Electricity Corporations (Areas of Operation) Regulations 2015

The Regulations operate by authorising activities that would otherwise be governed by the Act and relevant licensing statutes. The controlling concepts are authorisation, geographic scope, temporal point-in-time definitions and cross-reference to other statutes for definitions and scope.

Authorisation: each substantive regulation expressly authorises a named corporation to perform one or more functions under the Act. The enabling Act sections are cited in each regulation: s 37(5) for the Electricity Generation and Retail Corporation (reg 3), s 43(3) for the Electricity Networks Corporation (reg 4(2)), and s 52(4) for the Regional Power Corporation (reg 5(2)). The Regulations therefore do not create new statutory functions; they permit the exercise of functions already in the Act in places or for premises that are outwith the corporation’s ordinary area.

Geographic scope and point-in-time definitions: the Regulations rely on two different modes of spatial limitation.

• Broad area exemption by system coverage: regulation 3 authorises gas supply in "all parts of the State not served by the South West interconnected system". The SWIS coverage is the dividing line used; the regulation does not redraw network boundaries but uses the existence (or absence) of SWIS service to identify eligible locations (reg 3).

• Licence-area snapshot: regulation 4 authorises stand‑alone power systems "in the part of the State that is its distribution licence area", but crucially defines distribution licence area as the area specified in the distribution licence "as at regulation commencement day". That creates a snapshot approach: the authorised area is fixed to the licence area as it existed on the regulation commencement day, as defined by cross-reference to the Electricity Industry Act 2004 (reg 4(1)-(2)).

Community-specific and purpose-limited authorisation: regulation 5 combines system geography (electricity systems in the part of the State served by the SWIS) with property- and purpose-based criteria for premises (owned, occupied or leased by, or used solely or principally for, a named "relevant Aboriginal community"), and limits the authorised activities to particular transmission and distribution functions set out in s 50(b), (g) and (j) of the Act (reg 5(1)-(2)).

Definitions and cross-references: the Regulations do not define technical terms such as "South West interconnected system" within their text; they use terms defined elsewhere (for example, distribution licence and stand‑alone power system are defined by reference to Electricity Industry Act 2004 s 3(1), and "relevant Aboriginal community" is drawn from Aboriginal Communities Act 1979 s 3, reg 5(1)). A notes section reiterates that a list of defined terms is supplied for convenience and is not part of the law.

Temporal and amendment architecture: the Regulations have a simple commencement structure (reg 2) and an explicit amendment history recorded in the compilation table. Two later instruments (SL 2021/1 and SL 2023/79) inserted regulations 4 and 5 respectively. The inserted regulations are annotated as such in the text ([Regulation 4 inserted: SL 2021/1 r. 5.] and [Regulation 5 inserted: SL 2023/79 r. 4.]).

Practical upshot: the main concepts are targeted statutory authorisation (not licence-granting), spatial delimitation (SWIS/non-SWIS and licence snapshot), and community-specific limits tied to definitions in other Acts. The Regulations therefore adjust where and in respect of whom certain corporate functions under the Act may be performed, without rewriting the underlying corporate functions, pricing rules or licensing regime.

The Regulations primarily affect three State electricity corporations named in the Electricity Corporations Act 2005 and the persons or premises in the geographic areas or communities described in the instrument. They also affect ancillary stakeholders such as customers served by those corporations, other regulated network service providers, and regulators or Ministers exercising powers under the Act or other connected statutes.

Directly affected corporations and functions:

• Electricity Generation and Retail Corporation: reg 3 authorises it to perform its function of supplying gas under s 35(b)(i) of the Act in all parts of the State not served by the SWIS. That authorisation enables the Corporation to decide to supply gas in non-SWIS locations (reg 3).

• Electricity Networks Corporation: reg 4 authorises it to provide stand‑alone power systems under s 41(ba) of the Act, but confined to the "distribution licence area" specified in its distribution licence as at the regulation commencement day. This affects where the Networks Corporation may install or operate stand‑alone systems (reg 4(1)-(2); reg 4(2)).

