86 Power to acquire easements with approval of Governor in Council
S. 86(1) amended by Nos 40/2003 s. 22, 9/2026 s. 12A(1).
(1) A corporation to which this section applies may, with the approval of the Governor in Council, acquire compulsorily an easement which is, or may be, required for the purposes of—
S. 86(1)(a) inserted by No. 40/2003 s. 22.
(a) erecting or laying power lines (or both); and
S. 86(1)(b) inserted by No. 40/2003 s. 22.
(b) maintaining power lines.
(2) The **Land Acquisition and Compensation Act 1986** applies to this section and for that purpose—
(a) the **Electricity Industry Act 2000** is the special Act; and
(b) the corporation to which this section applies is the Authority.

(2A) Nothing in section 8C(1) of the **Environment Effects Act 1978** prevents—
(a) the Governor in Council approving an acquisition of an easement under this section; or
(b) the acquisition of an easement under this section.
***corporation to which this section applies*** means a distribution company, a transmission company or a generation company;
***easement*** includes right, charge, power or privilege in, under, over, affecting or in connection with, land.
