The Bill introduces several interlocking statutory concepts that alter how electrical equipment safety restrictions are made, communicated and enforced.

• Unsafe equipment direction (s 122D). This is the primary new concept. It is a discrete decision by the regulator made by gazette notice that can prohibit sale, installation, and/or use of an item or type of electrical equipment where the regulator is satisfied on reasonable grounds the equipment is or will be unsafe in use, or lacks adequate marking or accompanying information. Each direction must identify who it applies to, set a period (up to 10 years), and state the compliance obligation and the requirement to have a reasonable excuse to contravene (s 122D(1)-(3)). The regulator may reissue the same direction multiple times in respect of the same item or type (s 122D(4)).

• Centralised decision-making and non-delegation (amendment to s 122B(2)). The regulator cannot delegate the s 122D or s 122E powers, meaning that these specific functions must be exercised by the regulator itself (cl 3).

• Publication and notice regime (s 122D(8)-(9)). The regulator must publish each unsafe equipment direction and a QCAT Act s 157(2) notice on the department’s website. For sale prohibitions the regulator must also deliver copies of those documents to persons it knows, or is likely to know, are sellers. The Bill also displaces lack of receipt as a defence (s 122D(10)).

• Evidential burden on defendant (s 122D(6)). If a prosecution arises for non-compliance, the defendant bears an evidential burden to show a "reasonable excuse". This is positioned as an evidential, not persuasive, burden in the statutory text.

• Regulatory delegation to electricity entities (s 210(6)). The Bill enables a regulation to authorise electricity entities, or a class of them, to give notices requiring action in relation to defective electrical equipment. This creates a mechanism by which private or corporate electricity entities may be given statutory power to require remedial action (subject to regulations yet to be made).

• Transitional validation of prior regulatory notices (ss 260-262). Notices previously given by electricity entities about defects are validated as if the s 210 power existed at the time (s 261). Certain prior prohibitions under former reg s 192 that were in force immediately before commencement continue as unsafe equipment directions with specified characteristics (s 262). The Bill expressly exempts those continued directions from the s 122D(8)-(9) publication and seller-notification obligations (s 262(4)), while declaring them to have been given by the regulator via gazette on commencement, applying to all persons, for 10 years, and containing the s 122D(3)(c) matter (s 262(5)).

• Repeal/omission of regulatory prohibition power (Electrical Safety Regulation 2013 s 192 omitted by cl 9). The Bill removes the older mechanism in the Regulation that allowed the regulator to prohibit sale or use on safety grounds and replaces the regulatory mechanism with the statutory s 122D regime and conversion of specified continuing prohibitions.

These concepts combine to centralise the creation of prohibitions into a non-delegable regulator power coupled with procedural publication obligations, while preserving certain pre-existing prohibitions and enabling regulations to authorise electricity entities to issue corrective notices. The text also embeds procedural touchpoints with the QCAT Act for notice requirements (s 122D(8)-(9)) and sets a statutory maximum period for directions of 10 years (s 122D(3)(b)).

The Bill’s mechanics change rights and obligations across several identifiable groups. The provisions and cross-references in the Bill indicate who pays, who decides, and who must change behaviour.

• The regulator (decision-maker). The Bill places new substantive decision-making power in the regulator to give unsafe equipment directions (s 122D) and prevents delegation of that power (amendment to s 122B(2)). The regulator is also required to publish directions on the department’s website and provide specific notices under the QCAT Act for decisions (s 122D(8)).

• Sellers of electrical equipment (economic actors liable to be affected). A sale prohibition under an unsafe equipment direction directly inhibits their normal commercial activity (s 122D(2)(a)). For sale directions, the regulator must proactively give the direction documents to each person it knows, or is likely to be, a seller (s 122D(9)). The Bill also removes the defence that a seller did not receive such a document (s 122D(10)), shifting the practical compliance cost onto sellers to monitor official gazettes and departmental publications.

• Installers and persons performing installations. An installation prohibition is explicitly within the regulator’s power (s 122D(2)(b)). Transitional provisions treat certain former "use" prohibitions as including installation (s 262(6)), which affects firms installing equipment and possibly contractors.

