What it does
These Regulations amend the scope of functions that three statutory electricity corporations may lawfully perform and fix the timing for those permissions. Mechanically the instrument does three things.
First, it authorises the Electricity Generation and Retail Corporation to perform a specific gas‑supply function in parts of Western Australia that are not served by the South West interconnected system (the SWIS). That authorisation is made under the Electricity Corporations Act 2005 (the Act) by reference to s 37(5) of the Act and the function in s 35(b)(i) of the Act (regulation 3). The Regulation thereby expands, or makes explicit, the geographic reach of a particular supply function for that statutory corporation to all parts of the State outside the SWIS.
Second, it authorises the Electricity Networks Corporation to provide stand‑alone power systems within the area specified as the distribution licence area held by that corporation. The mechanics are: regulation 4(2) states the authorisation is given under s 43(3) of the Act to perform the function in s 41(ba) of the Act, and regulation 4(1) imports three defined terms from the Electricity Industry Act 2004 (distribution licence, distribution licence area, and stand‑alone power system). The regulation fixes the distribution licence area by reference to the area specified under the Electricity Industry Act 2004 section 5 “as at regulation commencement day”, so the authorised geographic scope is time‑fixed to the licence specification on that commencement day.
Third, it authorises the Regional Power Corporation to perform specified transmission and distribution functions in respect of electricity systems inside the SWIS, but only in relation to three named Aboriginal communities and only for premises that meet ownership, occupancy, lease or use criteria. Regulation 5(2) gives the authorisation under s 52(4) of the Act to perform the “transmission and distribution functions” defined in regulation 5(1) as the functions set out in s 50(b), (g) and (j) of the Act. Regulation 5(1) requires that the community be one of the three communities listed, with those communities themselves defined by reference to the Aboriginal Communities Act 1979 s 3.
The Regulations do not create new criminal offences or administrative sanctions; they are limited to conferring or clarifying statutory authorisations for the named corporations to perform specified functions in particular geographic or factual circumstances (see regs 3, 4(2), 5(2)). The instrument also contains the usual commencement provisions (regulations 1-2) that bring into force regs 1 and 2 on publication day and the remainder on the following day, subject to the regulation‑specific definition of “regulation commencement day” in regulation 4(1) which ties an authorisation to the operation day of an earlier 2021 instrument (see compilation table and r 4(1)).