• Regional Power Corporation: reg 5 authorises it to perform certain transmission and distribution functions (those in s 50(b), (g) and (j) of the Act) in relation to electricity systems in the part of the State served by the SWIS for the purpose of supplying premises tied to particular Aboriginal communities (Barrel Well; Kardaloo (Wandanooka); Kurrawang). This is a narrow authorisation, limited both by function and by which premises qualify (reg 5(1)-(2)).

Customers and premises:

• Residents, businesses and communal facilities in parts of the State not served by the SWIS are within scope of the Electricity Generation and Retail Corporation’s authorised gas-supply function (reg 3).

• Owners, occupiers or lessees of premises that are owned, occupied or leased by, or used solely or principally for the purposes of, one of the three listed Aboriginal communities may be affected by the Regional Power Corporation performing transmission and distribution functions in relation to electricity transported for consumption at those premises (reg 5(2)(a)-(b)). The licensing or tenancy status of premises is therefore a key gateway to whether the authorisation applies.

Other regulated entities and regulators:

• The Regulations may have incidental effects on other network operators or retailers that normally operate in or near the SWIS boundary or within distribution licence areas. For example, where an authorised corporation exercises functions outside its usual area, that activity might intersect with the operations or planning of other providers, though the Regulations do not prescribe how such overlaps are to be resolved (reg 3, reg 4(2), reg 5(2)).

• Regulators, Ministers or agencies responsible for licences and pricing are also affected in the sense that corporate activities enabled by these Regulations will still be subject to the Act and any licence or regulatory requirements imposed under it or other legislation. The Regulations do not themselves set price or funding mechanisms; therefore regulatory instruments outside the Regulations will determine customer charges, subsidies or cost recovery.

Third parties and contractors:

• Entities contracted by the authorised corporations to build, operate or maintain supply, distribution or transmission infrastructure in the authorised areas are operationally affected because the Regulations expand the scope of permissible activity for the corporations who may engage them. The Regulations do not prescribe procurement or contracting rules; those remain subject to the corporations' policies and the Act.

Geographic and temporal specificity creates differential effects:

• The distribution licence area is fixed by reference to its specification "as at regulation commencement day" (reg 4(1)). That temporal fixation affects which premises or land parcels are in scope; changes to licence boundaries after that day do not alter the authorisation provided by reg 4 as written.

• The list of "relevant Aboriginal communities" is limited to three communities defined in the Aboriginal Communities Act 1979 s 3 (reg 5(1)). Premises associated with other Aboriginal communities are not brought into scope by these Regulations.

In short, the Regulations principally affect the three named corporations by expanding the locations and limited functions they may perform, and thereby affect the customers and premises in those locations, the other regulated providers who might be affected operationally, and contracting parties engaged to deliver infrastructure or services.

The Regulations do not create novel duties or rights in broad terms; rather, they confer authorisations to exercise specified functions under the Electricity Corporations Act 2005 and thereby enable those corporations to carry out particular activities in defined places or for defined premises. Any concrete duties and rights arise primarily from the Act sections referenced and from other statutes to which the Regulations cross‑refer.

Authorisation as a right to act:

• By regulation 3, the Electricity Generation and Retail Corporation is authorised under section 37(5) of the Act to perform its function of supplying gas under section 35(b)(i) of the Act in parts of the State not served by the SWIS (reg 3). That authorisation operates as a statutory permission for the Corporation to exercise its supply function in those places; it is not framed as a duty to supply, but as an authority to perform the function.

• By regulation 4(2), the Electricity Networks Corporation is authorised under section 43(3) of the Act to perform the function of providing stand‑alone power systems under section 41(ba) of the Act in the part of the State that is its distribution licence area (as defined at regulation commencement day) (reg 4(1)-(2)). The text authorises performance of the function; it does not in itself impose operational obligations such as minimum service levels, customer connection duties, or pricing terms.