• Users and operators of electrical equipment. A use prohibition under s 122D(2)(c) directly affects persons who operate electrical equipment, including businesses and potentially members of the public involved in activities using the equipment (s 122D(3)(a) requires the direction to state the person or class of persons to whom it applies).

• Persons in control of electrical equipment and electricity entities. Section 210(6) expands the regulation-making power to allow regulations to authorise electricity entities to give notices requiring action in relation to defective equipment. The transitional provision (s 261) validates notices previously given by electricity entities, which means people who already received such notices are treated as if authorised by s 210(6) (s 261(2)-(3)). Electricity entities thus gain or have validated statutory notice-giving roles, with practical consequences for persons in control of equipment.

• Legal defendants facing enforcement. Contravention of an unsafe equipment direction carries a maximum penalty of 40 penalty units and places an evidential burden on the defendant to show a reasonable excuse (s 122D(5)-(6)). The evidential burden shifts preparatory compliance tasks towards potential defendants to preserve defences.

• The regulated community at large, including manufacturers, importers, wholesalers, distributors, retailers, electrical contractors, facility owners and operators. The broad wording "item of electrical equipment, or a type of electrical equipment" (s 122D(1)) and the ability to specify persons or classes (s 122D(3)(a)) mean wide groups may be affected by a single direction.

• Parties previously affected by prohibitions under former regulation s 192. The Bill specifies which prior prohibitions are "continuing installing prohibitions" and "continuing use prohibitions" by gazette dates (s 262(8)-(9)), and continues those prohibitions as unsafe equipment directions from commencement with prescribed default content and effects (s 262(2)-(5)). However, the publication and seller-notification obligations in s 122D(8)-(9) do not apply to those continued directions (s 262(4)), changing the communication regime for those specific transitioned prohibitions.

• Regulators or bodies under the Work Health and Safety Act 2011 that previously relied on amendments flagged in the 2024 Act. Parts 4 and Schedule 1 omit certain sections of the Work Health and Safety and Other Legislation Amendment Act 2024 and adjust cross-references (ss 11-13, Schedule 1), which affects legislative interconnections and administrative practice.

In short, sellers, installers and users primarily bear immediate compliance costs and operational constraints from prohibitions; electricity entities may be given statutory notice-giving responsibilities (or have past notices validated); the regulator gains central, non-delegable control of prohibition directions and must observe publication and QCAT notice procedures; and defendants in enforcement proceedings carry an evidential onus when relying on a "reasonable excuse".

The Bill creates defined duties for the regulator, electricity entities (subject to future regulations), sellers, installers and users, and rights/defences for persons affected by directions. The statutory text sets out both procedural duties and substantive prohibitions.

Duties imposed on the regulator

• Exercise of s 122D and s 122E: The regulator has the power to give unsafe equipment directions and must personally exercise the powers under s 122D and s 122E because those powers cannot be delegated (amendment to s 122B(2)).

• Publication and notice duties: When a direction is given, the regulator must publish a copy of each unsafe equipment direction and a notice complying with QCAT Act s 157(2) on the department’s website (s 122D(8)). For sale prohibitions, the regulator must also give a copy of those documents to each person the regulator knows to be, or is likely to be, a seller of the affected equipment (s 122D(9)).

Duties imposed on regulated persons

• Compliance with directions: A person to whom an unsafe equipment direction applies must comply unless the person has a reasonable excuse (s 122D(5)). The direction must specify the person or class of persons to which it applies (s 122D(3)(a)).

• Time-limited obligations: Directions must state the period for which they apply, up to a maximum of 10 years (s 122D(3)(b)). The regulator may give the same direction more than once in relation to the same item or type (s 122D(4)), allowing renewal or reissuance.

• Evidential burden in enforcement: If accused of non-compliance, the defendant carries an evidential burden to show a reasonable excuse (s 122D(6)). The maximum penalty for contravention is 40 penalty units (s 122D(5)).

Duties (or prospective powers) for electricity entities

• Regulation-authorised notice-giving: A regulation may provide for an electricity entity, or a class of electricity entities, to give notices requiring action to be taken in relation to defective electrical equipment (s 210(6)). The Bill does not itself make such regulations; it opens the regulatory avenue.

