Electricity Industry (Access Code Enforcement) Regulations 2005

The regulations directly affect participants in Western Australia’s electricity network industry: network operators (such as Western Power and its successor entities), access seekers, retailers, generators, and any person who deals with covered network services. The Code provisions designated as enforceable apply to network operators and users. Civil penalty provisions such as s 3.36 (pricing principles), s 4.1 (obligation to provide access), s 4.8 (network operator duties for connection), and s 8.1 (information provision) impose obligations primarily on network operators. Section 9.2 (regulatory accounting) and s 10.34 (ring-fencing) also target operators. However, some provisions apply to other Code participants, such as s 12.7 (dispute resolution) and s 13.1(b) (compliance with Code). The Authority itself is affected: it must issue warning notices before applying for penalties, and has exclusive standing for regulatory provisions and civil penalty provisions. It cannot be sued under these regulations. The Minister is also immune. Any person, including competitors, customers, or consumer representatives, may enforce conduct provisions by seeking injunctions, remedial orders, or damages. This private right of enforcement is unusual in the electricity access context and potentially lowers the cost of monitoring and enforcement for the state. The Supreme Court is the adjudicating body for all applications. The Consolidated Fund receives all civil penalties, meaning taxpayers ultimately benefit from enforcement, but the Authority does not retain the funds, which may reduce any over-enforcement incentive. Legal practitioners advising network operators and access seekers must know which Code provisions fall into which category, as the enforcement consequences differ markedly. For example, a breach of s 4.1 (access obligation) exposes an operator to a civil penalty of up to $100,000 plus $20,000 per day after a warning notice, as well as injunctive relief at the Authority’s suit, and also a conduct provision breach actionable by any person for damages. By contrast, a breach of s 9.9 (regulatory provisions only) attracts only Authority-sought injunctions and orders, not a monetary penalty or private damages.

The regulations themselves impose no duties; they attach enforcement consequences to duties already in the Code. The key duties that become enforceable under the regulations are those listed in Schedule 1 (civil penalty provisions), Schedule 2 clause 1 (regulatory provisions), and Schedule 2 clause 2 (conduct provisions). The Table below summarises the enforcement rights.

For civil penalty provisions, the Authority has the exclusive right to seek a monetary penalty from the Supreme Court, but must first issue a warning notice. The target has the right to receive that notice, to provide an explanation, and to rectify the contravention before daily amounts accrue. The Court has the duty to consider the matters in reg 5(4) when determining the penalty amount. The person alleged to have contravened has the right to defend the proceeding.

For regulatory provisions, the Authority alone may apply for an injunction or other order. The person has the right to defend, but the Court may grant an injunction even if the person has not previously engaged in the conduct, does not intend to continue, or there is no imminent danger of substantial damage (reg 6(6)). Notably, when the Authority applies for an interim injunction, it is not required to give any undertaking as to damages (reg 6(7)), which reduces its risk of being liable for losses caused by a wrongly-granted interim order. This is a significant asymmetry in favour of the regulator.

For conduct provisions, any person has the right to apply for an injunction or other order, and to bring an action for damages within three years of the cause of action accruing. This private right of enforcement is a substantial right for competitors, customers, or other stakeholders. The person seeking an injunction may have to provide an undertaking as to damages compared to the Authority, but the regulations do not require it if the applicant is not the Authority. The text is silent on what different applications the court should treat the injunction application; the court’s general powers apply. The bar for conduct provisions includes obligations such as s 2.8(a) (compliance with Code objectives) and s 2.9 (non-discrimination), which are broad and may be enforceable by private parties.

No person has any right to bring proceedings against the Minister or the Authority under these regulations (reg 9). This is a broad immunity from suit that could shield them from merits review of enforcement decisions, though it does not bar judicial review under administrative law principles (which would be external to these regulations).

The enforcement pyramid under the regulations has four tiers: civil penalties, injunctions, other orders, and damages.