• By regulation 5(2), the Regional Power Corporation is authorised under section 52(4) of the Act to perform the transmission and distribution functions specified in s 50(b), (g) and (j) of the Act in respect of electricity systems in the SWIS-served part of the State for the transportation of electricity to premises tied to specified Aboriginal communities (reg 5(1)-(2)). The authorisation is limited in scope by function and by the character of the premises concerned.

Absence of prescriptive duties in the Regulations:

• The Regulations are spare in prescriptive content. They do not set service standards, connection obligations, safety requirements, complaint-handling procedures, pricing frameworks, cost-recovery mechanisms, or compensation arrangements. Any enforceable duties or rights imposed on customers or corporations will therefore come from the Act or other instruments (licences, Regulations under other Acts), not from these Regulations themselves. This is apparent because each regulation only states that a corporation "is authorised" under a specified provision of the Act to perform a function (reg 3; reg 4(2); reg 5(2)).

Interactions with licence terms and cross-referenced statutes:

• Regulation 4 relies on the definition of "distribution licence" and "distribution licence area" in the Electricity Industry Act 2004 s 3(1) and s 5 for its spatial scope, and specifies a temporal point "as at regulation commencement day". That means the Networks Corporation's right to provide stand‑alone power systems is linked to the content of its distribution licence as it stood on that specific day (reg 4(1)). Any licence conditions (including duties) that attach to that distribution licence under the Electricity Industry Act or under the Act will continue to apply.

• Regulation 5 ties the class of qualifying premises to communities defined in the Aboriginal Communities Act 1979 s 3. Questions about whether a premise is "used solely or principally for the purposes of a relevant Aboriginal community" implicate facts and possibly definitions under the Aboriginal Communities Act (reg 5(1)-(2)).

Decision-maker discretion and administrative action:

• The Regulations vest decision-making power in the named corporations to perform the authorised functions; they do not specify administrative processes for how a decision to extend supply, to construct networks, or to connect premises must be made. That discretion is therefore exercised in the framework of the Act and any applicable licences, but the Regulations themselves do not create procedural constraints.

Rights of affected third parties:

• The Regulations do not create a private right for third parties to require service, nor do they create an enforceable right in customers against the corporations distinct from any rights under the Act, licences, or other consumer-protection laws. The instrument simply authorises the corporations to act; whether third parties can compel action or obtain remedies will depend on the Act and other instruments.

In sum, the Regulations create targeted statutory permissions for three corporations to carry out certain functions in specific places or for specified premises, but they do not, on their face, impose new operational duties, pricing rules or customer entitlements. Those obligations must be located in the Act, in relevant licences under the Electricity Industry Act 2004, or in other applicable legislation.

The Regulations themselves do not prescribe penalties, enforcement mechanisms or sanction regimes. They function by cross-reference to the Electricity Corporations Act 2005 and to other statutes for definitions, and therefore any enforcement or penalty architecture will derive from the Act, relevant licences, or other regulatory instruments rather than from the Regulations’ text.

Absence of penalty provisions in the Regulations:

• A close reading shows that regulations 3, 4 and 5 simply authorise particular corporations to perform specified functions under the Act (reg 3; reg 4(2); reg 5(2)). The Regulations contain no sections imposing offences, specifying fines, creating infringement notices, nor setting out administrative review machinery. There is no text in the instrument that indicates a self-contained enforcement regime.

Enforcement relies on the Act and licences:

• Because the Regulations operate by authorising activities under specific sections of the Act (referencing s 35(b)(i), s 41(ba), s 50(b), (g) and (j), and the enabling authorising sections s 37(5), s 43(3) and s 52(4)), any enforcement action for misconduct, failure to comply with statutory duties, breaches of licence conditions, or contraventions of safety or technical obligations will be grounded in the Act, relevant licence instruments made under the Electricity Industry Act 2004, or other technical and safety legislation. The Regulations do not take away or add to the enforcement powers the Act confers; they simply expand where or in relation to whom the authorised corporations may exercise their functions.