Transitional duties/effects

• Validation of prior notices: The Bill declares that notices given by electricity entities before commencement about defects are taken to have been valid as if s 210 had been in force (s 261(2)-(3)). This means prior recipients of such notices are treated as if the statutory power existed at the time the notices were given.

Rights and procedural safeguards

• QCAT Act notice interaction: The regulator must publish a QCAT Act s 157(2) notice in relation to the decision to give an unsafe equipment direction (s 122D(8)). The Bill’s text expressly links the statutory regime to the QCAT Act’s notice requirements, creating a procedural step.

• Repetition and time-limits: Directions are time-limited (maximum 10 years) and may be reissued; that combination creates periodic review opportunities in practice, though the text does not itself create an automatic review mechanism.

Non-excusable failures

• Not receiving a required document is not a reasonable excuse for non-compliance (s 122D(10)). This places an onus on affected persons to monitor statutory publications and gazettes rather than to rely on service by the regulator.

Other consequential duties/changes

• Conversion of prior regulation prohibitions: Certain former s 192 prohibitions under the Regulation are continued as unsafe equipment directions with specific prescribed content and are taken to have been given by the regulator with gazette publication on commencement (s 262(2)-(5)). For those continued directions, the s 122D(8)-(9) publication and seller-notification obligations do not apply (s 262(4)), but the continued directions are declared to apply to all persons and to be for 10 years (s 262(5)).

Rights of affected persons that follow from the text

• The statutory requirement to publish a QCAT Act s 157(2) notice signals an administrative law pathway for challenge or review of the regulator’s decision-making, though the Bill itself does not specify appeal rights beyond the linkage to the QCAT Act.

• The ability for the regulator to reissue a direction and the 10-year cap mean affected persons have predictable temporal boundaries for prohibitions, and the continued existence of transitional directions is specifically spelt out.

Collectively, the Bill creates a structured regime of non-delegable regulator decisions, mandatory publication and seller-notification in certain cases, a possible role for electricity entities under regulation, and specific evidential burdens and penalties for non-compliance.

The Bill specifies the principal penalty for contravening an unsafe equipment direction, sets evidential burdens impacting enforcement practice, and embeds publication and notice processes that feed into enforcement dynamics.

Statutory penalty

• Contravention of an unsafe equipment direction is an offence with a maximum penalty of 40 penalty units (s 122D(5)). The Bill does not set differing penalties for sale, installation or use prohibitions; the single maximum applies to any contravention of s 122D directions.

Evidential burden

• The defendant must discharge an evidential burden to show a reasonable excuse for non-compliance (s 122D(6)). Statutorily this is an evidential burden, not a legal onus to prove beyond reasonable doubt, which affects how prosecutions and defences will be run: defendants must adducesome evidence in support of a reasonable excuse to shift the evidentiary state and trigger the prosecution’s onus to disprove beyond reasonable doubt.

Enforcement modalities and notice

• The regulator uses gazette notices to make the direction (s 122D(2)), and must publish the direction and a QCAT Act s 157(2) notice on the department’s website (s 122D(8)). This publication requirement will be a central element in enforcement because s 122D(10) stipulates that failing to receive a required document (either the s 122D(9) seller notice or a QCAT Act s 157(1) notice for installation/use directions) is not a reasonable excuse. Practically, that makes publication and proactive monitoring more important for affected parties and can simplify an enforcement case by removing lack-of-service defences.

• For sale prohibitions the regulator has a further duty to give a copy of the documents to each person it knows to be, or is likely to be, a seller (s 122D(9)). However, the statutory structure still removes non-receipt of such documents as a defence (s 122D(10)). For continued prohibitions carried across under s 262, the s 122D(8)-(9) requirements do not apply (s 262(4)), but s 262(5) declares those continued directions to have been given by gazette and to apply to all persons for 10 years , the enforcement effect is carried forward mechanically.

Regulation-enabled private notice-giving

• Section 210(6) opens the door for a regulation to provide that electricity entities may give notices requiring action in relation to defective electrical equipment. Those notices, once regulations are in force, will likely become an enforcement/mitigation mechanism industry participants must comply with. The Bill validates pre-commencement notices from electricity entities as if s 210 had been in force (s 261). The validation of past notices affects enforcement history and continuity, and means that enforcement following validated notices can be treated as lawful rather than retrospectively invalid.