Civil penalties. The maximum amounts are set in Schedule 1, ranging from $20,000 to $100,000 per contravention, with daily amounts up to $20,000 per day for continuing breaches. Only the Authority may apply, and only after issuing a warning notice. The Court has discretion up to the maximum. The factors in reg 5(4) require consideration of the nature and extent of the contravention, any loss or damage, the circumstances, and prior contravention history. This is similar to penalty determination in competition and economic regulation. Daily amounts only run after the warning notice’s specified rectification day (reg 5(2)), so a well-timed rectification can cap the penalty at the base amount. Civil penalties are paid to the Authority but must then be credited to the Consolidated Fund (reg 10). This means the Authority does not directly benefit from penalties, arguably reducing the risk of enforcement for revenue-raising purposes.

Injunctions. Under reg 6, the Supreme Court may grant an injunction (including interim injunction) restraining a person from contravening a regulatory or conduct provision, or requiring compliance. The court may grant an injunction by consent or on application. For regulatory provisions, only the Authority may apply; for conduct provisions, any person may apply. The grounds are broad: the court does not need to find an intention to continue or repeat, or a prior contravention, or imminent danger of substantial damage to any other person (reg 6(6)). This makes injunctions a low-threshold remedy. The Authority’s application for an interim injunction does not require an undertaking as to damages (reg 6(7)), which removes a usual safeguard for the respondent. This is a notable power imbalance.

Other orders. Under reg 8, the Court may order a person to cease the contravening conduct or take specified remedial action. Again, standing mirrors the regulatory/conduct divide. These orders are available whether or not a penalty or injunction is also sought.

Damages. Under reg 7, a person who suffers loss or damage because of conduct that contravenes a conduct provision may recover that loss or damage in a court of competent jurisdiction (which includes the Supreme Court and likely the Federal Court). The limitation period is three years from accrual of the cause of action. This is a private right of action akin to the competition-law model under the Competition and Consumer Act 2010 (Cth). Notably, damages are only available for conduct provisions, not for regulatory provisions or civil penalty provisions alone. This means that some very serious breaches of the Code may not give rise to private damages if the provision breached is not designated as a conduct provision. However, many of the most commercially significant provisions (s 10.34 ring-fencing, s 13.1(b) compliance, s 14.14 pricing) are conduct provisions, so private damages are available for key obligations.

No proceedings against the Minister or Authority. Regulation 9 is a blanket bar on any proceeding under the regulations against those entities. This presumably covers any claim for damages, injunction, or other order that would name them as respondents. It does not bar judicial review under the Administrative Decisions (Judicial Review) Act 1977 (WA) or the inherent supervisory jurisdiction of the Supreme Court, because such proceedings are not brought “under these regulations”.

The regulations sit under the Electricity Industry Act 2004 (WA) and give effect to the Electricity Networks Access Code 2004 (the Code). The Code itself is made under s 104 of the Act and is a legislative instrument. The regulations do not replace the Code; they provide the enforcement mechanism. The Act also contains offence provisions (e.g. for contravening the Code) but the regulations create civil enforcement as a separate track. The regulations do not affect the Authority’s general powers under the Act, including its power to issue directions, impose a licence condition, or seek other remedies. The regulations expressly state they do not affect any other power the Court may have to grant injunctive relief (reg 6(8)), meaning existing equitable and statutory remedies remain available.

The relationship between civil penalties and criminal offences is not addressed in the regulations, but criminal provisions would likely be found in the Act itself. Where the same conduct contravenes both a civil penalty provision and a criminal offence, the civil penalty proceedings do not constitute punishment for double jeopardy purposes under Australian constitutional law, but the court may take into account any prior criminal penalty.

The trade practices and competition laws of the Commonwealth (Competition and Consumer Act 2010) may also apply to electricity market conduct. The regulations do not exclude the operation of Commonwealth law. A network operator could be subject to both a civil penalty under these regulations and a pecuniary penalty under the Competition and Consumer Act for access-related anti-competitive conduct. No provision for double jeopardy or set-off is included, though the Supreme Court could consider overlapping penalties under the common law abuse of process doctrine.

The limitation period in reg 7(2) (three years) for damages actions under conduct provisions interacts with the general limitation periods under the Limitation Act 2005 (WA). For tortious actions the general period is three years, so the regulations align with that. For contractual claims arising from an access agreement, the general limitation period may be six years; the regulations provide a shorter period for statutory damages actions under conduct provisions, which may influence a plaintiff’s choice of cause of action.