Regulatory ambiguity and enforcement risk:

• Because the Regulations do not set operational rules, enforcement will depend on the clarity of the underlying Act and of the licence instruments. For example, if a dispute arises about whether a premise is "used solely or principally for the purposes of a relevant Aboriginal community" (reg 5(2)(b)), enforcement or adjudication would rely on factual inquiry and on any definitions or guidance in the Aboriginal Communities Act 1979 or in other applicable law. Similarly, whether a location is "served" by the SWIS (reg 3) may be determinative for jurisdiction; enforcement agencies or courts would need to resolve such points under the Act and relevant evidence.

Administrative or civil remedies:

• Any remedies for affected parties (customers, other providers) will be those available under the Act, licence conditions, or general administrative law (judicial review) or civil law (contract, tort) as applicable. The Regulations do not establish a separate administrative appeals path.

Implementation and coordination enforcement:

• Where the authorised activity by a corporation overlaps operationally with another licensee’s activities, enforcement or resolution of disputes will need to follow the relevant statutory or licence-based mechanisms. The Regulations do not prescribe processes for coordination between providers, nor do they establish inter-corporation dispute resolution procedures.

Compilation and amendment annotations:

• The Regulations’ compilation table and the insertion annotations ([Regulation 4 inserted: SL 2021/1 r. 5.] and [Regulation 5 inserted: SL 2023/79 r. 4.]) are not themselves enforcement instruments; they record legislative history. Enforcement clinicians should therefore look to the Act and to licence and regulatory frameworks for specific sanctions and remedies.

In short, enforcement and penalties relevant to activity authorised by these Regulations will be handled under other legal instruments. The Regulations expand the permissible scope of corporate activity but do not change the statutory enforcement framework within which those activities must be undertaken.

These Regulations operate almost entirely by cross-reference to other statutes and to the content of licences created or defined by other statutes. Understanding their legal effect therefore requires attention to the Electricity Corporations Act 2005 (the Act), the Electricity Industry Act 2004, and the Aboriginal Communities Act 1979, as those instruments supply the substantive functions, definitions and the list of communities respectively.

Direct cross-references:

• Electricity Corporations Act 2005: Each substantive regulation authorises a corporation to perform a function under specified sections of the Act. Regulation 3 invokes s 37(5) and s 35(b)(i); regulation 4 invokes s 43(3) and s 41(ba); regulation 5 invokes s 52(4) and s 50(b), (g) and (j) (reg 3; reg 4(2); reg 5(2)). The Regulations do not replace or alter those Act provisions; they operate as clarifying or enabling instruments that allow the corporations to exercise those functions in specified contexts.

• Electricity Industry Act 2004: Regulation 4 depends on definitions in the Electricity Industry Act 2004. It defines "distribution licence" and "stand‑alone power system" by reference to that Act’s s 3(1), and defines "distribution licence area" as "the area specified, as at regulation commencement day, under the Electricity Industry Act 2004 section 5 in the distribution licence held by the Electricity Networks Corporation" (reg 4(1)). Therefore, the spatial scope of reg 4 is determined by the content of the distribution licence under the Electricity Industry Act 2004 as it stood on the regulation commencement day. Any regulatory consequences of being within or outside a distribution licence area will be governed by the Electricity Industry Act, not by these Regulations.

• Aboriginal Communities Act 1979: Regulation 5's list of "relevant Aboriginal community" relies on the definition of those communities under Aboriginal Communities Act 1979 s 3 (reg 5(1)). Whether a community qualifies as "Barrel Well", "Kardaloo (Wandanooka)" or "Kurrawang" for the purposes of the regulation is therefore to be determined by the Aboriginal Communities Act 1979 s 3. Additionally, the criterion that premises are "used solely or principally for the purposes of a relevant Aboriginal community" will implicate the factual and legal constructs in that Act.

Scope overlap and potential jurisdictional questions:

• The Regulations create situations where a corporation may lawfully perform functions in places where it might not otherwise be permitted. In such situations, interplay with licences and regulatory responsibilities governed by the Electricity Industry Act 2004 and the Act will be salient. For example, the Networks Corporation's ability to provide stand‑alone power systems in its distribution licence area as at the regulation commencement day may intersect with other licence holders’ rights or regulatory obligations; the Regulations do not spell out priority or conflict-resolution rules.