Administrative law and review pathways

• The Bill requires the QCAT Act s 157(2) notice to be published (s 122D(8)), which indicates statutory interaction with QCAT procedures. The Bill does not spell out appeal mechanics against a direction, but the linkage to QCAT notice requirements means administrative review channels established in the QCAT Act will be engaged in practice for challenges to the regulator’s decisions.

Practical enforcement consequences

• The evidential onus, combined with the non-excuse rule for non-receipt, shifts procedural burden to regulated parties to monitor publication points (gazette and department website) and to keep records of any notices. Sellers will face particular compliance exposure because sale prohibitions can be targeted at classes of persons and the regulator must notify known/likely sellers, but the statutory non-receipt rule removes that as a fail-safe defence.

• The existence of a 10-year cap with the possibility of reissue means a direction can create long-term business constraints, and enforcement outcomes may have sustained commercial consequences for suppliers, installers and users.

Overall, the enforcement regime relies on publication and statutory validation to make directions binding and enforceable, places evidential burdens on defendants in prosecutions, and provides a statutory channel for regulation to authorise electricity entities to issue remedial notices.

The Bill explicitly links to and alters cross-references with a small set of statutes and instruments, and its operational design intersects with administrative law and prior regulatory schemes.

Interaction with QCAT Act

• The Bill requires publication of a notice complying with the QCAT Act s 157(2) for the decision to give an unsafe equipment direction (s 122D(8)). For installation or use directions, the Bill refers to the QCAT Act s 157(1) requirement to give notice of the decision (s 122D(9) note). These references mean the procedural obligations and potential review rights emanating from the QCAT Act will be operationally relevant to the new regime. The Bill does not alter the QCAT Act itself; it embeds that statute’s notice requirements into the publication process for unsafe equipment directions.

Interaction with the Electrical Safety Regulation 2013

• The Bill removes s 192 of the Electrical Safety Regulation 2013 (cl 9). Section 192 previously allowed the regulator to prohibit sale or use on safety grounds; the Bill replaces that regulatory provision with a statutory power under s 122D and provides transitional continuity for certain continuing prohibitions in force immediately before commencement (s 262). The removal of reg s 192 means future prohibitions will be made under the statutory s 122D mechanism rather than the regulation, changing the instrument used to create prohibitions.

Interaction with administrative law principles

• The regulator’s non-delegable power (amendment to s 122B(2)) concentrates decision-making. Decisions to issue directions must be made by the regulator personally, which creates clearer administrative responsibility and potentially sharper grounds for judicial review based on how the regulator exercises the satisfaction on "reasonable grounds". The Bill’s statutory text does not describe merits review or appeal paths but ties publication to the QCAT Act process, which can provide procedural redress channels.

Interaction with regulation-making power and electricity entities

• The addition to s 210 that a regulation may provide for an electricity entity, or class of electricity entities, to give notices requiring action in relation to defective electrical equipment (s 210(6)) creates an intersection between statutory regulation and private-sector actors. That interaction may shift certain operational responsibilities to electricity entities through subordinate legislation. The Bill itself does not create those regulations, but validates prior notices given by electricity entities by treating them as if s 210 had been in force at the time (s 261). This makes previous statutory gaps administratively tidy by legalising earlier entity-issued notices.

Interaction with Work Health and Safety Act and related amendments

• The Bill omits particular sections previously inserted by the Work Health and Safety and Other Legislation Amendment Act 2024 (ss 11-13). Editor’s notes identify the affected statutes, including the Work Health and Safety Act 2011 and other Acts ultimately amended by the 2024 Act. Schedule 1 also amends the Work Health and Safety Act 2011 by omitting "(1A)" from s 271A(1) and updates cross-references to the relocated s 122E in the Electrical Safety Act (Schedule 1). Those changes reconfigure statutory cross-references and can affect confidentiality or regulator definitions in the WHS framework where s 271A was referenced.

Interaction with existing prohibitions and historical gazette notices

• The transitional provisions list exact gazette dates for prior prohibitions (s 262(8)-(9)). The Bill carries forward those historical regulatory instruments as unsafe equipment directions, and expressly states some of the publication duties in s 122D do not apply to those continued prohibitions (s 262(4)). The Bill therefore both replaces the regulatory mechanism and preserves specified regulatory outcomes in a way that maintains legal continuity.

