and procedures, updated the Pilbara networks rules Schedule 1 references, and made other drafting adjustments (see heading insertions in regs 7 and 13A-13F). Schedule 1 listing of reviewable decisions and procedural decisions was inserted by SL 2023/32 r. 6.

• 2025 amendment. Energy Regulations Amendment Regulations 2025 Pt. 3, SL 2025/179, published 29 October 2025 and commencing 30 October 2025. Regulation 9 was amended by SL 2025/179 r. 8 to include additional transitional powers allowing the Minister to make amending rules during specified periods, including a period ending 31 October 2027 following the commencement of an Energy Regulations Amendment Regulations 2025 provision (reg 9(6)-(7) and annotation [Regulation 9 amended: SL 2025/179 r. 8]).

• Amendments to arbitrator and Board funding regulations. Part 9 of these regulations amends the Electricity Industry (Arbitrator and Board Funding) Regulations 2009, with the insertion of regs 7A and 7B to enable specific cost fixing and recovery for Pilbara matters (Part 9, regs 35-39). These inserted provisions enable the Board and arbitrator to fix and recover costs relating to Pilbara proceedings and to charge the Regional Power Corporation for generalized quarterly amounts of the Board’s Pilbara‑related costs.

The compilation table at the end of the instrument records these changes and their commencement dates. The recorded sequence shows a layered approach: initial rule‑making and registration rules in 2021; a two year limited competition authorisation in 2022; refining of Board review and procedural protections in 2023; and expanded Ministerial powers to make amending rules in specified transitional windows in 2025. The particular text of the Pilbara networks rules and any amending rules made under the Minister’s powers will influence how these amendments operate in practice.

The text provided does not record judicial decisions or any litigation involving these regulations. The document contains no case citations and the compilation notes explicitly say this is a legislative compilation. Therefore there is no litigation history to summarise within the content of the regulations as provided.

What the regulations do include are administrative review mechanisms and potential dispute channels that could give rise to litigation or judicial review in the future. These are:

• Administrative review via the Board. The regulations specify which rule provisions are reviewable decisions (Schedule 1) and provide for Board review under regs 13A-13F. The Board’s determinations have the same effect as decisions made by the original decision maker (reg 13B(4)), which structures how disputes about rule applications will be litigated administratively.

• Cost recovery mechanisms that can be enforced in court. The amendments to the Arbitrator and Board Funding Regulations enable the arbitrator to recover unpaid amounts or interest in a court of competent jurisdiction as a debt due to the arbitrator (Part 9, regs 7A(6), 7B(6)). That creates a standard civil enforcement pathway for non‑payment of Board/arbitrator orders or notices.

• Criminal enforcement for unregistered operation. The $1 000 penalty for engaging in specified activities without registration (reg 19) could result in prosecutorial action by the Authority or an authorised person under reg 34.

• Civil liability caps and immunity limits. The regulations prescribe caps and exclusions for civil monetary liabilities (regs 22-31). These provisions will frame damages claims and allocation of risk in any future litigation arising from acts or omissions by Pilbara participants, the Pilbara ISO or public bodies covered by the immunity provisions.

Because no cases are cited in the text, readers must rely on the administrative and civil enforcement mechanisms the regulations set up as the foreseeable routes through which disputes will proceed. Any future litigation would likely involve interpretation of the Pilbara networks rules, the scope of immunities and caps in regs 21-31, the application of reviewable decision listings in Schedule 1, and the interplay with federal competition law authorisations under reg 16A.

This section flags technical traps, timing‑sensitive provisions and subtleties that follow directly from the regulatory text.

• Registration requirement is activity‑specific and operative. The registration prohibition applies from 1 October 2021 and targets operators of the North West Interconnected System Network, generators, storage works and large consumer works connected to high‑voltage connections (regs 18-19). The penalty is modest ($1 000), but non‑registration prevents lawful engagement in those activities. Check whether the Pilbara networks rules specify additional penalties or conditions for registration. The regulations leave the content and criteria for registration to the Pilbara networks rules (reg 18(2) cross‑referencing the rules).

• Ministerial gatekeeping for initial rules and certain amending rules. The Minister must make the initial Pilbara networks rules (reg 6). Amending rules may be made by the Minister during specified transitional periods (reg 9(6)-(7)). Importantly, amending rules that confer functions on the Coordinator or otherwise deal with matters in reg 8(b) must be approved by the Minister before they are made (reg 9(5)). That creates a two‑tier amendment process: routine amendments may be delegated by the rules, but some changes require direct Ministerial approval.

• Publication and commencement constraints. Initial and Minister‑made amending rules cannot commence before notification in the Gazette and publication on the Coordinator’s website (regs 10, 12(2)). Different commencement times may be fixed for different provisions (reg 12(3)-(4)). Practitioners must watch Gazette notices and the Coordinator website to know when rules or amendments become effective.