• The distinction between the SWIS and non-SWIS parts of the State is central to regulation 3 and regulation 5. Determining whether a location is "served by the South West interconnected system" is consequential for whether the Electricity Generation and Retail Corporation or the Regional Power Corporation may act under the authorisations. The Regulations do not themselves define "South West interconnected system"; that term will therefore be interpreted in the context of the Act or other regulatory material.

No modification of licence or safety obligations:

• The Regulations enable functions but do not purport to modify licence conditions, technical safety obligations, environmental laws, local government approvals, land access rights, or other statutory requirements that may apply to physical works or service delivery. Those laws remain applicable to any infrastructure or services provided under the authorisation.

Administrative and remedial pathways:

• The Regulations do not create or displace administrative appeal rights, compensation entitlements, or dispute resolution mechanisms. Those pathways remain governed by the Act, the Electricity Industry Act 2004, licence instruments, and general administrative or civil law.

In sum, these Regulations are instruments of cross-reference and targeted authorisation. They interact with other laws by importing definitions and operative powers from the Act and the Electricity Industry Act 2004, and by depending on the Aboriginal Communities Act 1979 to identify communities. They do not stand alone in governance terms; enforcement, duties, licence conditions and technical obligations are located in those other statutes and in the content of licences.

The Regulations were originally made and published in October 2015 and have been amended twice, as recorded in the compilation table. The instrument's structure and operative provisions have changed by insertion of new regulations in later amendments; the compilation table specifies publication and commencement details for the original instrument and for each amending statutory instrument.

Chronology and legislative identifiers:

• Original instrument: Electricity Corporations (Electricity Generation and Retail Corporation Area of Operation) Regulations 2015, published 20 October 2015 (Government Gazette p. 4293). Commencement: regulations 1 and 2 (citation and commencement) commenced on 20 October 2015; the remaining regulations commenced on 21 October 2015 (reg 2; compilation table first row).

• 2021 amendment: Electricity Corporations (Electricity Generation and Retail Corporation Area of Operation) Amendment Regulations 2021, SL 2021/1, published 15 January 2021. The compilation table records commencement of regs 1 and 2 of that amending instrument on 15 January 2021 and the rest on 16 January 2021. The text annotates that Regulation 4 was inserted by SL 2021/1 r. 5 ([Regulation 4 inserted: SL 2021/1 r. 5.]). That insertion added the authorisation for the Electricity Networks Corporation to provide stand‑alone power systems within its distribution licence area (reg 4).

• 2023 amendment: Electricity Corporations (Areas of Operation) Amendment Regulations 2023, SL 2023/79, published 20 June 2023. The compilation table records commencement of regs 1 and 2 on 20 June 2023 and the rest on 21 June 2023. The text annotates that Regulation 5 was inserted by SL 2023/79 r. 4 ([Regulation 5 inserted: SL 2023/79 r. 4.]). That insertion added the authorisation for the Regional Power Corporation to perform specified transmission and distribution functions in relation to premises associated with three named Aboriginal communities (reg 5).

Citation change and editorial notes:

• The "Other notes" section of the compilation records that the instrument is now known as the Electricity Corporations (Areas of Operation) Regulations 2015; its citation was changed (note under reg 1). The compilation table records the dates and SL numbers associated with each amendment, which is important for identifying when the new authorisations became operative.

Practical consequences of amendment timing:

• Because regulation 4's definitions rely on the distribution licence as specified "as at regulation commencement day", the 2021 insertion of reg 4 fixes the distribution licence area for the Networks Corporation to that licence as it existed on the commencement date of the 2021 amendment. Practically, this means changes to licence areas after the relevant commencement day do not alter the distribution licence area for the purposes of regulation 4 as it stands (reg 4(1)). This temporal fixation was created by the 2021 amendment and is therefore an amendment-specific effect.

• Similarly, regulation 5's insertion in 2023 created a new, narrow authorisation tied to the three named Aboriginal communities; the effect applies from the commencement date of that amendment as recorded in the compilation table.