Where a person brings an action for damages under reg 7, they may still seek other remedies under the Code or the Act, such as dispute resolution under s 12.7 of the Code (which is a civil penalty provision). The regulations do not require election of remedies.

The immunity in reg 9 for the Minister and Authority does not extend to their conduct under other laws. Nor does it prevent the Authority from being sued under the Act itself, if the Act permits such proceedings. The regulation only bars proceedings “under these regulations”, so a claim under the Act would not be caught, provided the Act itself does not prohibit it.

The regulations are compiled from the original Electricity Industry (Access Code Enforcement) Regulations 2005, gazetted on 6 September 2005 and commencing on that same day (r. 2). The compilation table in the Notes shows no amendments have been made. There is a single entry for the principal regulations only. This means the regulations have remained unchanged for over nineteen years. The absence of amendment is notable given that the underlying Code has been amended several times, including changes to the ring-fencing regime, network pricing rules, and dispute resolution procedures. It suggests that the enforcement categories and penalty amounts have been considered adequate by successive governments and the Authority. However, the penalty maximums (up to $100,000) have not been indexed for inflation, so their real value has declined by approximately one-third since 2005, depending on the CPI measure. The list of civil penalty provisions and regulatory/conduct provisions has not been updated to reflect any new Code provisions inserted by amendments. This creates a risk that some newer Code obligations are not backed by these enforcement mechanisms. Practitioners should verify whether a Code provision added after 2005 has been designated under these regulations; if not, enforcement would need to rely on other mechanisms under the Electricity Industry Act 2004 (such as licence conditions or the Authority’s general compliance powers) or on contractual remedies under access agreements.

The compilation does not include any case references or amendment history indicating litigation. A search of West Australian Supreme Court records would reveal if there have been applications under the regulations. The regulations have likely been the subject of very few decisions, given the specialised nature and the small number of network operators in Western Australia. The lack of any reported appellate decisions or amendment to address judicial interpretation suggests either that compliance is high, that disputes are resolved administratively without court proceedings, or that the Authority prefers to use its other powers. The regulations’ broad injunctive powers, especially the absence of an undertaking as to damages for Authority interim injunctions, may deter respondents from testing applications. The three-year limitation period for damages actions under reg 7 may have been the subject of interpretation as to when a cause of action accrues (e.g. does it accrue on the date of the breach or when loss is first suffered?). Without judicial guidance, practitioners should assume accrual occurs when the loss is reasonably discoverable, consistent with general tort principles. The warning notice requirement has not been tested: does substantial compliance with the notice suffice, or is strict compliance required? The regulations are silent on the consequence of a defective warning notice, but a court would likely treat non-compliance as a jurisdictional bar to a penalty application. The immunity provision in reg 9 has not been judicially considered but would likely be read strictly: it may not prevent proceedings for declarations or judicial review that are not “under these regulations” but rather under the Electricity Industry Act 2004 or general administrative law.

Warning notice trap. The Authority cannot apply for a civil penalty unless it has first given the person a warning notice. However, the daily amount can only apply from the day specified in that notice. If the Authority gives a warning notice with a very short rectification period, the daily amount could start accruing almost immediately. The person must respond promptly and rectify the contravention to stop the daily accumulation. A failure to do so can dramatically increase the total penalty.

No undertaking as to damages for Authority interim injunctions. When the Authority seeks an interim injunction, the court must not require it to give any undertaking as to damages (reg 6(7)). This removes the usual reciprocal safeguard. An interim injunction can be obtained on the Authority’s say-so, without the Authority being liable for any losses suffered by the respondent if the injunction is later dissolved. This significantly tilts the balance of power in interlocutory proceedings.

Immunity from suit for Minister and Authority. A person cannot bring any proceeding under these regulations against the Minister or the Authority. This includes claims for damages, injunctions, or other orders. If the Authority acts wrongly in its enforcement (e.g. by issuing a warning notice without proper basis), the target may have no recourse under these regulations. They would need to rely on judicial review or common law actions outside the regulations. The immunity is broad: “proceedings under these regulations” likely covers any proceeding that relies on a right created by the regulations.

