53 Order in Council in relation to trial waivers (1) The Governor in Council, by Order published in the Government Gazette, may do any one or more of the following— (a) specify matters the Commission must have regard to when determining whether to— (i) grant a trial waiver; (ii) extend the period of a trial waiver; (iii) vary a trial waiver or a condition to which a trial waiver is subject; (iv) revoke a trial waiver; (b) specify principles for the purposes of section 52; (c) specify a condition or class of condition that the Commission must or may make a trial waiver be subject to; (d) specify matters that the Commission must provide for in the trial project guidelines; (e) specify the process for the making or amendment of trial project guidelines by the Commission; (f) direct the Commission to make amendments to any instrument made by the Commission to give effect to any matter specified in the Order; (g) confer powers and functions on, and leave any matter to be decided by, the Commission. (2) An Order under this section may— (a) be of general or limited application; and (b) differ according to differences in time, place and circumstances.