No recorded repeals or substantial reworking:

• The compilation table shows only insertions and no repeal of the substantive regulations. The instrument therefore progressed from being focused primarily on the Electricity Generation and Retail Corporation (the 2015 instrument title) to include specific additional authorisations for the Electricity Networks Corporation (2021) and the Regional Power Corporation (2023).

For practitioners, the amendment history provides the operative dates for each authorisation and indicates that the Regulations are intended to be modified modestly and incrementally by regulation insertions rather than by wholesale rework.

The Regulations themselves do not record any litigation history. The instrument contains no annotated cases, no references to judicial determinations, and the compilation table does not list any court decisions or legal proceedings that have interpreted these Regulations. The text therefore provides no direct evidence of judicial interpretation or litigation concerning the scope or application of these Regulations.

Implications of the absence of recorded litigation:

• Because the Regulations are highly targeted authorisations that operate by reference to the Act and other statutes (reg 3; reg 4(1)-(2); reg 5(1)-(2)), litigation that would concern them is more likely to arise in the context of disputes under the Electricity Corporations Act 2005, the Electricity Industry Act 2004, or in relation to the Aboriginal Communities Act 1979 definitions. Any legal challenge about whether a corporation may lawfully exercise a given function in a particular place would therefore likely invoke those Acts and associated licence conditions, rather than challenge the Regulations in isolation.

Potential loci for future disputes (no cases named in the Regulations):

• Factual disputes about whether premises satisfy the criterion "used solely or principally for the purposes of a relevant Aboriginal community" (reg 5(2)(b)) may be contested; because the Regulation references the Aboriginal Communities Act 1979 s 3 for the list of communities, litigation could arise about whether a given premises' use brings it within the regulation’s scope. The Regulations themselves do not provide interpretive guidance for such tests.

• Boundary or service questions about whether a place is "served by the South West interconnected system" (reg 3; reg 5) could be determinative of which authorisation applies. Disputes over the factual state of "service" or on where the SWIS confers service could generate litigation invoking technical evidence and the Act or regulatory instruments.

• Disputes may also concern the effect of the "distribution licence area" being fixed "as at regulation commencement day" for the purposes of reg 4(1). Parties may litigate whether a particular parcel of land was within the distribution licence area on the relevant commencement day, invoking historical licence documents and possibly administrative records.

Absence of reported judicial decisions in the compilation:

• The instrument provides no precedent citations and no recorded cases interpreting these Regulations. Practitioners should therefore expect that ultimate legal resolution of borderline questions will rely on general statutory interpretation principles, the content of the Act and related statutes, and potentially first-instance judicial determinations if disputes are litigated.

For now, the Regulations appear to have a limited, administratively focused footprint. If disputes arise, they will most likely be framed within the context of the Act, licence terms under the Electricity Industry Act 2004, or definitions under the Aboriginal Communities Act 1979 rather than as standalone challenges to the Regulations themselves.

The Regulations are concise but contain several features that can produce unexpected operational or legal effects. These should be front of mind for counsel, compliance teams and operational planners.

1. Snapshot definition for "distribution licence area" (reg 4(1))

• The distribution licence area is defined as the area specified in the distribution licence "as at regulation commencement day". That wording creates a fixed snapshot. If the distribution licence held by the Electricity Networks Corporation changes after that day (for example, through amendment, surrender, or re-specification), the area relevant for the authorisation in reg 4 remains the earlier, snapshot area unless the Regulations are amended. Practitioners should note that rights under reg 4 are tied to a historical state of the licence, not to future versions (reg 4(1)-(2)).

2. Narrow community list for reg 5

• Regulation 5’s authorisation for the Regional Power Corporation is limited to premises associated with three named Aboriginal communities defined in the Aboriginal Communities Act 1979 s 3 (Barrel Well; Kardaloo (Wandanooka); Kurrawang). Other Aboriginal communities are excluded unless the Regulations are amended or those communities appear in the Aboriginal Communities Act definition. The limited list means operational plans that assume broad Aboriginal-community coverage will be incorrect (reg 5(1)-(2)).