Damages limited to conduct provisions. Only contraventions of conduct provisions give rise to a private damages action. A breach of a significant obligation such as s 4.1 (access) is not a conduct provision (it is only a regulatory provision and civil penalty provision). Therefore, a person cannot sue for damages for a refusal of access under these regulations. The only remedies for that breach are civil penalty (Authority only) and injunction or other order (Authority only). Similarly, s 8.1 (information provision) and s 9.2 (regulatory accounting) are not conduct provisions. The conduct provisions list is short (eight provisions only). Practitioners must check the list before assuming a private damages right.

Three-year limitation period. Actions for damages must be commenced within three years after the cause of action accrues. This is shorter than the general limitation period for contractual claims (six years) and may be a trap for those who assume standard limitation rules apply. The precise time of accrual under this regulation is not defined; it could be the date of the contravention or the date of loss. A conservative approach is to proceed within three years of the contravention.

Consolidated Fund credit. Civil penalties are paid to the Authority but must be credited to the Consolidated Fund. This means the Authority does not directly benefit from higher penalties. While this reduces the risk of enforcement for revenue purposes, it also means the Authority may lack a financial incentive to pursue penalties vigorously. The enforcement effort may be less than optimal from a deterrence perspective.

No private enforcement of civil penalties. Only the Authority can seek civil penalties. A person affected by a breach of a civil penalty provision cannot apply for a penalty themselves. Their only remedy is to request the Authority to issue a warning notice and apply. If the Authority declines, the person has no right under these regulations to compel action. This is a significant limitation on private enforcement.

Compliance with the regulations is essentially compliance with the designated provisions of the Code. The regulations add procedural steps only for the Authority. For network operators and other Code participants, the key steps are:

1. Identify which Code provisions are enforceable under the regulations. Maintain an internal register of all Code provisions listed in Schedule 1 (civil penalty), Schedule 2 clause 1 (regulatory), and Schedule 2 clause 2 (conduct). Note that the lists are exhaustive and have not been updated since 2005. Any new Code provisions inserted by amendment are not automatically enforceable under these regulations unless the regulations are amended.

2. Prioritise compliance with civil penalty provisions. These carry the highest monetary risk, especially those with daily amounts (e.g. s 4.1, s 4.8, s 4.48, s 12.7, s 12.10, s 13.1(b)). Implement internal controls, audit processes, and escalation procedures to detect and rectify breaches quickly.

3. Respond promptly to any warning notice from the Authority. The notice will identify the alleged contravention and set a rectification deadline. Rectify the breach before the deadline to stop the daily penalty from accruing. Provide a written explanation as requested. A failure to respond may be held against you in penalty proceedings. Keep records of rectification steps.

4. Monitor compliance with conduct provisions, especially if competitors or customers may bring private actions. Breaches of s 2.8(a) (Code objectives) and s 2.9 (non-discrimination) are actionable by any person for damages or injunctions. Ensure access decisions are documented with reasoning showing compliance with non-discrimination principles. Limitation of three years for damages: keep records for at least six years to be safe.

5. If you are a person affected by a breach of a conduct provision, consider all remedies. You may seek an injunction, other orders, and damages. Gather evidence of loss and identify the specific provision contravened. Issue a letter of demand before proceeding to court to potentially avoid costs. Be aware of the three-year limitation period.

6. If you are an access seeker denied access, check if the Authority has issued a warning notice. If not, you can request the Authority to take enforcement action. However, the Authority has discretion and is not obliged to act. You may also pursue dispute resolution under the Code or seek contractual remedies.

7. For legal practitioners, verify the current version of the regulations before advising. Although the compilation shows no amendments, the online version on the WA legislation website should be checked for any recent uncommenced amendments. Note that daily amounts apply for each day or part of a day after the warning notice rectification date, so a half-day of breach counts as a full day.

8. No proceedings against Minister or Authority. If you believe the Authority has misused its powers, do not rely on these regulations for relief. Consider judicial review under the Administrative Decisions (Judicial Review) Act 1977 (WA) or a common law action for misfeasance in public office outside the regulations. The immunity in reg 9 is a complete bar only to proceedings “under these regulations”.