Overall, the Bill ties the new unsafe equipment direction power into the QCAT Act’s notice framework, removes the prior regulatory prohibition power, provides for possible subordinate legislation enabling private electricity entities to give notices, validates prior entity notices, and adjusts cross-references in the Electrical Safety Act and the Work Health and Safety Act. The net effect is to consolidate prohibition-making in the principal statute while preserving and validating certain prior regulatory actions.

The Bill itself is the primary document for amendment history in the source material. It records a series of changes being made to principal legislation and includes transitional and validation steps. The relevant amendment steps in this Bill are as follows.

• Electrical Safety Act 2002 amendments (Part 2). The Bill amends the Electrical Safety Act 2002 by (i) preventing delegation of the regulator’s power under new s 122D and s 122E (amendment to s 122B(2)), (ii) inserting new s 122D (unsafe equipment directions), and (iii) relocating and renumbering s 206 (electrical safety notification) to s 122E, with subclause adjustments (cl 3-6). These are direct statutory insertions and relocations.

• Regulation-making power expansion (s 210(6)). The Bill adds clause s 210(6) empowering a regulation to provide for electricity entities to give notices requiring action be taken regarding defective electrical equipment.

• Part 24 insertion , validation and transitional provisions. The Bill inserts a new Part 24 into the Act (ss 260-262) to define "new" for the Part, validate pre-commencement notices given by electricity entities (s 261), and continue particular regulatory prohibitions from the repealed/omitted reg s 192 as unsafe equipment directions with specified content and status (s 262). It sets out specified gazette dates for identifying which historic prohibitions are "continuing installing prohibitions" and which are "continuing use prohibitions" (s 262(8)-(9)).

• Electrical Safety Regulation 2013 amendments (Part 3). The Bill omits s 192 of the Regulation (cl 9). That section’s removal is supplemented by the transitional continuations set out in s 262.

• Work Health and Safety and Other Legislation Amendment Act 2024 amendments (Part 4). The Bill omits sections 9, 52 and s 64(1) from that Act (ss 11-13). Editor’s notes show the legislation ultimately amended included the Safety in Recreational Water Activities Act 2011 and the Work Health and Safety Act 2011.

• Schedule 1 (Other amendments). The Bill amends internal cross-references: replacing references from section 206 to section 122E in s 35(1) note and Schedule 2 of the Electrical Safety Act 2002; and omitting "(1A)" from s 271A(1) of the Work Health and Safety Act 2011 (Schedule 1). These are technical amendments to maintain internal consistency after the renumbering.

• Validation clause specifics. Section 261 validates notices given by electricity entities before commencement by taking them to have always been as valid as they would have been if the new s 210 had been in force at that time (s 261(2)-(3)). Section 262 continues certain prior prohibitions as unsafe equipment directions and prescribes how they are taken to have been issued (s 262(2)-(6)).

The Bill’s amendment history here is self-contained: it directly inserts new provisions, omits an existing regulatory prohibition power, relocates an existing Act provision, and creates a transitional framework to carry over and validate pre-existing regulatory actions. The schedule updates cross-references to account for the renumbering.

The Bill, as provided, contains no litigation history. There are no judicial decisions, statutory interpretation disputes or prior cases cited in the text. The source material is an amending Bill and therefore records legislative change rather than judicial outcomes.

Potential litigation-relevant features in the statutory text

• Non-delegation and administrative law exposure. Because the Bill prohibits delegation of s 122D and s 122E powers (amendment to s 122B(2)), decisions to issue unsafe equipment directions will be exercised personally by the regulator; that concentrated decision-making can focalise legal challenges concerning whether the regulator had "reasonable grounds" for the satisfaction required under s 122D(1). The Bill itself does not refer to specific review mechanisms beyond the linkage to QCAT Act notices (s 122D(8)), but the statutory delegates to QCAT procedure mean affected parties will have administrative law avenues and procedural notice entitlements to pursue. The text does not document any existing litigation on these points.