• Limited scope of statutory immunities and tight caps. While immunities under the Act exist, the regulations limit their scope significantly. They exclude liabilities arising from personal injury from immunity (reg 22), exclude liabilities to pay amounts under notes or rules (reg 23) and permit sophisticated parties to contractually limit immunity but not to the extent of affecting system management function immunity or reg 22 (reg 24). Caps are modest during the initial cap period ($10 000 per act and $100 000 group cap during initial cap period; reg 29) and higher thereafter ($100 000 per act with a $10 000 000 12‑month group cap; reg 30). Officers and employees have nominal liability of $1 for acts or omissions to another entity (reg 31). These caps may be binding in damage claims involving entities granted immunity, subject to exceptions and the operation of the Act.

• Complexity in determining initial cap period. The initial cap period definition depends on whether the immunity that does not apply is the immunity granted under s 120ZB(3) or otherwise. The initial cap period is 6 months beginning after either 2 months from notification of initial rules in the Gazette (if immunity under s 120ZB(3) is involved) or otherwise after 12 months from notification (reg 28). This timing nuance matters for calculating which cap applies to acts or omissions.

• Contractual bargaining among sophisticated parties permitted but constrained. Sophisticated parties may agree in contract to limit immunity as between them (reg 24). But such agreements cannot affect immunity in relation to system management functions or the operation of reg 22. That means parties trying to allocate risk by contract should ensure they do not attempt to override immunity protections for system management functions or personal injury liabilities.

• Board review timeframes and stays. An application for Board review does not automatically stay the operation of the decision unless the Board orders a stay to secure the effectiveness of the hearing and determination and has regard to affected interests (reg 13E(1)-(3)). The Board must determine reviews within 120 days, with a single possible 30 day extension for complexity (reg 13F(2)-(4)). Parties and counsel should plan for a predictable but limited administrative timeline.

• Procedural reviews are narrow. Where a decision is a listed procedural decision in Schedule 1, the Board’s review is limited to whether the correct procedure was followed; it cannot re‑decide substantive matters (reg 13C(1)). The Board must be constituted by a legal practitioner for such reviews (reg 13C(2)). Avoid treating a procedural review as an opportunity for substantive reconsideration.

• Competition authorisation is time limited. Regulation 16A provides an authorisation for relevant events that are done within two years of the commencement day specified in the regulation. That temporary authorisation relieves participants of federal competition risk for those activities only during that window and expressly does not override existing Commonwealth Part VII Division 1 authorisations (reg 16A(2)-(4)). After the two year window, parties must rely on other competition authorisations or comply with general competition law.

• Cost recovery is rule driven and may impose fees. Empowered persons must identify and submit costs for approval and the Pilbara ISO must allocate approved costs to participants who must pay fees in accordance with the rules (reg 17). The detail of how costs are apportioned, and the level of fees, will be found in the Pilbara networks rules rather than in these regulations. Entities should factor potential fee exposure into business planning.

• Arbitrator and Board funding changes increase exposure to discrete Board costs. The amendments in Part 9 allow the Board to fix costs attributable to hearing Pilbara matters and to allocate liability for payment to parties. Where the Board fixes an amount, failure to pay can lead to recovery in court and accrual of interest (Part 9, regs 7A and 7B). The Regional Power Corporation may be issued quarterly notices for general Pilbara matter costs (reg 7B). Parties involved in Board proceedings should budget for the possibility of being ordered to pay hearing costs.

• Limited criminal enforcement detail. The regulations vest the Authority with the power to prosecute Pilbara offences, but do not prescribe prosecutorial standards or administrative procedures for that process (reg 34). Practitioners should consider criminal enforcement risk in their compliance assessments, and seek clarity on Authority enforcement policy.

These gotchas are derived from the text of the regulations. Many operational consequences depend on the content of the Pilbara networks rules which the Minister must make and which will define registration criteria, allocation mechanisms and specific technical and procedural obligations.

This section sets out practical compliance steps derived from the regulatory text. It focuses on concrete actions and monitoring points for regulated entities.

1. Confirm whether your activity is captured and register if required (regs 18-19)

• Determine whether you operate any of the specified activities: operating a North West Interconnected System Network; operating generating works, storage works, or large consumer works connected to a North West Interconnected System Network (reg 18(2)). Large consumer works are defined as wires, apparatus, equipment, plant or buildings used to consume electricity and connected to a high‑voltage connection (reg 18(1)).

• If you perform any specified activity, ensure you are registered under the Pilbara networks rules or have a derogation or exemption. Engaging in a specified activity without registration after 1 October 2021 attracts a fine of $1 000 (reg 19).

• Check the Pilbara networks rules for registration procedures, eligibility criteria, documentation requirements and timelines. The regulations delegate registration mechanics to the Pilbara networks rules (reg 18).

2. Monitor and use Coordinator and Pilbara ISO publications (regs 10, 13, 15)

• Regularly check the Coordinator’s website for the current Pilbara networks rules as in force (reg 13). The initial rules and Minister‑made amending rules must be gazetted and published; monitor the Gazette for notices of rule making and website posting (reg 10).

• If you are a Pilbara network participant, track reporting requirements the Pilbara ISO may impose and ensure timely cooperation where the Pilbara ISO requests information or publishes information relevant to networks not covered by covered Pilbara networks (reg 15).