3. Functional limits in reg 5

• The Regional Power Corporation is authorised only to perform the functions listed in s 50(b), (g) and (j) of the Act. The Regulations do not authorise a general transmission and distribution power, but only those specified functions. Practitioners must check the Act to determine exactly which activities s 50(b), (g) and (j) permit; the Regulation itself refers to those subsections but does not restate them (reg 5(2)).

4. No pricing or cost-recovery detail

• None of the Regulations set out pricing, tariffs, subsidies, or cost-recovery mechanisms for the authorised activities. The Regulations enable activity but do not instruct how costs are to be met or how customers will be charged. That leaves pricing and funding questions to the Act or other regulatory instruments and creates practical uncertainty for budgeting and customer communications (reg 3; reg 4(2); reg 5(2)).

5. The SWIS boundary matters

• Whether a place is "served by the South West interconnected system" is decisive for the application of reg 3 and reg 5. The Regulations do not themselves define the SWIS, so parties need to rely on the Act, regulatory materials, or factual determination about network service to establish coverage. This can be a practical point of contention in areas close to the SWIS boundary (reg 3; reg 5).

6. Premises "used solely or principally" is fact-intensive

• The phrase "used solely or principally for the purposes of a relevant Aboriginal community" in reg 5(2)(b) requires an assessment of use. Mixed-use premises or premises with shared occupancy could produce uncertainty about whether the authorisation applies. The Regulation imposes no evidential standard or process for determining principal use; practitioners should record and document usage facts and how decisions were reached (reg 5(2)(b)).

7. No express coordination mechanism with other service providers

• The Regulations do not provide a mechanism for coordination, dispute resolution, or compensation where the authorised activity overlaps with another provider’s operations. This could be operationally significant where network works or supply encroach on other licence areas or where access and asset ownership interact. Parties should proactively address coordination through contracts and regulatory engagement (reg 3; reg 4(2); reg 5(2)).

8. Start-date sequencing and transitional considerations

• Commencement rules (reg 2) mean that the citation and commencement provisions start on the Gazette publication day, but the substantive provisions begin the following day. The compilation table also records amendment commencement dates. Care is required when aligning project schedules and contractual obligations with the precise operative dates recorded in the compilation table and the Regulations themselves (reg 2; compilation table).

9. Definitions located outside the Regulations

• Key definitions (distribution licence; stand‑alone power system; relevant Aboriginal community) are by reference to other Acts. Practitioners must consult those Acts (Electricity Industry Act 2004; Aboriginal Communities Act 1979) for the operative meanings; assuming ordinary-language meanings could be misleading (reg 4(1); reg 5(1)). The Regulations’ notes also caution that the list of defined terms is not part of the law.

10. Limited statutory text increases reliance on external instruments

• Because the Regulations are tightly focused and lean on cross-references, legal questions will often require consultation of multiple statutory instruments and possibly relevant licences or regulatory determinations. This increases transactional complexity and the need for cross-disciplinary checks (legal, regulatory, technical, land/title).

Each of these points is grounded in the text of the Regulations and the way they cross-reference other Acts. Parties relying on the authorisations should map these features against licence conditions, network boundaries, tenure and occupancy records, and the funding and pricing frameworks that will apply under the Act and regulatory instruments.

Compliance in practice requires attention to the authorisation content, to the relevant definitions in other statutes, to licence documents, and to operational and documentary processes. The Regulations authorise activity; they do not set out operational rules. Below are concrete steps and controls that will align a corporation’s actions with the Regulations’ scope and mitigate legal and operational risk.

1. Map the authorisation to the Act sections

• For each proposed activity, identify the specific Act provision under which the Regulation says the corporation is authorised. For example, if the Electricity Generation and Retail Corporation proposes to supply gas in a non-SWIS area, document that the authorisation traces to s 37(5) and s 35(b)(i) of the Act as referenced in regulation 3 (reg 3). For the Networks Corporation and stand‑alone power systems, map to s 43(3) and s 41(ba) (reg 4(2)); for the Regional Power Corporation, map to s 52(4) and the specific subsections of s 50 (reg 5(2)).