• Evidential burden, procedural compliance and due process. The placement of an evidential burden on defendants to adduce a reasonable excuse (s 122D(6)) is a litigation-relevant rule because it affects evidentiary strategy in prosecutions. The Bill’s silence about merits review, combined with the QCAT Act linkage, means that litigation arising from directions will likely focus on process compliance, statutory satisfaction standards and publication/service rules. Again, the Bill contains no cases.

• Transitional validation of prior notices. Section 261 validates prior notices given by electricity entities. Litigation could, in future, arise concerning the legal effect of that retrospective validation or challenges to actions taken in reliance on notices prior to validation; the Bill resolves those effects by statutory validation but does not reference litigation precedents.

Summary

• There is no litigation history recorded in the Bill. The provisions creating non-delegable regulator powers, the evidential burden on defendants, and the transitional validation of prior notices are litigation-relevant and may give rise to future challenges, but no decisions, cases or judicial interpretations are supplied in the source material.

Several details in the Bill impose particular risks or traps for regulated parties and for those advising them. These are concrete mechanics that can create compliance or operational pitfalls.

1. Non-delegable power is concentrated. The regulator cannot delegate s 122D or s 122E under the amendment to s 122B(2). That means enforcement decisions must be made by the regulator personally. In practice this centralises responsibility, which can speed strategic decision-making but also concentrates legal accountability. Advisors should note who is properly authorised to act for the regulator and ensure procedural checks are followed.

2. Publication is dispositive; non-receipt is not an excuse. The regulator must publish directions and a QCAT Act s 157(2) notice on the department website (s 122D(8)). For sale prohibitions the regulator must also give copies to sellers it knows or is likely to know (s 122D(9)). However, s 122D(10) expressly provides that failing to receive a document required to be given (either under s 122D(9) or QCAT Act s 157(1)) is not a reasonable excuse. The practical effect is that regulated parties cannot rely on not having been personally served; they must monitor the gazette and the department website to detect directions.

3. Evidential burden on defendant. The defendant carries an evidential burden to establish a reasonable excuse (s 122D(6)). This alters evidentiary strategy, defendants need to be prepared to adduce evidence showing their excuse to place a burden on the prosecution to disprove it.

4. Broad scope of directions. A direction may target an "item" or a "type" of electrical equipment and may specify persons or classes to whom it applies (s 122D(1)-(3)(a)). The regulator may therefore craft directions with wide coverage, creating systemic compliance costs across supply chains. The capacity to reissue the same direction repeatedly (s 122D(4)) enables long-term restrictions.

5. Maximum period and reissuance interaction. Directions must state a period not exceeding 10 years (s 122D(3)(b)) but can be given more than once for the same item/type (s 122D(4)). Practically, that can create near-permanent regulatory constraints through sequential reissuance rather than an indefinite single order.

6. Transitional exceptions to publication/notice duties. Section 262(4) disapplies s 122D(8) and (9) for continued prohibitions that were in effect immediately before commencement under former reg s 192. Those continued prohibitions are nonetheless declared to have been given by the regulator by gazette on commencement, to apply to all persons, and to run for 10 years (s 262(5)). Affected parties should not assume that lack of the usual publication steps signals a gap in the legal effect of those continued prohibitions.

7. Electricity entities can be empowered by regulation to issue notices. Section 210(6) allows a regulation to give electricity entities the authority to require action in relation to defective equipment. This creates the possibility of statutory notices originating from private-sector entities; the Bill validates prior entity-issued notices as if s 210 had been in force (s 261). Organisations should prepare for private notice regimes to be created by subordinate legislation and be aware that such notices may be retrospectively validated.

8. Repeal of reg s 192 and conversion of prior prohibitions. The Bill omits reg s 192 (cl 9) and converts specified prior prohibitions into the new statutory form, with listed gazette dates to identify which prior documents continue (s 262(8)-(9)). Those historical dates are precise; reliance on a different historical prohibition date will not fall within the transitional continuation.

9. No new civil compensation scheme in the text. The Bill creates directions and penalties but does not create a parallel compensation or remediation fund for commercial losses arising from a direction. Affected businesses will need to consider commercial arrangements, contractual clauses and insurance implications in anticipating directions.

10. Cross-references updated; practitioners must adjust. The renumbering of s 206 to s 122E and the schedule amendments will change statutory citations in compliance documents, licences and contracts, and in internal compliance software. Schedule 1 updates cross-references; practitioners must ensure internal and external documentation is aligned.