3. Implement accounting and budgeting for fees and allocated costs (reg 17)

• Empowered persons must implement accounting arrangements to identify costs and submit them for approval (reg 17(2)). If you are the Pilbara ISO or an empowered person, set up systems to separately identify costs related to Pilbara functions and to prepare cost submissions in the manner required by the Pilbara networks rules.

• For participants, anticipate cost allocations being passed through as fees under the Pilbara networks rules. Build these potential fees into operating budgets and contract negotiations.

4. Understand and negotiate contractual risk allocation where permitted (regs 23-24, 20 definition)

• If you are a sophisticated party (defined in reg 20), consider carefully whether and how to contractually allocate liability and immunity among sophisticated commercial parties. The regulations allow contractual limitation of immunity between sophisticated parties but constrain such agreements so they cannot affect immunity in relation to system management functions or the operation of reg 22 (reg 24(2)-(3)).

• Ensure high‑voltage contracts and service agreements expressly deal with payment obligations, as liabilities to pay amounts under notes or the rules are excluded from immunity (reg 23). Draft notice and recovery procedures to reflect that payments required by the Pilbara networks rules are recoverable despite immunity limitations.

5. Plan for liability exposure under regulatory caps and exceptions (regs 22-31)

• Identify the liability regime applicable to your organisation. During the initial cap period small per‑act caps apply ($10 000 per act and $100 000 group cap for the initial cap period; reg 29). Outside the initial cap period different caps apply ($100 000 per act and a $10 000 000 12‑month group cap; reg 30).

• Note the exclusions. Immunities do not apply to liabilities arising from personal injury, liabilities between related bodies corporate, or liabilities to pay amounts under the rules or under notes (regs 22-23, 29(2), 30(2)). Ensure insurance and contractual arrangements reflect those exclusions. Officers and employees of entities have statutory liability capped at $1 to another entity, but practitioners should consider personal liability exposure beyond that where other laws apply (reg 31).

6. Prepare for Board review processes and time limits (regs 13A-13F, Schedule 1)

• If you are likely to be affected by reviewable decisions listed in Schedule 1, prepare to apply for Board review within 28 days of notice or website publication (reg 13D(1)-(2)). The Board must make its determination within 120 days, subject to a 30 day extension for complexity or special circumstances (reg 13F(2)-(4)).

• For procedural decisions listed in Schedule 1, note that review is limited to whether the required procedures were followed; evidence that a decision is procedurally flawed may lead to the decision being set aside and the matter remitted (reg 13C(1)-(3)). Ensure procedural records are retained to defend procedural compliance.

• If seeking a stay of a decision pending review, prepare a targeted application addressing the interests of others who may be affected because the Board’s power to stay is discretionary and conditioned on securing the effectiveness of the hearing and determination (reg 13E(2)).

7. Factor in Board hearing cost risk (Part 9)

• Parties in proceedings related to Pilbara matters should budget for potential Board costs being fixed and allocated to parties under the amended funding regulations (Part 9, regs 7A and 7B). If you are likely to be a defendant or claimant in a Board hearing, consider the risk that the Board may fix hearing costs and order payment.

• Regional Power Corporation and other counterparties should be aware of quarterly charges that may be issued under reg 7B and payment and enforcement consequences for non‑payment including interest and court recovery.

8. Coordinate with competition counsel for activities occurring during the two year authorisation window (reg 16A)

• If undertaking arrangements or conduct in reliance on reg 16A’s competition authorisation, confirm the relevant event falls within the two year window defined in reg 16A(2) and that the actor is an authorised person or is performing functions under the Access Code, rules or authorised instruments (reg 16A(3)).

• Obtain competition law advice on whether any conduct falls within a Commonwealth Part VII Division 1 authorisation which reg 16A does not displace (reg 16A(4)) and plan for compliance after the two year period expires.

9. Use deliberate delegation and contract drafting for delegate liability protection (reg 26)

• If a participant delegates a function to a delegate who is not an officer or employee, reg 26 provides an exemption for the participant from s 120ZD(1)(a) in relation to civil monetary liabilities arising from acts or omissions of that delegate, subordinate delegate or their officers or employees, but does not affect the participant’s own act or omission liability (reg 26(1)-(3)). Use careful delegation agreements and ensure delegates carry appropriate indemnities and insurance.

10. Maintain records and document compliance steps

• Since many enforcement and review processes hinge on notice, publication dates and procedural compliance, maintain records of Gazettal notices, website postings, registration submissions, reports and correspondence with the Coordinator and Pilbara ISO.

• If being asked to provide information under the rules or by the Pilbara ISO, ensure formal records exist for requests and responses and consider privilege and incrimination protections,Board proceedings recognise a reasonable excuse to refuse to answer questions or produce documents where doing so might tend to incriminate the person (reg 13F(6)).

Following these steps will not remove all regulatory or commercial risk given the delegated role of the Pilbara networks rules. Practitioners should obtain a copy of the current Pilbara networks rules as published on the Coordinator’s website and align operational, contracting and insurance practices to that rule content and to the statutory caps, exclusions and Board procedures set out in these regulations.