2. Confirm spatial and premises eligibility

• Verify whether the location is "served by the South West interconnected system" for the purposes of regs 3 and 5. Obtain network records or an authoritative determination from the network operator or the regulator that identifies SWIS coverage. For reg 4, confirm whether the location falls within the distribution licence area specified in the distribution licence as at the regulation commencement day; obtain a certified copy of the Networks Corporation’s distribution licence as at that date and document the geographic extent (reg 4(1)-(2)).

• For reg 5, confirm that the premises are owned, occupied or leased by, or used solely or principally for the purposes of, a listed "relevant Aboriginal community". Obtain title records, lease documents, occupancy records, and documentary evidence of use to support the factual determination. If use is mixed, document the basis for determining whether use is principally for community purposes (reg 5(2)(a)-(b)).

3. Check applicable licence terms, safety and technical standards

• Although the Regulations authorise functions, the corporation must comply with applicable licence conditions under the Electricity Industry Act 2004 and with the technical, safety and environmental obligations that apply to infrastructure construction and operation. Before proceeding, review the Networks Corporation’s licence conditions, any permits required under local planning or environmental laws, and relevant safety standards.

4. Establish pricing and funding arrangements before customer engagement

• Because the Regulations do not state pricing or cost recovery methods, determine the regulatory or contractual framework that will govern prices, charges and subsidies for the authorised supply. Document the legal basis for any charges, obtain regulator approvals where required, and communicate terms to prospective customers. Ensure consistency with any applicable consumer protection obligations or licence conditions.

5. Put documentary decision-making in place

• Adopt internal controls and decision‑making processes that document determinations about eligibility, scope and compliance. For each project, maintain an audit trail showing the legal basis for proceeding (the specific regulation, the Act section cited, licence documents and evidence of premises use), approvals from senior management or the board, and any regulatory notifications or approvals obtained.

6. Coordinate with other providers and regulators

• Where activity could overlap with another provider’s assets or services, proactively notify the other provider and the regulator and seek to document agreed arrangements. Where necessary, negotiate access, easement or connection agreements and record any asset ownership or maintenance responsibilities.

7. Manage community engagement and Indigenous approvals

• For activities touching on Aboriginal communities pursuant to reg 5, adopt culturally appropriate engagement practices, obtain consents or community approvals where required by other law or policy, and document those engagements. Keep records demonstrating that premises meet the "owned, occupied or leased by, or used solely or principally for the purposes of" threshold.

8. Train operational staff on the limits of authorisation

• Ensure operational teams understand the geographic and functional limits in the Regulations: non-SWIS vs SWIS, distribution licence area as of the commencement day, and the specific functions authorised for the Regional Power Corporation. Train staff to escalate any ambiguous cases to legal or regulatory compliance teams.

9. Maintain readiness to respond to disputes

• Create a dispute-resolution playbook for potential disagreements about SWIS coverage, premises use, licence boundary interpretation or supply obligations. Ensure legal counsel is prepared to obtain historical licence documents, network statements, occupancy evidence and other records that would be needed to defend an authorisation.

10. Monitor and document legislative change

• The Regulations have been amended by later Statutory Laws (SL 2021/1 and SL 2023/79). Maintain a compliance register that flags any future amendments, records their commencement dates and analyses operational impact. Because reg 4 uses the licence area "as at regulation commencement day", future amendments may create further snapshot effects that require operational adjustments.

11. Check for ancillary approvals

• For physical works, verify whether planning approvals, land access or native title clearances are required. The Regulation’s authorisation does not replace the need to obtain such approvals.

12. Keep regulator engagement records

• Where the Act or licence requires notification or approval for particular infrastructure or service extensions, keep contemporaneous records of communications with the regulator and of approvals or conditions imposed.

Following these steps will align operational decisions with the narrow authorisations the Regulations provide and will create defensible documentary records demonstrating that actions fall within the regulatory permissions as drafted (reg 3; reg 4(1)-(2); reg 5(1)-(2)).