These are not advisory warnings but mechanical consequences that follow directly from the text. Each can translate to operational behaviour changes: monitoring publications, updating contractual allocation of risk, and preparing evidential records to meet the evidential burden if prosecuted.

Practical compliance steps follow directly from the statutory text. Compliance tasks are obligations flowing to sellers, installers, users, persons in control of equipment, electricity entities, and advisers.

1. Monitor official publication channels continuously

• Because unsafe equipment directions are issued by gazette notice (s 122D(2)) and must be published on the department’s website with a QCAT Act s 157(2) notice (s 122D(8)), affected parties should institute continuous monitoring of the Queensland Government Gazette and the department’s website. Section 122D(10) makes non-receipt of required documents not a reasonable excuse, so passive reliance on regulator service is insufficient.

2. Update internal supplier/distributor controls

• Sellers, importers and distributors should map their product lines against current and historical prohibitions. The Bill allows directions to prohibit sale of an item or a type of equipment (s 122D(2)(a)), and prior prohibitions listed in s 262 are continued as directions. Create recall and removal processes, and ensure stock controls prevent prohibited sales.

3. Amend contracting and procurement processes

• Procurement and installation contracts should be reviewed to add notice-compliance clauses and allocation of risk for sudden unsafe equipment directions. Installers must note that installation prohibitions are an explicit direction type (s 122D(2)(b)), and under the transitional provision former "use" prohibitions are taken to include installation (s 262(6)). Contracts should require contractual parties to monitor and comply with statutory directions.

4. Evidence collection and retention

• Because defendants bear an evidential burden to show a reasonable excuse (s 122D(6)), businesses should retain contemporaneous records that could support such a defence: purchase records, supplier communications, internal due diligence, technical assessments, steps taken after receiving a notice, and any compliance actions. These records will be central if an evidential burden arises in enforcement proceedings.

5. Responding to electricity entity notices

• If and when regulations are made under s 210(6) authorising electricity entities to give notices requiring action, entities and persons in control of equipment must follow any specified compliance process. For notices already given before commencement, s 261 validates those notices; recipients should treat them as lawful and act accordingly.

6. Update compliance registers and product safety teams

• Add a specific register of unsafe equipment directions and validated prior notices to compliance-management tools. Assign responsibility within organisations for checking the department website and the gazette and for tracking the expiry or reissuance of directions (directions have a period not more than 10 years but may be reissued under s 122D(4)).

7. Liaise with suppliers and legal counsel when a direction is published

• On publication of a direction affecting your products or activities, promptly assess scope (persons/classes named under s 122D(3)(a)), duration (s 122D(3)(b)), and legal obligations. If the direction is ambiguous about how it affects particular goods or activities, obtain legal advice early to determine whether a reasonable excuse may be available and how to substantiate it.

8. Prepare for enforcement and administrative review

• Because the Bill references QCAT Act s 157(2) notices (s 122D(8)), affected persons should be ready to use administrative review or tribunal processes as appropriate. Ensure any challenge or response is lodged within statutory time limits established under the QCAT Act or other relevant statutes and supported by documented evidence.

9. Insurance and commercial risk management

• Evaluate existing insurance coverage for product recalls, regulatory enforcement and business interruption. The Bill does not create compensation arrangements; businesses will need to decide whether insurance or contractual indemnities are needed to manage the commercial risk of long-term prohibitions.

10. Technical compliance and standards evidence

• The regulator may consider relevant safety standards or "any other relevant matter" when forming its satisfaction (s 122D(7)(a)-(b)). Manufacturers and suppliers should maintain records demonstrating compliance with relevant Australian or international standards and be prepared to show those records in regulatory or enforcement contexts.

11. Update statutory references and documentation

• After commencement, update any internal or external documentation to reflect the renumbering of s 206 to s 122E (Schedule 1) and the omission of reg s 192. Ensure licences, compliance manuals and regulatory checklists reflect the new statutory structure.

Following these steps aligns practical compliance actions with the statutory design set out in the Bill. The overarching practical requirement is proactive information monitoring coupled with documented technical and commercial steps to mitigate the operational impacts of unsafe equipment directions.
